Las Vegas police called off the search for a missing 3-year-old boy after his body was found in a remote area near Lake Mead National Recreation Area.

Homicide Lt. Ray Spencer said 3-year-old Daniel Theriot was found dead early Monday morning after his mother reported him missing about 8:45 a.m. Sunday at Sunset Park. Spencer said the boy’s 20-year-old mother and the boy’s father, her 40-year-old boyfriend, are in custody.

It’s unclear how police discovered the child’s body. Police believe Theriot was killed at least 12 hours before he was reported missing. Spencer would not reveal how the child died, but said it was “absolutely disturbing” and that “there was nothing accidental about it.”

Both parents face a murder charge and possible child abuse charges after Child Protective Services took custody of Daniel’s 2-year-old sibling. Spencer said the family had never been investigated by CPS, but the parents do have a criminal history.

The woman told police the boy wandered off while she was on the phone, Spencer said, but police began to doubt the woman’s story after no one at the park could recall seeing the woman and child together.

She also told detectives that she took her son to Sunset Park to feed the ducks, but the family lived within walking distance of Lorenzi Park.

A 20-year-old mother of two has told police she stood nearby and did nothing as her boyfriend beat her three-year-old son and poured hot water on his body.

Cassie Smith, who had reported her son Daniel Theriot missing days before she and her boyfriend Joshua Oxford were charged with his murder, said her son had been disrespectful in the days leading up to the fatal attack.

The Las Vegas woman told police her son had a bad attitude, causing Oxford to lash out and begin to hit the young boy on September 1, The Review Journalreported.
Oxford, 40, reportedly beat the child over and over, but still did not receive the respect he believed he was owed, and decided to pour water over Daniel.

When the water on its own did not affect the youngster, he allegedly decided to heat it up on the stove before pouring the now-hot water over the boy again.

The report claims as her son cried out in pain and asked for her help, she stood nearby watching, declining to get involved.

Oxford has told police both he and Smith were hurting the child, both pinching his ears and hitting him with an open hand.
Later on, young Daniel was being babysat by his grandmother Kathy Evans, and fell asleep.

Evans told police when Oxford returned home, he woke the child up and continued to beat him.

He remained asleep, Smith told police, and she claims the next morning he was dead.

An autopsy report, released just days after the child's death, says the toddler had several broken ribs at the time of his death, as well as bruising, abrasions and blunt force injuries.

He had also suffered a subdural hemorrhage - bleeding on the brain.

Daniel's body was discovered near Lake Mead National Recreation Area in the early hours of Monday morning, after he was reported missing by his mother on Sunday.

Cassie Smith, 20, called 911 around 9am, telling police she'd taken her son to feed the ducks at Sunset Park in Las Vegas, but when she'd looked away for a second to use her phone, he'd disappeared.

Police immediately mounted a huge search effort, closing the park and checking each car as they left.

But investigators say they also began to have their suspicions about the woman's version of events and launched a simultaneous criminal investigation.

Ray Spencer, a homicide detective, told a news conference on Monday that it didn't make sense for the mom to take Daniel to Sunset Park, a huge 300-acre space with a 9-acre lake, when they lived in walking distance of Lorenzi Park.

He also said no one at the park remembered seeing Daniel with his mom, or noticed the woman frantically searching.

'We started doubting if the three-year-old was ever at the park,' he said. 'We suspected some foul play was involved.'

Just before 5am on Monday, Daniel's body was discovered in a plastic tub near Lake Mead National Recreation Area.

It appears he was killed and dumped there up to 12 hours before his mother called to report him missing from the park.

Spencer also made clear there was 'nothing accidental about the death of the child.'

A man suspected in the death of his girlfriend's toddler son in 2018 pleaded guilty to murder and child abuse charges on Wednesday.

Joshua Oxford, 42, entered a plea on Oct. 2 in front of Judge Douglas Herndon for one count of second-degree murder and one count of child abuse, neglect or endangerment with substantial bodily harm.

He was accused, along with Cassie Smith, in the death of her 3-year-old son, Daniel Theriot.

he couple told police the boy had a "bad attitude" and had "been disrespectful" toward them. In Smith's arrest report, she admitted to Oxford pouring hot water on Daniel when he misbehaved. Oxford said he hit Daniel several times that same day.

Joshua Oxford was sentenced Wednesday from 16 to 45 years in prison for the death of 3-year-old Daniel Theriot. Oxford, 42, took a plea deal which reduced his charge to second-degree murder.

According to the arrest report, Oxford had a history of abusing the boy.
 
The woman convicted in the death of her 3-year-old son whose body was found in the desert outside Las Vegas has been sentenced to at least 14 years in prison.

Cassie Smith received her sentenced after she pleaded guilty last year to charges of second-degree murder and child abuse.

Her sentence will run from 14 to 45 years, with credit of nearly two years' time served.

Joshua Oxford was sentenced to 16 to 45 in prison.
