The baby son of a woman murdered by a family of womb raiders in Chicago has died in the hospital, two months after being torn from her belly.

Yadiel Lopez had been on life support since April 30, when he was cut from his mother Marlen's womb by Clarisa Figueroa and her daughter.

Marlen had gone to their home to pick up baby clothes after speaking to Clarisa on Facebook.

She was strangled and the women then used a butcher's knife to cut the baby from her stomach and pretend he was their own for weeks before DNA testing proved otherwise.

The baby boy's father, Yovani, had been praying for his recovery and was hopeful that he would survive.

Despite weeks of promising false starts, like when the baby opened his eyes, he never regained full brain function and was pronounced dead in the hospital on Friday.

'It is with great sadness that we inform you of the passing of baby Yovanny Jadiel Lopez. He passed away this Friday June 14, 2019 from his severe brain injury.

The grieving father of a baby who was cut from his mother's womb after she was murdered by people who pretended to be his parents has slammed the hospital where he was taken and says it is 'unfair' its staff have been cleared of wrongdoing.

Yovany Lopez spoke on Tuesday to condemn the state of Illinois' decision to clear Advocate Christ Medical Center of wrongdoing.

Yovany condemned the decision at a press conference on Tuesday where his family had been mistreated from the beginning because they are Hispanic.

'It's not fair that the state of Illinois and the hospital want to take advantage of one for being Latino and abusing our trust, the truth is very painful, losing a family, his wife and his son,' he said.

'It's not right the way we're treated. We want justice for my wife and son,' the 20-year-old said with his toddler son clinging to his chest.

What justice can the hospital offer this man except a large cash settlement.

His family was wronged by another Latino not the hospital or the police.

In an email written June 12 to Christ Medical Center President Matthew Primack, the Department of Health and Human Services said that “as a result of the May 24, 2019 substantial allegation survey, [the hospital] was found in compliance with the Medicare Conditions of Participation and will continue to be deemed to meet applicable Medicare requirement.”

An Illinois Department of Public Health spokesperson could not provide additional information on the details of the investigation, citing the Hospital Licensing Act.

The IDPH launched the investigation in May after Clarisa Figueroa, her daughter Desiree and partner Piotr Bobak allegedly killed the mother and tried to pass the baby off as their own.

After strangling Ochoa-Lopez, Figueroa called 911 and was transported to Christ Medical Center, where she told medical staff that the baby was hers, authorities said. Despite showing “no signs consistent with a woman who had just delivered a baby,” a “mandated reporter” did not notify the Department of Child and Family Services about the newborn until May 9, DCFS spokesman Jassen Strokosch said.

“There is no doubt in our minds that on April 23, 2019 mistakes occurred at this hospital. There were red flags everywhere,” Contreras said. “Baby Yovanny Lopez is dead now & we need a law in place to help hospitals like Christ Advocate get things right when the next innocent baby walks into their ER in the arms of criminals like Clarissa Figueroa.”

On May 20, the Cook County sheriff’s office said they were questioning whether the hospital violated the Abuse and Neglected Children Reporting Act by failing to notify child protection authorities about the situation, but ultimately let state officials “take the lead” with an investigation, office spokeswoman Cara Smith said.

CHICAGO (FOX 32 NEWS) - The mother and daughter accused of killing a pregnant Chicago teenbefore cutting the unborn baby from her womb were charged Thursday for the infant's death.

Clarisa Figueroa, 46, and her daughter, Desiree Figuroa, 26, were charged with murder of Yovanny Lopez, the son of Marlen Ochoa-Lopez, according to the Cook County state’s attorney’s office.

Both women and Clarisa Figueroa’s boyfriend, Piotr Bobak, were previously charged in Ochoa-Lopez’s death. All three plead not guilty to the murder of Marlen.

Mother and daughter are set to appear in court for a bail hearing on the new charges Thursday, prosecutors said.

The family of Marlen Ochoa-Lopez was billed more than $300,000 in medical costs for the baby boy that was cut from the 19-year-old’s womb.

According to the Chicago Sun-Times, the bills came from Advocate Christ Medical Center in Oak Lawn, where her accused killer Clarisa Figueroa took the baby and allegedly claimed him as her own. In the bills, baby Yovanny Lopez is also referred to as “Figueroa”– the last name of the suspects.

Advocate issued a statement Thursday, saying the bills were an “error.”

A man was sentenced to four years in prison Monday for obstructing justice in the April 2019 killing of a pregnant Chicago teenager whose baby was cut from her womb with a butcher knife.

Piotr Bobak, 44, who was dating the suspect at the time of the killing, received credit for time served and will leave prison in nearly four months. He then must serve six months of probation under a plea agreement, court records said.

Marlen Ochoa-Lopez, 19, was nine months pregnant when she went to Clarisa Figueroa’s home believing she was getting free baby items after the two connected in a Facebook group.

Prosecutors said Figueroa's daughter, Desiree Figueroa, distracted Ochoa-Lopez with a photo album while her mother strangled Ochoa-Lopez. Her baby boy, Yovanny Jadiel Lopez, then was cut from her womb with a butcher’s knife.


Hours later, Clarisa Figueroa allegedly came running out of the home claiming she had just given birth to a baby boy and that he wasn’t breathing. The boy suffered brain injuries and was hospitalized, but died months later.

Marlen-Ochoa’s body was found in a trash bin.
Bobak said at the hearing he was misled by his “then-girlfriend” and her daughter. He said he had no prior knowledge of what the women planned to do, but used “poor judgment” after the fact when cleaning up the crime scene.
 
A Chicago woman accused of luring a pregnant teenager to her home and cutting her baby from her womb with a butcher knife nearly five years ago pleaded guilty to murder Tuesday and was sentenced to 50 years in prison.

Prosecutors have said Figueroa strangled 19-year-old Marlen Ochoa-Lopez with a cable on April 23, 2019, after luring the teenager to her home with the promise of free clothing for her unborn child. Ochoa-Lopez was nine months pregnant. Figueroa then called 911, saying she given birth and the child was not breathing.

The child died about two months later.
Yovanny Lopez, the victim’s husband and the father of the child, Yovanny Jadiel Lopez, described how the tragedy affected him and the couple’s older child, Joshua., who he said “has lost his mother forever.”

“The memory of my infant son’s last breath in my arms is complete agony,” he said in a statement read in Spanish and English in the courtroom. “... God’s justice will be served upon you the day you die.”
Authorities say not long after Clarisa Figueroa’s adult son died of natural causes, she told her family she was pregnant. They say she plotted for months to acquire a newborn, and that she posted an ultrasound and photos of a room decorated for a baby on her Facebook page. In March 2019, she and Ochoa-Lopez connected on a Facebook page for pregnant women
Piotr Bobak, Clarissa's boyfriend, cleaned up the crime scene and was sentenced to four years in prison after pleading guilty last year to obstruction of justice.

Desiree Figueroa, 29, pleaded guilty to murder in January for helping her mother and was sentenced to 30 years in prison. She had agreed to testify against her mother.
