Johnny Caphart was sentenced to life in what prosecutors called “the worst sexual-abuse case they’ve ever seen” is getting a new trial.

Caphart challenged his conviction, arguing the trial court failed to inform him of the minimum and maximum sentences that could be imposed upon him.

A district court judge denied Caphart’s petition challenging his conviction. The judge’s ruling was later overturned during an appeal process with the criminal court of appeals.

In 2015, Caphart was sentenced to serve four life sentences for charges of rape, sodomy, child abuse and producing pornography. The victims were 12, 15, and 17 years old at the time of his arrest and had undergone abuse most of their lives.

A Montgomery man at the center of a disturbing child sex abuse case accepted a plea deal Monday just as his trial was beginning.

Johnny Caphart pleaded guilty to 12 of the 64 charges against him, including rape, sodomy, child abuse and producing pornography. Prosecutors say his three victims suffered abuse for six years. The investigation began when one of the victims reported the abuse to a school resource officer.

"She had enough and she went to her police officer at her school and told him what was happening," said Montgomery County Deputy District Attorney Seth Gowan. "The thought of anyone doing doing this, it's just... it's horrible. And the fact that this went on as long as it did is just inexcusable. That's why we held firmly that he go to prison for life."

“(One of Caphart’s daughters) looked at her father as a jealous boyfriend. He was controlling, manipulative. He would get jealous if he saw her talking to a boy,” said Montgomery County District Attorney Daryl Bailey as he referred to Caphart’s mental evaluation.

“If she talked to a boy she would get slapped, stomped, or forced to have rough sex. She believes she had sex with her dad over 200 times.”

Bailey added that in his 20 years as a prosecutor, this is the worst sexual abuse case he’s seen.

Weeks before Johnny Caphart was sentenced to four terms of life imprisonment for sexually abusing his children, one of his daughters said to Judge Truman Hobbs that she was not a victim. She was a survivor.

“I’m standing here by the grace of God. (Caphart) doesn’t have any control over me at all. I’m here with a smile on my face. I’m happy. He made me stronger. He didn’t make me weaker,” his daughter said, enunciating each word clearly and confidently.

Her two sisters stood by her side, both of whom had also been abused physically, psychologically and sexually by their father for most of their lives.

Johnny Frank Caphart has been sentenced to life in prison after pleading guilty to sexually abusing three family members, which Montgomery County District Attorney Daryl Bailey described as "one of the most harrowing and shocking cases" to come through his office.
Caphart, 40, was convicted of first-degree rape, aggravated child abuse and production of child pornography. He received three life sentences for rape, which Bailey said reflect the three lives that were "forever scarred by Caphart's horrendous crimes." He received an additional 20 years without the possibility of parole for the production of child pornography charge.
Caphart subjected three female relatives to years of ongoing sexual abuse, forcing the girls, who were as young as 12 at the time of his arrest, to engage in sexual acts with him "countless times," Bailey said. The survivors said at the time that Caphart acted like a "jealous boyfriend" despite being related to them.
In September 2015, Caphart took a plea agreement in which he pleaded guilty to 12 of 64 charges, while the remaining 52 were dismissed. He was sentenced in 2015 to four terms of life imprisonment but in 2019 was granted a new trial.
Shortly after he was sent to the Alabama Department of Corrections, Caphart received a letter from the Alabama Bureau of Pardons and Paroles informing him that he would not be eligible for parole since Alabama law barred anyone convicted of a sex crime against a child under the age of 12 from being released on parole.
He filed an appeal of his sentencing in May 2018, claiming that he was never told he wouldn't be eligible for parole. He also argued that he was told the minimum punishments for sodomy, rape and production of child pornography would be 10 years, when in fact it was 20 years. The first appeal was denied, but then he filed another.
The Alabama Court of Criminal Appeals agreed that Caphart wasn't given sufficient information about possible punishments when he took the plea agreement and granted him a new chance at trial, but still made him face the original 64 charges. He was returned to the Montgomery County Detention Facility in 2019, where he was held under $1.5 million bond.

Bailey said that he hoped the sentencing will bring "some semblance of peace" to the survivors of the abuse.
