Malakai Michael Garrett was rushed to a local hospital in critical condition Wednesday but was pronounced dead shortly after that.

Police arrested 27-year old Mitchell Vanryn and charged him with aggravated battery and domestic battery. A probable cause affidavit says Vanryn is the boyfriend of Malakai's mother. The mother told police Vanryn is the sole childcare provider while she is at work.

Detective say she told them Malakai was not feeling well the night before he died and had bruising on his face she said was from falling. The court documents say the mother said Malakai was feeling sick, not eating and complaining about pain to his head.

When police interviewed Vanryn about Malakai's death, the court documents say he told them he put him down for a nap and found him unresponsive shortly after 4 p.m.. Police say he told them he slapped Malakai in the face to try to wake him before taking him to the bathtub to put cold water on him to try to get a response from him.

The court documents say a visual scan of Malakai's body indicated multiple bruises to the groin area, front and back torso, left and right cheek and back of his head. The doctor who pronounced him dead said the bruises appeared to be two to three days old.

An autopsy conducted on the toddler revealed even more damage. The court document states the doctor who conducted the autopsy told police Malakai had extensive and severe bruising in many areas including the chest, abdomen, back, face and head. Malakai also had severe injury to several internal organs.

The doctor told police the injuries were consistent with multiple blows and strikes from a closed-fist punch. The internal injuries would have had to occur within hours of arriving at the hospital.

The doctor indicated Malakai died as a result of injuries caused by blunt force injury and the death was a homicide.

Mommy damndest was so shit pants scared she even lied to cover for him.

Although he clearly didn't slap the child hard enough or that time honoured tradition of waking would have worked...right?

I really hope the mommy breeds again and gives it another go at parenting.
Odds are good one might survive.

Margaret Easterly, Malakai's great-grandmother, was the last family member to see him alive. She said the family believes there was plenty of evidence in existing CPS reports to remove Malakai. Easterly said the family filed a complaint with the agency in late October after she saw the boy with two black eyes.

Easterly said she visited Malakai's home at 6902 Palmetta Court on the city's north side Oct. 29 and was alarmed when Malakai came running to the door with bruises under his eyes. He begged to leave with her, Easterly said, but she was not allowed to take him trick-or-treating.

Easterly sobbed as she drove away, she said. That day, Easterly said Lantz Garrett and his mother, Chante Harter, Easterly's daughter, called CPS and the police to report what Easterly had seen.

The family was told by police that CPS was already at the home. There was an understanding that photos of Malakai had been taken and were being sent to a hospital that specializes in children's care for verification of abuse, Easterly said.

In an email response, Michael Joyner, Fort Wayne Police Department public information officer, said that when a call of this nature is made police would “ask if the juvenile has sought medical attention for the injury, ask how it occurred, determine suspect information.” Police would also “notify the detective bureau, notify DCS, take photographs and write a detailed report.”

“The investigative process determines if a juvenile is removed,” Joyner said. “DCS and the Detective Bureau are involved in this process. And if warranted, an arrest is made. Know that there are so many variables that could be brought into play, that an investigation and actions taken could be many. Your question is general and my response is for the most part general.”

Easterly said the CPS has six reports, not just from the family. “One was a hospital. He had diaper rash so bad he was bleeding from his genitals. He's been to the ER four or five times in the last 5 months, stitches in his lip, a busted eardrum,” Easterly said.

Why not remove the child temporarily while you wait on these experts? Why is this ass backwards? Why aren’t you protecting the child first, then investigating when he clearly has major injuries.

i feel like some kind of guilty, shallow hypocrite when i look at a picture of a good looking person that something bad happened to and my heartstrings are pulled really hard and i think what a waste.

its not that i believe that a more average looking person or a person whose story is not accompanied by a picture had any less valuable of a life, or like i can look at an unattractive person and dismiss their suffering... not at all by any means. but i supect i'm an empath, and when i look into the eyes of someone who looked happy and well loved and cared for, the enormity of the lost potential hits me harder, i guess, than someone who looks or seems like their death was probably some kind of welcome release from the pain they've already endured in this world.

#2) mom sees bruising and doesn't seek medical
#3) mom lies for the golden dick.
#4) golden dick tries to wake the non responsive child by slapping and then cold water.
#5) other family members have made reports to to police and child protective.
#6)medical staff made prior report.
#7) child is kept from paternal grandmother/other family.
#8)past abuse, broken eardrum I'm sure from getting slapped. Stitches to his lip.

Every person in this child's life failed him. Poor baby.

he mother of a 2-year-old boy who police said was beaten to death by her boyfriend has been arrested and charged with neglect.

Amber Garrett, 26, faces felony charges of Child Neglect related to the Nov. 29, 2017, death of her son, Malakai Garrett. She was arrested Monday, Fort Wayne Police said.

Mitchell Vanryn, 27, has been charged with Murder, Aggravated Battery of a Child and Domestic Battery Resulting in the Death of a Child in the boy’s death.

Amber Garrett, Malakai’s mother who is in a relationship with Vanryn, told police that Vanryn was the sole child care provider for him while she was at work Monday through Friday from 8 a.m. to approximately 4:30 p.m. According to the affidavit, on the day Malakai died, he was still asleep when she left for work at around 7:30 a.m.

