]. 29-year-old Kentucky man with a history of being declared incompetent to stand trial -- following allegations of sexual assault and other crimes -- is now accused in a brutal attack on an 8-year-old girl, according to reports.

Authorities in Louisville say Cane Madden, 29, is scheduled for arraignment Monday after being arrested early Saturday for allegedly whacking the child in the head with a shovel, fracturing her skull, then raping her.

Madden was accused of at least one previous sex crime, WDRB reported. In that 2017 case, according to police, Madden “bit the victim on her face above her left eye, removing a large chunk of the victim’s face.”

The charges in that case were dismissed after a judge found Madden incompetent to stand trial, the station reported. Madden has also seen other assault cases against him dismissed, according to the Courier-Journal.

In the 1950s there were 33 mental health beds for every 100k people, by 2010 it was down to 14. Starting with the Kennedy Administration, the removing of mental hospital beds were done by State and Federal lawmakers, both Democrats and Republicans, passed bipartisan bills/laws that would lower the need for beds and all were done for "humane" reasons, though the consequences were not thought through. The politicians aren't the only responsible, even the ACLU has much blame. Cases after case, the ACLU has fought against both involuntary admission to a mental institution and involuntary drug treatment, again for "humane" intentions.

The mental health crisis is a prefect example of "the way to hell is paved with good intentions".

I watched that doc on Rosewood (in your neck of the woods) a couple of weeks ago. The effects of funding cuts on the most vulnerable of us is tragic .

I would like to hear what his victims have to say about all this.
 
I dont understand why charges were dismissed instead of him being found guilty but insane or even not guilty by reason of insanity, niether of which would have been a get out of trouble free card(at least not entirely). There would still be that on his record, which is significant, and he would have been forced by the State to receive some measure of help.

I mean we all know it's complete and total bullshit that he wasnt caged until he dies from the first assault on and that mental illness doesnt cause anyone to rape and therefore should never be permitted as a defense in such crimes. These are objective facts and can not be argued with. We also know that no amount of therapy or counseling would have prevented him from striking again.

But it's still the principle of it. Why was he not caged or put in an insitution until he was deemed safe for society, until he was deemed cured of his mental weakness the State was so convinced he suffered from?

I dont understand why he was instead just thrown back out AT society, charges dismissed entirely. Very bizarre way of handling a nutter defense. "Oh he's crazy? Well then he can do whatever he wants and the State wont stand in his way, charges dismissed, let him go free, no strings attached!"

So fucking bizarre. Really wish a single journalist would get off their ass and dig into this one. What a shitshow.


Anyways, very interested if this was a random attack or if some asshole relative/friend needs to be punished as well for letting a known violent scumbag around their child.

The price we pay for having mercy on violent criminals, for any fucking reason, and for not caring about victims in this nation.

Vengeance should trump ALL else, the protection of society should trump ALL else anyways. Shouldnt matter if someone has no fucking clue what's going on cuz theyre mental incompetents(which def is NOT the case here), these people should be put to the fucking sword, or at least left to rot in a cage forever.

A man accused of raping an 8-year-old girl is now charged with breaking into the Mockingbird Soccer complex.

Police say his mugshot helped crack the case.

Police say he broke into the sports complex on Mellwood Avenue, near Zorn Avenue, in May, by throwing a rock through a window.

According to police, security video shows the thief taking items from the concession stand and relieving himself on the floor.

Madden was arrested earlier this month after police say he hit a girl over the head with a shovel in her backyard, raped her, and stole her iPad.
 
A judge said Friday she will soon decide whether to rule Cane Madden mentally incompetent to stand trial for allegedly raping and fracturing the skull of an 8-year-old girl in August. It's a decision that could result in him walking free from the criminal charges.

Jefferson Circuit Court Judge Annie O'Connell, the judge over the case, already found Madden incompetent to stand trial once. Last February, she declared Madden mentally incompetent in a separate violent sexual assault case in which he was accused of biting a woman's face, "removing a large chunk," according to his arrest report.

That previous decision is the reason Madden's public defender says Madden's newer charges, involving the 8-year-old, should be dropped immediately.

Public defender Steven Harris reminded O'Connell of the previous finding in which she wrote Madden was "unlikely to regain competency in the foreseeable future."

"No program or medication has been able to make him competent," Harris argued. "There is a very good likelihood we will end up back where we are now."

His argument, in part, is that under Kentucky law, "foreseeable future" is defined as no more than 360 days, meaning that at the time of the alleged sexual assault of the child and now, Madden would still legally be considered incompetent.

Prosecutors, meanwhile, are now asking for new mental health evaluations after the August crime. Competency can come and go, they've argued.

I get the distinct feeling that no matter how batshit crazy he may be, he still knows the laws surrounding everything he does better than his public defender. That line up timeline is as insane as he is. Are they sure there isn’t some bath salts or something involved along the line?
