A man who raped an elderly woman has begged to be allowed out early less than a year into his jail stretch.

Christo Brown will stay behind bars after his appeal bid was refused by a judge.

His lawyers unsuccessfully argued it was unfair that evidence intended to prove he had a tendency to sexually assault sleeping women was produced during his trial.

He was sentenced to eight years with a non-parole period of four years over his sickening crime in the Australian city of Launceston.

Brown was 18 when he entered his 76-year-old victim's home in July 2015.

Brown, who is from Sudan but grew up in Tasmania, broke into the woman's home with his face covered with a black jacket and demanded cash and sex from the elderly woman.

Examiner reports he then ordered her to take off her clothes, raped her, and then demandedd AUD$250.

He was convicted of rape, aggravated burglary and demanding property with intent to steal over the crime, and was jailed in September 2018.

He had a prior conviction of indecent assault in Queensland for getting into a sleeping women's bed at a youth hostel and assaulting her.

Australia's Court of Criminal Appeal Acting Justice Shane Marshall rejected the appeal, reportedly saying that while Brown's sentence was longer than some in recent years from a single count of rape, there were not enough mitigating factors aside from his youth to entitle him to discounts in the tariff.

"The appellant pleaded not guilty and forced an elderly complainant to give evidence. There was no evidence of remorse," Justice Marshall reportedly said.

He added psychiatric assessments showed Brown was considered to be at high risk of committing further sexual violence, and he lacked empathy.

He will be eligible for parole in two more years.
 
Evidence or testimony from prior crimes is often not admitted. This has lead to justice not being served in quite a few cases.

Makes it really sound like Australia doesn't find just a "Single" count of Rape all that terrible of a thing....
