Michael David Ross, of Des Moines, is being held without bond in the Polk County Jail on charges of child endangerment and neglect of a dependent person. He has not been formally charged in court.
The baby was first admitted to the hospital in June with bleeding in the brain. Police immediately arrested his mother, 21-year-old Cheyenne Foltz, and charged her with four counts of child endangerment and one count of neglect of a dependent person.
Court documents indicate the baby suffered a brain bleed, a broken femur and a broken hip within two weeks of each other. A criminal complaint says Foltz allegedly inflicted the injuries after becoming frustrating when the baby wouldn't stop crying.
A February trial is scheduled in her case.
The baby was returned to his father after a stint in foster care, said Sgt. Paul Parizek, spokesman for the Des Moines Police Department. He was re-admitted to the hospital Aug. 26 with additional bleeding in the brain after suffering what Ross told police was seizure-like symptoms, he said.
"Based on statements, the mother has not had any contact with the child since her arrest, and Ross was the primary caregiver for the child at what would have been the time of the injury that resulted in the new brain bleed," Parizek said.
Medical reports indicate the baby's injuries were consistent with being "violently shaken," he said.
