On Friday, a man was charged with seven counts of murder in the death of a 3-year-old boy at an Eagan foster home.

Charles Wayne Homich, 28, has been indicted by the Dakota County Grand Jury with four counts of first-degree murder and three counts of second-degree murder.

These charges stem from the death of 3-year-old Zayden Lawson, a foster child in the care of Homich's girlfriend, Zeporia Fortenberry, 31, in June of 2017.

Fortenberry was charged on April 16 with one count of manslaughter in the second degree (child neglect; knowingly permits continuing physical abuse) and manslaughter in the second degree (child neglect or endangerment). The case against her is still pending, according to court documents.

According to the criminal complaint, on June 7, 2017, around 3 p.m., Eagan police officers and paramedics responded to a call that a 3-year-old was not breathing. The child was found to be cold to the touch and without a pulse. He was transported to Children's Hospital where he was pronounced dead.

An investigation in the case revealed that on June 6, while Fortenberry was working the night shift and left her two children, Lawson and his younger brother in the care of Homich, her live-in boyfriend.

An autopsy revealed his death was due to multiple blunt force injuries.

The friend of the foster mom reportedly said she had been watching Lawson overnight about four times a week because of an incident in which Homich had "whooped" the boy. The complaint alleges she said she heard Lawson tell his foster mom that Homich had hit him in the head because of a dirty diaper.

She reportedly alleged Homich would "loose his cool" if he had to change one of Lawson's dirty diapers.

The complaint goes on to allege investigators found a text message from Homich to his mother on June 12 in which Homich reportedly said "Mom I'm about to go to prison." The complaint also alleges there are texts in which investigators claim it appears he is asking his mother to take the blame for Lawson's death.

One of Homich's co-workers also is alleged to have told investigators that prior to Lawson's death he had been on break with Homich who told him he had punched Lawson in his stomach.

Homich also reportedly told a coworker that he had punched Zayden in the stomach and that Zayden became, "really sick and his vomit was black," according to the complaint.

When the coworker told Homich to bring Zayden to a doctor, charging documents say Homich feared, "the doctor would see his bruises and Lawson is old enough to tell him who gave him the bruises."

Omg that poor baby...and both those fuckers look like they got MAYBE 3 brain cells between them...what fuck nut state agency would give that bitch the ability to foster....oh wait....

Foster homes are desperately needed. Almost anyone can be a foster parent. The sad part is, not everyone that becomes a foster parent does it to make a difference.
Some do it for the cash.

@Keepalowprofile

One of other major problems is who the foster parent allows into their home around the child.

I highly doubt she informed the agency that the child would be in this man's presence or that he completed a background check.

I am sure when he asked his mama to take the blame she informed him: I have a dick I am currently riding that is more important than you- just like the foster mother did to Zayden when he was being abused.

Real fucking tough guy that beats the shit out of a 3-year old then tries to get HIS mama to take the rap because he can't handle prison. Have fun in the slam asshole.

As to the foster mom - Real class act you got there honey. See what covering for him got ya?

And people wonder why suicides spike during the holidays. Humanity seriously needs to pause their shit for at least a week.

What an awful end to what must have been a very difficult life. This poor child. I'm amazed by his bright smile, how it's not dimmed by the filth surrounding him. Rest in peace, Zayden. This Mama would've wrapped her arms around you and kept you safe. So many would have. I'm sorry you ended up with a piece of shit waste of human life instead.

A woman entered a guilty plea and was sentenced Thursday in the death of her 3-year-old foster child in June, 2017.

According to court records, Zeporia Fortenberry entered a guilty plea towards manslaughter in the second-degree child neglect and was sentenced for just under three-and-a-half years in prison (41 months).

According to a criminal complaint, emergency personnel were called to an Eagan townhome on June 7, 2017. When they arrived, they found 3-year-old Zayden Lawson laying on his back on the living room floor, unconscious and not breathing. Medics were unable to revive Lawson, and he was transported to St. Paul Children's Hospital where he was pronounced dead.

According to the complaint, an autopsy showed the death was due to multiple blunt force injuries.

The complaint also says the foster mother told police she believed Homich had something to do with Lawson's death. A friend of Fortenberry and one of Homich's coworkers also allegedly each told police Homich had hit the boy, according to the complaint.

Fortenberry will also owe $230 in court fees.
