A Jacksonville police officer with nine years on the force was arrested Tuesday after an image of a nude girl was found on his cellphone that led to a rape charge, according to Undersheriff Pat Ivey.

Matthew Harper Butler, 39, was charged with capital sexual battery of a victim younger than 12 and remained behind bars on $1 million bail after his 6 p.m. booking, according to Duval County jail records. He immediately resigned his position as an attempt was made to interview him, the undersheriff said.

His arrest was the second of a Jacksonville police officer in the past week, another jailed Sunday on three counts of aggravated assault with a deadly weapon after his girlfriend and two other women were threatened with a gun, the Sheriff’s Office said. Nine Sheriff’s Office staff, including police and corrections officers, were arrested last year, Ivey said.

The Sheriff’s Office’s Integrity unit received a tip Friday that Butler, who was assigned the downtown beat, had the image of the underage girl on his cellphone, Ivey said.

“Information came forward, and I think he made a statement to someone, who then notified us,” Ivey said. “We went and got him.”

No other information on the girl or Butler’s relationship to her was released. The undersheriff said investigators have seized all of Butler’s electronics to search them.

“We will take this case and go wherever it takes us,” Ivey said.

Curious how a naked pic led to rape charges, but not to child porn charges. That better be coming ASAP.

I'm not sure if it's worse if the child under 12 sent the picture herself and already has that many issues, or if it was taken in person against her will. Either way, poor kid. That's so fucking young.

If we have to eat an entire cheesecake and take a nap, get the cheesecake and some blankets, because we are on the case. Hear me loud and clear, justice will be served in this case."
 
I am continually dumbfounded by people having this kind of content on their phones. Especially dumbfounded by those who transmit the images over thier phones. Hell, as a cop he should be especially aware of the fact that everything you transmit can be easily requested and ripped by the provider, turned into a well-organized and searchable database-type-thingy (that's a technical term) on a friggin DVD, and submitted as evidence. And it doesnt matter if you delete it. In fact the data set specifically flags anything the user deleted to make it easier to find. Cell phone data is not yours. It sits in your provider's hardware and they will hand it over to anyone who can produce a valid warrant.

Still pleased that he got caught, naturally. I just get indignant when people seem to think their cellphone contents are in any way private or protected.
