Police in Jefferson City, Missouri said 26-year-old Quatavia Givens has been arrested on suspicion of first-degree child abuse resulting in the death of 4-year-old Darnell Gray.

Givens had previously been identified as the caregiver who originally reported Gray missing.

Lt. David Williams said Tuesday Gray did not die on "his own accord," and said the Federal Bureau of Investigation (FBI) evidence team was assisting the Jefferson City Police Department in its investigation.

Givens, who was watching Darnell Gray, reported to police that the boy was last seen between 11:00 pm and midnight on October 24 when he went to sleep. At 7:00 a.m. Thursday, she reported that Gray was missing – launching an Endangered Person Advisory shortly after and including the help of more than 100 first responders over more than five days.

On Tuesday, Jefferson City Police Lt. David Williams announced that Gray was found dead by a searcher at an undisclosed location. Williams said the place the boy’s body was discovered was not previously searched but was on a path identified through the investigation.

The woman who reported 4-year-old Darnell Gray missing from his Missouri home last week is now charged in his death, PEOPLE confirms.

Quatavia Givens, Darnell’s father’s ex-girlfriend who was taking care of him when he went missing, is charged with first-degree child abuse resulting in death.

Darnell’s father told local station ACB7 he had asked Givens to watch his son while he visited his sick mother in Chicago, where Darnell was originally from.

“I trusted her to watch him. But I wasn’t expecting her to do this to him,” Kijuanis Gray told the station.

Gray told the station he is no longer with Darnell’s mother, who lives in Chicago, and that he moved to Jefferson City with his son in search of a better life.

Police have not revealed how Darnell died.

A judge allowed a blob accused in the death of a toddler in late 2018 to post a lower bond and get out of jail ahead of her trial.

4-year-old Darnell Gray was found dead. Gray was first reported missing on October 25, 2018; his body was found several days later. An autopsy showed Gray died from blunt and sharp force trauma.

Quatavia Givens had been in the Cole County jail on $100,000 cash only bond. In an order filed Monday, Judge Jon Beetem noted Givens was unable to pay that amount of cash. He determined Givens would not present a threat to the community if released, saying "the specific circumstances of the crime charged, however heinous, [do] not suggest a risk of repetition."

Beetem also found Givens isn't a flight risk. The probable cause statement, Beetem said, indicated Givens had talked during the investigation about going to Florida. But he determined she doesn't have the financial means to leave the state, therefore her flight risk is low.

Beetem released Givens on the following conditions:
  • She post a $5,000 bond
  • She submit to GPS monitoring until further order of the court
  • She contact the court weekly
  • She stay at the address listed with the court's Pre-Trial Services Office, traveling only to and from court with approval
  • She is to return to court for all appearances unless excused
  • She pay for any private supervision services which may be required
  • She may not be in the presence of minor children who aren't her own, and any in-person contact with her own child under supervision of the child's legal guardian
  • She has no contact with the victim's family
 
A court appearance for the woman charged in the death of a 4-year-old Jefferson City boy has been pushed back once again.

Quatavia Givens is charged with second-degree murder, child abuse, or neglect and endangering the welfare of a child in the death of Darnell Gray.

A trial for Givens was originally set for July 13 and was expected to last five days however, due to COVID-19 limitations the trial was canceled until another date is set. Givens was set to appear in court on July 28 for a criminal setting however, that has now been pushed back to September 22.

Online court records state the case has been continued because the court is "awaiting the report of status of jury trials in Johnson County." This is due to Cole County Circuit Judge Jon Beetem granting Givens a change of venue. Givens' jury will come from Johnson County.

Givens has been out on bond since Oct. 9, 2019, just days after Beetem ordered Givens' release on conditions. Givens was charged with second-degree murder a little more than two weeks after her release however, no warrant was issued.

According to online court records from Tuesday, Givens is "in compliance."

Back in October, Cole County prosecutor Locke Thompson said he had been told Givens' home plan would be in the St. Louis area.

"We're working hard to make sure we get this case tried as soon as possible," Thompson said during an interview in Oct. 2019.

According to the order, Givens had to post a $5,000 cash or surety bond and keep a GPS monitor on her until further order from the court. Givens must also abide by the following:
  • Contact pre-trial services office weekly as directed
  • Remain at the address given to pre-trial services and be permitted to travel to and from court
  • Pay for any private supervision services which may be required
  • May not live in home with or be in the presence of minor children who aren't her own. Any in-person contact with her own child will be permitted only to the extent it is allowed by the child's legal guardian
  • No direct or indirect contact with Darnell Gray's family
  • Return to court for all scheduled appearances unless excused
The order said the court reviewed the conditions of the previous bond set at $100,000 cash-only, which Givens couldn't post due to being unemployed. The order also states that Givens' flight risk is low given her socioeconomic status.

How’d I miss this one? Address they gave is for a neighborhood called crack alley. Used to have friend that lived there. I was 15 and remember stepping over babies on the floor while people sat around smoking weed. My friends mom stole our weed money and would only give us some crack. This place is next to a major highway and on the other side is a playground. Several times very small unattended children have tried tried to cross the highway. It used to upset my dad because his fire station was in the area and when the kids were injured he had to go attend to them. Oh and another time I was in that neighborhood I was car jacked.

Quatavia Givens was declared incompetent by Cole County judge William Hickle.

Givens is charged in the death of 4-year-old Darnell Gray.

Gray's body was found missing several days after he was reported missing on Oct. 25, 2018. The autopsy obtained by previous KOMU reporting showed that Gray died from blunt and sharp force trauma.

According to Cole County prosecutor Locke Thompson, Hickle said that while Givens understands the court proceedings, she is unable to aid in her own defense.

Givens has now been committed to the Missouri Department of Mental Health, and will undergo a case review on March 7, 2024.
Givens was Gray's caretaker at the time of his death. She participated in search parties for the missing boy before his body was discovered.

The defense argued Wednesday that Givens had post-traumatic stress disorder and filed a motion to have her declared incompetent

She is listed on the Cole County Jail online roster, but was admitted to Fulton State Hospital last year.

Court documents say that Givens allegedly struck and smothered Gray, resulting in his death.
A state psychologist last week argued in court that Givens is competent to stand trial. She was deemed incompetent in 2023.
Judge William Hickle made a decision on Tuesday that Givens is mentally fit to proceed and criminal proceedings will resume. Givens will remain in the Department of Mental Health’s custody.
 
Quatavia Givens pleaded guilty to second-degree murder, child abuse, and abandoning a corpse in the death of 4-year-old Darnell Gray. She had been charged with first-degree murder, child abuse, first-degree endangering the welfare of a child, and abandoning a corpse in relation to the death.
The agreement included a life prison sentence for murder, 15 years for child abuse, and four years for abandoning a corpse, to be served concurrently.

Cole County Prosecutor Locke Thompson says that under the agreement, Givens will be eligible for parole.
“It is an 85% offense in Missouri, basically at 30 years,” Thompson said. “That is what they calculate, a life sentence, so to speak, to be in Missouri. They will have the option, though, to keep her beyond that.”

Givens was deemed mentally competent to stand trial last year after initially being found unable to assist in her defense in August 2023.

After being read her rights on Friday, Givens told the judge she was taking medication from the state hospital but was in a clear state of mind and understood and admitted to the charges.
