New York DJ accused of having how-to video on child porn

A wedding disc jockey has been accused of sharing an instructional video showing how to sexually abuse children.

The case was referred to the Queens district attorney's office by police in Wheaton, Ill., who said they found two child porn videos in an Internet file-sharing program the DJ was using in February.

One video shows a 4-year-old girl performing a sex act on a man; the other gives advice and examples on how to sexually abuse minors, authorities said.

Dominick Guerra, 29, of Ozone Park, Queens, is charged in a criminal complaint with possessing and promoting child pornography. He was arraigned Thursday and held on $100,000 bail, according to the district attorney's office.

The DJ would face up to seven years in prison if convicted.

The name of Guerra's attorney could not immediately be determined.

The criminal complaint says the defendant admitted in a written statement that he downloaded and viewed numerous child pornography videos from the Limewire online file-sharing program.

"The charges are very disturbing," Queens District Attorney Richard A. Brown said in a statement.

"There is a national connection to this case which frighteningly shows the far reach of the Internet in dispensing child pornography," said Brown. "It is imperative that we vigorously prosecute this case so that our children remain safe from predators who share information to carry out their depraved acts."

An Ozone Park disc jockey who was accused in April 2008 of possessing child pornography was vindicated last week. His case was dismissed and sealed because of insufficient evidence, according to his lawyer.

Dominick Guerra is trying to clear his name. Last year, the Queens District Attorney’s Office charged the 30-year-old DJ with possession of an instructional video on how to sexually abuse children.

The case was referred to the district attorney by the Wheaton, Ill. police department, which said it found two child porn videos in February 2008 after tapping into Guerra’s file-sharing activities on Limewire.com.

After he was arrested, the NYPD Computer Crime Squad searched Guerra’s home and confiscated a desktop computer, two laptops — one of which he shared with his mother and sister — and several external storage devices.

The squad conducted several searches throughout the last year and was unable to find anything, according to Guerra’s lawyer, Peter Brill. “They searched them all again using a more rigorous search technique looking for remnants of deleted files,” Brill said. “It’s almost impossible to delete a file completely and, guess what, they didn’t find anything.”

The Wheaton police, who were cruising Limewire in search of Internet pedophiles, claimed they got a hit on a computer that was linked to Guerra’s IP address, according to Brill.

“There are plenty of sophisticated users out there who can mask their IP addresses,” the lawyer said. Noting that the Wheaton police don’t have the same level of sophistication, Brill added, “There’s no way to know if someone was … masking their IP [or] leaching off Dominick’s WiFi service, which is also common. There’s just no way to know. All I can tell you is that Dominick categorically denies, and has always categorically denied, having these things.”

Guerra said his life was turned upside down throughout the last year. In addition to destroying his reputation among friends and acquaintances, the allegations cost him several jobs — Guerra performed as a DJ at weddings, bar mitzvahs and other parties.

From start to finish, the experience was traumatizing, according to the DJ, who has lived in Ozone Park his entire life. The morning of his arrest, police burst into his home, woke him up and pulled him out of bed, terrifying him and his family — none of them knew what was going on.

Police then searched his home and confiscated his belongings. Guerra said he cooperated with police every step of the way, even showing them where they could find his work laptop, which was kept in the basement.

While he works to repair his image in the eyes of his clients, friends and neighbors, and to clear his name, Guerra said he doesn’t blame anyone for what happened and harbors no anger or resentment toward police. “They were just doing their job.”

I'm curious what led the keystone-kops to him in the first place.
Probably a Prenda Law style honeypot (Hint - It didn't work out so well for Prenda either).

Said they were playing around with his shared files with Limewire.. not sure they came across those.. anyone who spent a good amount of time downloading came across something that made you scratch your head ..
