Eric Jason Auen Jr., 20, has been charged with child abuse resulting in serious bodily injury, according to jail records.
On Dec. 6, deputies responded to Ruby Memorial Children’s Hospital in Morgantown as a 4-month-old boy was being treated for a fractured skull and ribs, bleeding from the brain and eyes and bruising, according to a news release from the Lewis County Sheriff’s Office.
The news release said investigators uncovered past incidents of suspected physical abuse that led to the child being hospitalized.

Doctors said should the boy survive, he "will most likely suffer permanent and irreversible brain damage and seizures," according to court records.

Auen claimed he "blacked out" when alone with his son on multiple occasions and failed to provide details to investigations, according to a criminal complaint filed filed in Lewis County Magistrate Court.
The complaint said medical professionals believe the injuries are believed to have been created by blunt force trauma.
The baby was also hospitalized in October with a traumatic head injury, a fractured skull and a broken arm, deputies said. During that appointment, a CPS report was made, and the baby was supposed to be seen in the Child Safety & Advocacy Clinic, but his appointment was “refused,” court documents say.

Court documents say that Auen himself was taken to the hospital on November 3rd because he had “bad thoughts,” which included “placing the infant victim on his lap and squeezing the child’s head until the child’s head ‘popped off.’”
Later in November, the baby was seen at the Stonewall Jackson Memorial Hospital’s Emergency Department for bilateral hand swelling on one occasion and a ‘rib injury’ on another, in which Auen reported “hitting the baby’s chest with his elbow while co-sleeping.”


Doctors told deputies the injuries were all the result of intentional child abuse, and deputies said the abuse occurred at Auen’s residence in the Orlando area of Lewis County.

Another person has been charged in the case where a 4-month-old infant in Lewis County suffered multiple brain bleeds, a cracked skull and other severe injuries.
Last week, Eric Auen was charged with four counts of child abuse causing serious bodily injury for alleged intentional abuse of the infant when he was “blacked out” during multiple instances between September and December.

Now, deputies with the Lewis County Sheriff’s Department say that Alexis Benedum, 22, of Orlando, failed to take the infant for medical treatment after several stances of abuse and that she caused injuries to the child herself.
According to a criminal complaint against Benedum, the infant, who was born in August, was injured from or showed signs of abuse at least seven times between Sept. 3 and Dec. 6.
A text message sent by Benedum on Nov. 29 questioned whether Auen could be charged for an injury to the child he claimed was accidental, deputies said, which “suggests that [Benedum] suspected abuse against the infant victim; however, at no point prior to this incident or after this date did [she] report her suspicions of abuse, assure the child was not left alone with [Auen]” nor seek other help to protect the child, the complaint said.
She also accompanied Auen to a mental health evaluation on Nov. 3 where he reportedly admitted to “having thoughts of willfully and intentionally harming the child” and “disclosed that he had thoughts of placing the infant victim on his lap and squeezing the child until the child’s head ‘popped off’,” deputies said.
In a Mirandized interview with law enforcement after Auen’s arrest, Benedum admitted to law enforcement that some time during October or November, she “had forcibly shoved a pacifier in the child’s mouth in an effort to make the child stop crying” and then “observed blood coming from the mouth of the infant victim after having done so.”
During that interview, Benedum also admitted to “having been aware of the possibility that Eric Auen has been intentionally causing physical harm to the infant,” the complaint said.

Alexis Benedum has been charged with six counts of child neglect resulting in injury and one count of child abuse resulting in injury.

Six people have been indicted during a special term of the Lewis County Grand Jury Monday for the abuse of a 4-month-old baby.

Eric Auen, Jr. and Alexis Benedum have been indicted after the baby was admitted to WVU Medicine Children’s in December with a brain bleed, a fractured skull, bleeding behind the eyes, broken ribs, organ damage and bruises on numerous parts of his body.
According to deputies, Auen was physically abusing the baby, and Benedum did not report the baby’s injuries.

The couple was arrested in December for their involvement in the case. However, four additional people have been indicted during the special term on charges of child neglect and child abuse reporting procedures in relation to the same case, according to the Lewis County Prosecuting Attorney’s Office.
Stephen Benedum, Kristina Benedum, Katelyn Bunch and Jessica Embrey have also been indicted on child neglect charges.

The Benedums are facing six felony counts of gross neglect of a child creating a substantial risk of death or serious bodily injury each. Kristina is also facing one misdemeanor count of persons mandated to report suspected abuse.

Eric Auen Jr. was sentenced to seven to 35 years in prison on several child abuse charges. He will also serve 50 years of supervised release after his prison term.

Auen and Alexis Benedum were indicted in April after the baby was admitted to WVU Medicine Children’s Hospital in December 2024. The 4-month-old baby had a brain bleed, a fractured skull, bleeding behind the eyes, broken ribs, organ damage and bruises on numerous parts of his body.

Auen was physically abusing the baby and Benedum did not report the baby’s injuries, deputies said.
Benedum was sentenced to three to 15 years in prison on child neglect charges in September.
The guardian of the baby said the child now has permanent brain damage.


During sentencing, Auen said he “deserves to be going” where he is going.

The judge in the case said this was the most severe case of child abuse he had seen where the child lived.
According to deputies, the child’s grandparents, Stephen and Kristina Benedum, were aware of the abuse. Katelyn Bunch, a social worker, was also allegedly aware of the abuse and was called to the home to investigate when the baby was 2 months old. All three are charged with six counts of child neglect.
 
So, that 50 years of post prison supervision. Is that set in stone, or can the courts grant leniency if they want to? Because I like the odds if he serves 35 years plus the 50 years! That'd put him at over a 100 years old if he gets off supervision... :angelic:
