A trial is set to begin for a Massachusetts woman charged with murder after the bodies of three infants she had given birth to were found in her squalid home.


Erika Murray's trial is scheduled to begin Tuesday in Worcester Superior Court.

Murray is charged in the deaths of two of the three dead babies found in the trash-strewn and insect-infested Blackstone home in 2014. Four living children were removed from the home.

An attorney for a woman charged in the deaths of two babies whose remains were found in her squalid home says there is no evidence his client committed a crime.
Defense attorney Keith Halpern made the comments as the trial opened in the case against Erika Murray. Halpern says Murray has mental health issues.
Murray is charged with murder in the deaths of two of the three dead babies found in the trash-strewn and insect-infested home in 2014. Four living children were removed from the home.

Prosecutor Christopher Hodgens said Murray's neglect caused the baby's deaths. He said Murray created "two different worlds for her children: a world of the wanted and a world of the unwanted."

A judge is deciding the case after Murray waived her right to a jury.

The Blackstone house, which has since been demolished, was littered with trash and feces and was infested by insects. Among the squalor, skeletal remains of the three infants were found. The third dead infant was found in a closet in another room. That child was diapered and fully clothed, according to prosecutors.

Prosecutors on Tuesday said a state trooper who responded to the home went upstairs and opened a closet. There, they found a dead baby with the placenta still attached. Near the infant was a dead dog in a bag and a second dead baby that was "diapered and fully clothed, but they were skeletal remains."

So, maybe, the baby and placenta might could be called a miscarriage, Maybe. But the one with the clothes and diapers, absolutely not. That one lived long enough to be possibly neglected to death, at the very least. Must have been her dead body closet since there was a dead doggie in there too. :wideyed:

Yeah she’s mentally ill but she knew how to keep a baby alive, as evidenced by the surviving kids. It’s also reasonable to assume she knew what would happen to a live baby tossed into a closet and abandoned. Murder charges are appropriate.

The remains of one of the three infants found in the Massachusetts house of horrors case was discovered in a filthy onesie, another was wrapped in maggot-infested sweatpants and a third was kept in a cardboard box, a medical examiner testified Thursday.

Shocking images presented to the court showed the soiled clothing two of the babies were said to have been found in after being hidden in a closet.

Their mother Erika Murray, 35, now faces charges over the deaths of two of the three dead babies found in the trash-strewn and insect-infested Blackstone home in 2014.

Trooper Keith Egan told a judge Thursday he searched the home using a shovel before finding he remains of an infant in a cardboard box.

Later medical examiner Robert Welton, who performed autopsies on the dead children, described how he found the remains of three infants in horrifying circumstances on the third day of the trial.

Murray, who appeared in court wearing the same shirt two days running, appeared emotionless Thursday as she listened to the harrowing evidence.

On Wednesday she broke down in tears in a rare display after images of her children were projected to the court room.
But former Department of Children and Families investigator Catherine Francy testified Wednesday that Murray called her three-year-old child 'it' several times.

Dr Welton told a judge he saw the remains of the infant left in the cardboard box pulled from a closet by police. A second infant was also said to have been found in the same closet along with the remains of an animal.

our living children, ranging from five months to 13-years-old, were removed from the home, which was eventually torn down.

Neighbors say the property was full of 'dirty diapers, fleas and maggots' and images from the house show piles of trash filling rooms and squalid conditions.

Blackstone Police Acting Chief Gregory Gilmore said Murray 'was embarrassed to have' her three-year-old and five-month-old girls. She is said to have told her older children she was babysitting them.

The older children, who appeared to have maggots in their ears, did not realize the younger ones were their siblings a judge was told.

Video footage from the scene showed police and forensic teams removing bags of trash after police said they found the skeletons of two diapered and clothed babies as as well as a fetus in a closet.

It was reported at the time that the three-year-old could not walk, had poor muscle tone and only made a few sounds. The six-month-old baby was extremely sensitive to sunlight.

It took clean-up crews 90 hours spread over four days of work to clear out Murray's house before heavy machinery was brought in to raze it to the ground.

Ramon Rivera, 39, the children’s father and Murray's live-in boyfriend, is also said to be facing child abuse charges in a separate proceeding.

A Worcester County judge has found Erika Murray not guilty of second-degree murder in the death of her child whose decomposed body was found inside a closet in her squalid Blackstone home in 2014.

Judge Janet Kenton-Walker also found Murray guilty of two counts of assault and battery on a child causing substantial bodily injury and not guilty of two counts of reckless endangerment of a child. Prosecutors had accused Murray of causing injuries to an infant and 3-year-old found dirty and isolated in her home, and of endangering her two older children by causing them to live in squalor and filth.

On the final counts, Murray was found guilty of two counts of animal cruelty for the neglect of pets found in her home.

Kenton-Walker ruled that while prosecutors proved one of the dead infants survived childbirth, they failed to prove that Murray could have saved the infant by calling for help or performing CPR when she discovered the baby blue and not breathing.

In a statement to a full courtroom, Kenton-Walker said the disturbing details of the case -- and her feelings about those facts as a parent herself -- could not legally affect her ruling.

“Emotion or sympathy can play no part in the decision that I make," Kenton-Walker said. "This is a court of law, not a court of public opinion.”

Erika Murray, the mother who was acquitted of murder charges in the deaths of two infants who were found inside her squalid Blackstone home, was sentenced Thursday to 6-8 years plus probation on two charges in the case.

Murray was found guilty of assault and battery on a child and cruelty to animals in June. Judge Janet Kenton Walker found Murray not guilty of second degree murder in the bench trial due to her mental health issues.

“I have to take into account that the normal does not necessarily apply,” Walker said Thursday at sentencing, adding, “There is nothing about this case that is normal.”

Murray has already served nearly five years following her arrest. She will get credit for time served plus 2-3 more years. When she is released, Murray cannot have contact with children under 10 years old.

Prosecutors recommended 4.5 years in prison for assault and battery and 2.5 years for animal cruelty. The prosecution also asked for five years probation and for Murray to have no contact with children under 18 years old for a period of 10 years.

Murray’s defense asked for less than 18 months for the assault and battery charges and probation for animal cruelty.

After Murray was sentenced, defense attorney Keith Halpern said he believed Walker could have let Murray go with time served.

“Would it have been reasonable for her to get a sentence of five years and walk out today? Yes. She’s going to do a little bit more,” he said.

During the bench trial, prosecutors argued Murray knew what she was doing and lived a life of secrecy. Murray’s attorney said previously his client is mentally ill and that there’s no evidence she caused the baby’s death.

“This case involves a senseless, tragic story about a dysfunctional parent and her family. Regardless of how disturbing the facts of this case are to the community at large and to me as a parent, I cannot take into account those feelings,” Walker said while announcing her verdict in June.
