In late January, five of 27-year-old Lyssa Hewitt's children were removed by child protective services from a home that she and Blayke Yorks, 21, were staying at on Inn Road.
A cadet arrived to serve a subpoena, but to his surprise, Hewitt's five-year-old son answered the door with a knife.
The cadet asked the five-year-old to get an adult, but he returned instead with a loaded gun.
“It was clearly accessible by a five-year-old so it was not stored properly," BCPD Detective Trevor Hoard said.
Yorks, who was also a caregiver to the children, admitted to officers the gun was his.
Road patrol officers called to the scene witnessed what was described as "poor living conditions."
Inside the home, human feces and old moldy food were discovered on the ground, according to court records.
Officers also found knives, scissors and other sharp objects on the floor.
In addition, a padlock was placed on the the fridge, which had little to no food inside, court documents detailed.
“It was very unsafe by cleanliness, it was very unsafe for any kid let alone an adult to be there," Hoard said.
BCPD cited the home for several code violations. These include:
Unsanitary conditions throughout
Dangerous electrical violations
Missing smoke detectors
Unpermitted electrical, plumbing, and mechanical work
Inoperable vehicles/parts
Junk and trash
The home has since been condemned by the City of Battle Creek.
