Deputies from the Lake County Sheriff's Office were called to a home in Old Mill Creek, Illinois, about 47 miles north of Chicago, Tuesday around 1:15 a.m. following the shooting, Detective Sgt. Chris Covelli told reporters in a news conference.

The 75-year-old homeowner told deputies he went outside after noticing a suspicious SUV in his driveway and several people on his property, whom he believed were attempting to break into and steal his car, a 2011 Audi, Covelli said.

Armed with a revolver, the homeowner told authorities he was standing on his porch, yelling at them to leave, when two of the individuals "quickly approached him," Covelli said. The man said he saw that one of the teens "holding something in his hand," so he discharged his firearm at least three times out of fear for his and his wife's safety.

The homeowner then called 911 to request an ambulance, and the teens fled, Covelli said.

About three miles from the man's home, officers from the Gurnee Police Department responded to a crash involving an SUV, Covelli said. When the officers approached the 2015 Lexus, two people exited the vehicle -- one of whom had a gunshot wound to his head.

The four people who were still in the SUV fled the scene "at high rate of speed," reaching 120 mph on Interstate 94 as they were chased all the way back to Chicago by law enforcement officers from the Lake County Sheriff's Office, the Gurnee Police Department and Illinois State Police.

Once the vehicle was depleted of gas, the four people inside fled on foot, Covelli said. Three of them were found "pretty quickly," and a Lake County deputy located the fourth suspect in a dumpster about a block away, buried under trash. The fifth suspect was taken into custody at the crash scene in Gurnee.

The five teens, ages 16 to 18, are being charged as adults for first-degree murder "due to them being in commission of a forcible felony," according to a press release from the sheriff's office. They appeared in court for an initial hearing Tuesday afternoon, where bond was set at $1 million each. They will appear in court next on Sept. 5.

The only suspect who was identified is the sole 18-year-old, Diamond Davis, who is being detained at the Lake County jail. The three 17-year-olds and the 16-year-old are being held at the Hulse Juvenile Detention Facility in Vernon Township.

A knife, "likely from one of the individuals," was found on the man's property, Covelli said. The Lexus SUV had been reported stolen in Antioch, some 10 miles southeast of Old Mill Creek, two days before the incident, Covelli said.

Covelli described the crime as a "random theft of a vehicle," adding that investigators will look into whether the teens could be responsible for other vehicle thefts in the area. The teens may face additional charges, he added.

The homeowner was legally allowed to possess the gun he used in the shooting, Covelli said. The 14-year-old was pronounced dead at the scene of the crash.

Lake County Sheriff John Idleburg extended condolences to the family of the teen who was killed, "despite the circumstances."

Authorities have released the identities of the five teens who were charged with first-degree murder and the name of the 14-year-old accomplice who was fatally shot during an attempted car theft in unincorporated Lake County on Tuesday.

Diamond C. Davis, 18, Steven D. Davis, 17, and Stacy Davis, 17, who all live in the 5700 block of South Bishop Street in Chicago, were charged as adults with first-degree murder along with Curtis M. Dawson, 16, of the 7800 block of South Oglesby Avenue in Chicago, and Kendrick Cooper, 17, of the 5000 block of South Martin Luther King Drive in Chicago.

“The teens were charged due to them being in commission of a forcible felony, when the 14-year-old victim was shot and subsequently died as a result of being shot during the commission of a burglary,” the Lake County Sheriff’s Office said Tuesday evening.

All five teens appeared in court for an initial hearing late Tuesday afternoon and a judge ordered them to be held on a $1 million bond each. They are scheduled to appear in court again on September 5.

Lake County Coroner Dr. Howard Cooper said that the 14-year-old boy killed in the incident was Chicago resident Jaquan Swopes. An autopsy confirmed he died as a result of a gunshot wound to the head.

The Lake County Sheriff’s Office said they responded at 1:15 a.m. Tuesday to the 17600 block of West Edwards Road in unincorporated Antioch for an attempted vehicle theft at a residence.

The 75-year-old homeowner told sheriff’s deputies he shot at the suspects trying to steal his car before they fled the scene, according to Lake County Sheriff Spokesman Sgt. Christopher Covelli.

Covelli said at a press conference Tuesday morning that the homeowner saw a vehicle on his driveway and went outside.

He realized the group of people were trying to steal his vehicle and then two males, one of whom was holding something in his hand, approached him quickly while he was still on his porch, Covelli said.

The homeowner discharged his small caliber revolver, striking the boy in the head, Covelli said. A knife was later recovered at the scene.

After the suspects fled, Gurnee police were investigating a vehicle crash at Grand Avenue and Hunt Club Road around 1:35 a.m when a stolen 2015 Lexus SUV approached the scene with the six teens inside it.

The occupants in the vehicle told police officers that one of the people in the car, a 14-year-old Chicago boy, needed medical attention for a gunshot wound, Covelli said. One of the occupants in the car helped remove the injured boy from the vehicle.

Police arrested the 17-year-old boy who got out of the car and the other four fled the scene in the vehicle. Paramedics responded and transported the boy who had been shot to Advocate Condell Medical Center in Libertyville where he was pronounced dead.

The Gurnee Police Department and the Lake County Sheriff’s Office began pursuing the suspect vehicle, at which point speeds reached over 100 mph, Covelli said.

The Illinois State Police and Chicago Police Department joined the pursuit and it ended in Chicago’s West Town neighborhood near Halstead Street and Randolph Street.

The 16-year-old boy, 17-year-old boy and 18-year-old woman were taken into custody around 2 a.m. after running from the car, according to Illinois State Police. Lake County Sheriff Canine Dax found the fourth suspect, one of the 17-year-old boys, hiding inside a dumpster.

Bail has been set at $1m, and if anyone is interested in why they were charged with murder even though they weren't the one that did the shooting.
The five teens are charged under a state law known as the felony murder rule, which holds a person legally responsible for the death of an accomplice killed in the commission of a forcible felony.

All five suspects appeared in Lake County bond court Tuesday, when a judge set bail at $1 million each. Their next court appearance is set for Sept. 5.

 
A Chicago woman charged in a burglary that led to the death of a teen will serve one year behind bars.

A Lake County judge sentenced Diamond Davis, 18, to a year in prison followed by a year supervision.

Davis and four juveniles were charged with trying to rob a homeowner in Old Mill Creek on Aug. 13. That homeowner opened fire, killing 14-year-old Ja’quan Swopes.

Davis will receive credit toward the sentence for 85 days spent in the Lake County jail since her arrest.

She could also get day-to-day credit for good behavior, which could result in her serving only half of her remaining prison sentence.
