Megan Danielle Martzen, 19, will make her first appearance in Fresno County Superior Court on Thursday.
A criminal complaint charges her with murder and assault in the death of Ella Joy Vanleeuwen of Reedley.
Martzen was arrested Tuesday after a Reedley police detective’s affidavit in support of an warrant to arrest her said Ella died of blunt force trauma to her body, including her head.
Martzen told detective Mark Diedrich that Ella suffered her injuries when she fell from a bed.

The affidavit said Ella was left in the care of Martzen on Feb. 21, 2009, but it does not say where the alleged crime happened.
“By all accounts, Ella was in good health when left with Megan,” Diedrich said in his affidavit. But within three hours, Ella’s injuries included a fractured skull and a major hemorrhage to her abdomen, the affidavit said.
Diedrich said several doctors reports state that “Ella’s injuries were not consistent with a fall from a bed.”
The county coroner’s office also described the injuries as “non-accidental blunt force trauma,” he said.
Marten was arrest when a second pathologist this month ruled that Ella’s death was a homicide, the affidavit said.

Suspect In Reedley Toddler's Death Back In Court
The suspect in the murder of a Reedley toddler, is expected back in court on Thursday.

On Monday, Reedley Police arrested Megan Martzen for the death of 18-month-old Ella Joy Vanleeuwen back in February of 2009.
The toddler suffered injuries to her head, while Martzen was babysitting her and later died as a result.
Martzen remains at the Fresno County Jail on $2 million bail.

Reaction to the Arrest of a Teen Accused of Killing a Toddler

The Vanleeuwen's former neighbor, Mike Graffigna says, "Well the story I've heard is that the baby was jumping on the bed and fell and got hurt. If that's the case it's tragic." According to the Reedley Police Department, staff at Children's Hospital concluded Ella Vanleeuwen's injuries were not accidental. The Reedley Police Department says it took detectives this long to make an arrest, because the entire case relies on forensic evidence.
CBS47 went to the house where Megan Martzen was arrested in Reedley. Although people were inside, no one answered the door. But Reedley Police Chief Steven Wright says Martzen was very calm and she did not appear surprised at the time of the arrest.
We spoke with CBS47's legal analyst, Carl Faller, about what he thinks may happen with this case in court. Considering, there were no witnesses to the crime. Faller says a settlement is not completely out of the question. Former neighbors of the Vanleeuwen's say they're glad the family is finally getting closure.

Babysitter Accused of Murder is Pregnant
Megan Martzen is being held in the Fresno County Jail on a $2 million bail. Defense attorney, Jeff Hammerschmidt is working to get that reduced, so the 19-year old will not have to deliver her baby in a jail cell.

Martzen is accused of intentionally killing a 17-month old Reedley girl she was babysitting in February 2009.“Everything about her past suggests she is a very nice, young, gentle, caring person who loves children,” said Jeff Hammerschmidt.
Hammerschmidt says his client was a regular babysitter for the victim’s family. Martzen also worked for several other families.
“She's babysat for families including members of law enforcement who have entrusted their children to her. So it seems completely out of character that she would ever consider harming a child,” said Hammerschmidt.
For the past year, Martzen contends the 17-month old was injured by accident. That she fell off a bed onto the carpeted floor. However, a court document reveals the toddler’s injuries were not consistent with that story.
A doctor says the child suffered a fractured skull and a major hemorrahage in her abdomen. Injuries the coroner's office describes as "non-accidental blunt force trauma."

“If she wanted to flee, she could have easily fled. Yet she chose to stay here. She and her husband started a family, she will being having a baby soon and that's not conduct one would expect from someone with a guilty state of mind.”

Megan Martzen pleads to involuntary manslaughter, probation expected

The plea was based on a new complaint filed Wednesday by the Fresno County District Attorney's Office that said Martzen "did unlawfully kill Ella VanLeeuwen, without malice but in the commission of a lawful act which might produce death in an unlawful manner and without due caution and circumspection."

Last month, a Fresno County jury was hung on a murder charge against Martzen 11-1 in favor of innocent and voted 8-4 against a charge of child abuse causing death. In addition, the jury deadlocked 6-6 on involuntary manslaughter.

A probation report will be filed with Judge Edward Sarkisian, who is expected to sentence Martzen to probation on April 30. There is no agreement on the length of probation.

Deputy District Attorney Jeff Dupras told the judge that the original complaint, which alleged murder and child abuse causing death, was dismissed by his office in light of the new complaint.

That means the district attorney's office cannot file future charges connected to the VanLeeuwen case, said Martzen's attorney, Jeff Hammerschmidt.

Hammerschmidt said the plea agreement shows that the case involved a series of accidents, including at least one that occurred in the VanLeeuwen home.

"The plea reflects that this was an accident," he said.

A Fresno County jury of seven women and five men could not reach a unanimous verdict on the two charges that Martzen faced in the death of 17-month-old Ella VanLeeuwen.

After the mistrial was announced, Dupras and Martzen's attorney, Jeff Hammerschmidt, spoke privately with 10 jurors for more than an hour. Afterward, Hammerschmidt told reporters that one juror said the prosecution's case was like "Swiss cheese -- it had a lot of holes in it."

