A 10-month-old girl is in critical condition after she was shot in the head early Sunday morning, police said.

The baby, Fayth Percy, underwent surgery to remove bullet fragments from her head, Fresno Police Chief Jerry Dyer said at a news conference Sunday. She is in critical but stable condition.

The suspect, Marco Antonio Echartea, was arrested on suspicion of three counts of attempted murder, The Fresno Bee reported. He was also wanted for a shooting in May.

The child’s 18-year-old mother had gone into a home with Fayth early Sunday morning, where she encountered Echartea and resisted his advances, police said. The mother and a male friend left the home and drove away when Echartea, 23, began shooting, police said.

“At some point when he got close, he pulled out a handgun and fired three rounds into the driver’s side window, which was up,” Dyer said. “One of those rounds struck baby Fayth on the side of the head as she was being held by her mother,” Dyer said.

Perhaps I am just misreading things...? It says they "left the home and drove away", then he began shooting when he "got close" (making me think he was giving chase in another vehicle, and didn't begin shooting until he pulled along the passenger side, although that isn't specified).
 
Echartea is believed to be the suspect responsible for another shooting that took place just miles away from the home on May 27, Police Chief Jerry Dyer said.

Dyer said that Echartea fired several shots into the home of his ex-girlfriend’s boyfriend.

“In that case, one of the bullets penetrated the walls and nearly struck another 1-year-old who was inside,” Dyer said. “That bullet landed approximately one foot from where the baby was.”

Echartea faces three attempted murder charges in relation to both the Sunday incident and the May 27 shooting, Dyer said.

“It should shock the conscience of every person in Fresno to know that we have a 10-month-old baby lying in the hospital fighting for her life,” Police Chief Jerry Dyer said in the news conference, adding that after Echartea was taken into custody, “he had no remorse.”

“When our detectives brought him downtown… he had just shot a 10-month-old baby and didn’t seem to care or it didn’t phase him,” Dyer said.

“Very apparent that Marcos Echartea has no regard for human life ― even a baby,” he said. “I know the parents [of Fayth] are broken. They’re hurting. … It tears my heart up to see a baby of that age lying in the hospital.”

A Fresno man sat emotionless in court today as he found out he will spend the rest of his life in prison for the attempted murder of a baby.
Marcos Echartea was just 23 when he tried flirting with the mom of a 10-month-old baby at a house party in 2019. When the mom, her baby, and a friend left, Echartea opened fire on their car.

"It is egregious and unconscionable to shoot into a moving vehicle with three occupants," Deputy District Attorney Jenny Volanti said.
Dramatic video from that day -- played in court earlier this year -- shows the chaotic scene. You can see a flash when Echartea pulled the trigger.

That is when a bullet hit baby Fayth Percy in the back of the head. The 10-month-old was injured but survived.
Earlier this summer, the court found Echartea guilty of attempted murder, assault, and having a gun while under a restraining order. Today, Volanti said it is the worst crime she has seen in her career and urged the court to hand down the maximum sentence.

"I believe the defendant should be sentenced to every single day that he's allowed to receive under the law. And it probably is still not enough," Volanti said.
Echartea's attorney, Jane Boulger, said a long sentence is "cruel" because all the victims survived. She urged the court to be fair.

"In general, a sentence of this length for a non-homicide can be considered cruel and unusual," Boulger said.
Boulger's effort was not enough to convince Judge Jonathan Conklin to hand down a reduced sentence.
Echartea was ordered to serve life plus 45 years in prison.
