The woman who was implicated in the death of 10-year-old Victoria Martens has been moved from the Bernalillo County Metro Detention Center to the Western New Mexico Correctional Facility in Grants.
That's where Kelley will be serving her seven-year sentence for a drug charged that she pleaded guilty to in 2017.

Kelley has not been sentenced in the Victoria Martens case. She pleaded no contest to six charges related to the death of Victoria.

Bernalillo County District Attorney Raúl Torrez said Kelley faces up 50 years in prison on those charges.
Kelley will be sentenced following Fabian Gonzales' trial. He's charged with child abuse resulting in death. Michelle Martens, Victoria's mother, pleaded guilty to one count of child abuse resulting in death in 2018. An unknown fourth suspect has not been caught.

My daughter, a very sweet and kind person, was a nurse at the Bernalillo Country Metro Detention Center during this fucking shit. She treated all the inmates with professionalism and respect, but of all the inmates she said Jessica was the fucking worst. She would milk her "injuries", was always bitching, and most of the other inmates was scared of her.

it won't let me in to read but none f them should ever get out of prison again & should be forced to stay in gen pop some of the worse child molestatin murder cases have cme out of NM which is a place o have always loved when gone there] they need to be more extreme with these cases and people, the amount of excuses people made fr the mother was ridiculous

Court documents reveal complications in Victoria Martens murder case

Almost three years have passed since the shocking murder of 10-year old Victoria Martens, but the trial for the last remaining suspect isn’t even scheduled.

A trial date for Fabian Gonzales is up in the air, yet trial preparations are still underway.

KRQE News 13 has learned there’s a lot of disagreement between Gonzales’ new attorney and prosecutors.

“We’re trying to find out the truth,” says his attorney Steve Aarons.

Aarons says he’s just trying to nail down the facts of that fateful night in August 2016, and he wants Michelle Martens to tell him.

“We were allowed to interview her for up to 8 hours and it’s just a standard pretrial interview,” he says.

Martens, Gonzales and his cousin, Jessica Kelley, are the main suspects in the 10-year-old’s death.

To date, Kelley has pleaded no contest and faces up to 50-years in jail. Martens took a plea deal to spend at least 12-years in jail.

However, neither will be sentenced until Gonzales’ case is resolved.

“Most people think early fall at the earliest, and it could be even into the winter or the new year before we try this case,” says Aarons.

So far, a trial date has not been set and that’s because, Judge Charles Brown ruled in favor of the defense to keep his drug history out of evidence at trial.

The DA’s Office appealed the decision.

“Who had used what drugs in the weeks past doesn’t really matter as much as whether or not there really was a man or not a man,” says Aarons.

As the case sits in limbo waiting on the higher court to rule, tensions are running high at District Court.

“We got into a bit of an argument with the DAs,” he says.

Aarons says he recently stormed out of an interview with Michelle Martens after a disagreement with prosecutors over his line of questioning.

Aarons wants to finish that interview with Martens, but now the DA’s Office is claiming he gave up his chance when he stormed out.

A judge will have the final say.

There’s no definitive date for when the appeals court could rule on excluding Gonzales’ drug history at trial, but Aarons says he’s hopeful it will happen by June.

Meanwhile, there’s still an alleged unidentified fourth person involved in this case. The District Attorney’s Office tells KRQE News 13 there are no updates on that.

The case was pretty much a shit-show, by the looks of it.

The stumbling and bumbling in such a high profile case makes one wonder how haphazardly they treat the lesser cases.

Not to mention losing sight of young Victoria.
 
One of the men tied to one of the most horrific cases of child abuse in the state is getting out of jail.

Fabian Gonzales will be released from jail with no GPS monitoring until trial, Judge Charles Brown ruled Wednesday. However, that trial has not been scheduled.

Gonzales was arrested in August of 2016 after Victoria Martens was found murdered and dismembered on her 10th birthday.

Because of the new information that came to light after Michelle Martens' plea deal, prosecutors dropped the murder charges against Gonzales. But he is still facing charges of tampering with evidence and child abuse resulting in death.

The court is working to determine his terms of release, including who he will stay with once released.

Brown did say that Gonzales could not stay with his brothers because they are considered witnesses in the case involving Victoria because he communicated with them before and after the girl’s death.

Prosecutors tried to keep him behind bars, arguing that his DNA was found on items used to clean up the crime scene inside the apartment where Victoria was killed.

But attorney’s for Gonzales argued he’s not a danger to the community.

And Brown agreed, saying prosecutors were not able to prove he was a danger.

At this point there is no form of GPS tracking planned for Gonzales. Brown explained there were no restrictions for him when he was released so there was no need to track his location.
