A woman is suing the Alabama Department of Human Resources, saying social workers never should have allowed her daughter to continue caring for her granddaughter.

News outlets report Michaela Cunningham says state workers knew the 11-month-old girl was being abused before she was killed. She had been diagnosed with Shaken Baby Syndrome, after which the hospital notified the agency and Catalaya was briefly removed from the home.

Now Bonita Cunningham and her boyfriend, Dennis Richardson, are charged with murder in last year's death of Catalaya Jordan Kyles. Autopsy reports show Catalaya suffered blunt force trauma to her abdomen.

Bonita Mercedes Cunningham, 29, has been charged with murder in the death of her 11-month-old baby, according to court documents filed Tuesday.

After arriving at the medical facility, officers noticed visible injuries on the baby.

Bonita Cunningham has been ordered to undergo a pre-trial mental evaluation. The dead baby’s grandmother wants punitive damages. - the baby is a burden to one and a paycheck to the other - what the fuck? Really?!

The lawsuit alleges the defendants named, which include DHR employees and Commissioner Nancy Buckner, failed to perform "their legal duty to make sure that the at-risk individuals served by the Department are safe and protected, including Catalaya Jordan Kyles." Michaela Cunningham is seeking unspecified damages.

i think the grandmother should get punitive damages
I agree! If not for any other reason but to hold the department responsible for their negligence. Maybe if they have to pay they will be more careful with these precious lives
Who the hell would give a child with shaken baby syndrome back to the piece of shit that caused the injury?

A Monroe County mother accused of killing her 11-month-old child was sentenced to life in prison, according to officials with the Monroe County District Attorney’s Office.

On May 29, 2018, officers with the Excel Police Department were called to the Monroe County Hospital for a report of a dead child. When officers arrived they allegedly found visible injuries on Catalaya Kyles, 11 months old.

Bonita Cunningham, 33, was arrested and charged with murder. The affidavit said Catalaya died from blunt force trauma. The district attorney’s office said Catalaya had injuries including burns to her neck, heel and hand.

Cunningham was booked into the Monroe County Detention Facility and given a bond of $80,000. Her trial occurred in November 2022, when she was found guilty of murder.

Officials with the Monroe County DA’s office said on Friday, Jan. 27, a judge sentenced Cunningham to life in prison.