Vanryn was charged days after Malakai’s death. Amber Garrett, though, remained free – until Monday.

In a probable cause affidavit, police said Garrett sold a broken iPhone to a man, who turned around and had the phone repaired. Afterward, the man found a text message chain on the phone between Garrett and Vanryn that began with Vanryn’s claim that he was in “deep (expletive trouble)” because the boy “slipped and fell in the (expletive) shower,” according to the affidavit.

“I’m not watching these kids anymore,” Vanryn said in the text messages. “This (expletive” is too much.”

Police collected the phone from the man after he said Garrett tried to buy it back from him, the affidavit siad.

On the phone, police found more text messages between Vanryn and Garrett which detailed a history of domestic abuse by Vanryn, including times he threatened to “beat her (expletive)” for calling the doctor about Malakai, another time he pulled her hair and kicked her while she was on the ground and yet another time he hit her with a pool stick, the affidavit said.

Text messages were also recovered which showed Garrett telling Vanryan that he has anger issues and that he was too hard on her children, the affidavit said.

New documents released by the Department of Child Services obtained by WANE 15 News reveal that the agency had been called to Amber Garrett's home for reported child abuse and neglect five times before her 2-year-old son Malakai was beaten to death last year.

Nov. 12, 2016, Malakai's father took him to Kosciusko Community Hospital in Warsaw because Malakai, who was a year old at the time, had severe diaper rash that he said occurred while in Amber Garrett's care. He believed Amber was neglecting their son. At the time Lantz reported sores on his face, bruises on his left leg, an on his side and back.

Oct. 29, 2017, complaint was reported to DCS regarding bruises, black eyes and injuries on Malakai's face. It was reported that Malakai's older sister expressed that "daddy Mitch" hit Malakai. There was concern that pictures of Malakai posted on social media showed marks on his face, a busted chin and bruising around his neck. According to the DCS assessment, a caseworker observed dark circles under his eyes and a scratch above his lip. However, Amber and Mitchell Vanryn said that he fell in the shower and had stitches. They told the caseworker she did not know why he had markings on his eyes but said he often "plays rough." The caseworker noted that Malakai appeared to be slim but did not look malnourished. A DCS caseworker interviewed Malakai's 6 year-old sister who sad said she was in the room when Malakai fell down in the shower and split his lip open. She described as she watched several people standing around her brother to give him stitches. The caseworker had difficulty understanding Malakai's speech but noted that he visibly agreed with his sister when she stated that they were safe in their mother's home and no one hurts them there. Both children reportedly said Mitch was nice to them.

Malakai Garrett died a month later. His death came two weeks before an emergency custody hearing scheduled.

A man accused of beating his girlfriend's toddler to death has been acquitted of murder.

After a three-day trial, the jury found Mitchell Vanryn not guilty of murder, but guilty of aggravated battery and domestic battery Thursday night.

The decision came after closing arguments that focused on Vanryn's intent and if he actually meant to kill the child. The defense argued there wasn't evidence that he meant to kill Malakai as he worked to save his life. The prosecution said the damage done to his body was enough proof.

2-year-old Malakai Garrett died in November of 2017. An autopsy determined he had extensive bruising, consistent with blows from a fist.

Thursday marked the third day of the trial. The day started with jurors watching the police station interview between Detective Liza Anglin and Vanryn. It happened shortly after Malakai died. In it, Vanryn was questioned about what happened that day, Malakai being sick, how he dealt with stress from kids, Malakai's injuries, among other topics.

Vanryn said he wouldn't abuse his child. "He hasn't been abused as far as I know," he said during the interview.

"If he was abused, someone needs to be held accountable," Vanryn added during the interview.

At the end of the interview, Vanryn asked about the process of the investigation.

"When will this be over, so we can be done with this (expletive) and get on to dealing with our grief," Vanryn said.

During the interview, Vanryn could be heard sniffling. After watching the interview, the prosecution asked the detective if she saw tears. The detective said "no." She also said he never asked for tissues or asked about Malakai.

Before lunch, Scott Wagner, M.D. took the stand to talk about Malakai's autopsy. The testimony brought the most reactions from the audience during the trial with quiet gasps and cringes, as he explained his way through several pictures.

WANE 15 News saw the same pictures the jurors did. Malakai's body was covered in bruises. Wagner counted more than thirty, but said there were too many to get an exact number.

Wagner did note marks on Malakai's back that were consistent with a knuckle pattern, or fist.

Despite the signs of injuries outside his body, Wagner credits Malakai's death to the internal injuries. The liver and pancreas were torn. The boy's abdomen was filled with blood. There were other tears inside his body and spots where blood was able to get into, where it shouldn't be.

In his opinion, Wagner said the tears were the result of blunt force and the 2-year-old could not have lived with those injuries for more than an hour or two.

Apr 05, 2019 -The mother of slain toddler Malakai Garrett is back behind bars.

Amber Garrett was arrested after a warrant for her arrest was issued for violating terms of her release.

According to Allen County Sheriff's Office spokesman Steve Stone, she was arrested Friday and is being held without bond.

Garrett was charged with two counts of neglect in the November 2017 death of her son Malakai. An autopsy determined the toddler had extensive bruising, consistent with blows from a fist.

She had been freed on bond while awaiting her upcoming trial in June.