Hammerschmidt said the Fresno County District Attorney's Office should reconsider, since two-thirds of the jury believed Martzen didn't intentionally harm Ella.

"Sometimes people just need some time to reflect," Hammerschmidt said. "Hopefully, they will come back and do the right thing."

Jurors told Hammerschmidt that the 6-6 involuntary manslaughter vote was closer to conviction than the other charges because some jurors thought Ella should not have been on a bed while Martzen sat on the bed and worked on her laptop computer. Martzen said Ella was injured in a fall from the bed when Martzen shifted her position.

One legal observer, Fresno attorney Gerald Schwab Jr., who was not part of Martzen's defense team but observed testimony in the four-week trial, said prosecutors should seek a plea agreement that gives them a felony conviction but allows Martzen to be sentenced to probation.

"The jury clearly said murder and child abuse causing death are off the table," Schwab said. "And manslaughter was split dead even, so you can retry this two, three or four times and you're never going to get a guilty or not guilty verdict."

Prosecutor Jeff Duprase said Martzen inflicted two, and possibly three, blows to Ella's head and that one of the strikes was with a man-made object that has not been found.

He told the jury that Martzen intentionally punched Ella in the stomach, which caused additional bruising to her ribs.

"It was a continuous assault, a continuous attack that led to this little girl's death," Dupras said.

He also said that Martzen concocted a story about Ella falling from her booster seat when her brother pushed her over while the child's mother, Deniele VanLeeuwen, was supervising her children a day earlier. Defense experts said such an injury could cause a skull fracture that may not immediately produce symptoms.

But VanLeeuwen denied the booster seat incident ever happened.

Martzen's lawyer said she couldn't have made up a story about a booster seat fall.

Jeff Hammerschmidt said Martzen told her previous lawyer about the fall a day before Ella's autopsy revealed rib injuries that an expert later said were consistent with a booster seat being pushed over.

Hammerschmidt said a prosecution expert, Dr. Gregory Reiber, testified that a booster seat fall was an "uncanny" match for Ella's rib injuries and could have caused the initial skull fracture that built up cranial pressure before Ella's fall from Martzen's bed.

Another expert hired by the defense pointed to the "second fall" issue, which shows that a person can have a serious head injury and remain lucid for a day or two before collapsing, Hammerschmidt said.

He reminded the jury that Dr. Khaled Tawansy said the first fall could have taken place 12 to 48 hours before the fall from Martzen's bed, allowing the pressure in her skull to build until Ella collapsed.

Hammerschmidt said the case involved three separate tragedies -- the death of a little girl, the VanLeeuwens losing a child and Martzen being falsely accused and having to face trial.

Reedley police detective Mark Diedrich said Martzen told him Ella and her brother, John, were supposed to take a nap. John went to bed, but Ella was fussy and refused.

Martzen told Diedrich she took Ella into her bedroom where she was working on her laptop computer. Ella was standing on the bed when Martzen reached for a pen, causing Ella to fall to the hardwood floor. Ella died from head injuries, including a skull fracture, police reports said.

At the hospital, a doctor saw the bruising from an older injury and asked the VanLeeuwens about it.

A doctor told the VanLeeuwens that Ella died from "shaken baby impact" syndrome, which occurs when a baby's head is struck against a wall or other hard object.

But Ella also had bruises to her face and other injuries to her abdomen, injuries Hammerschmidt said were not reported to coroner's investigators.

He said the Reedley police investigation was "botched" and information about prior injuries was not given to Fresno County coroner's investigators.

Martzen did not baby-sit Ella and her brother in the days before Ella's fall, and the toddler could have been injured 12 to 24 hours before her death, Hammerschmidt said. Police should have told coroner's investigators about Ella's pre-existing bruises, he said.

During Tuesday's hearing, Todd and Danielle VanLeeuwen testified that their children went to Martzen's house four or five days a week and enjoyed it. They said there never were any incidents in the few months before Ella's fall.

Martzen had told the couple that Ella fell from her bed, but she didn't see Ella land.

She went to Ella's aid and found her not responsive and barely breathing. She called her mother-in-law before calling Danielle VanLeeuwen. The next call was for paramedics. Her husband, Scott Martzen, already was on his way home from work to eat lunch.

While at the hospital, a doctor saw the bruising from an older injury and asked the VanLeeuwens about it. They told him about the coffee table injury earlier in the week.

Danielle VanLeeuwen said Ella was injured when she and her brother were playing with cars and running around the coffee table.

"My husband told me about it," she said. "He saw it."

But Todd VanLeeuwen said he didn't remember witnessing the incident.

Both VanLeeuwens also said they knew nothing of Ella falling backward while on a booster seat that was atop a chair.

The Megan Martzen case is closed, with the Reedley baby sitter sentenced Tuesday to three years probation, 250 hours of community service, restitution and various fines in the death of 17-month-old Ella Joy VanLeeuwen.

But the hurt and bitterness that has divided two once-friendly families, and many in Reedley as well, will likely linger for a long time -- if not forever.

Fresno County Superior Court Judge Edward Sarkisian Jr. noted as much, saying early in the proceedings that the "aisle in the courtroom marks the deep division of those who are present."
