A Wilkes-Barre man was sentenced Wednesday to 14 to 28 months in prison for hitting an infant who woke him in an Archbald home.
Juriiyah Westberry, 23, is a remorseful man who, exhausted by a 16-hour work day Nov. 17, "snapped" at the 10-month-old's cries and struck the baby's head three times, said his attorney, Curt Parkins.
Parkins called the act "aberrant" and said he has rarely seen such "substantial discrepancy" between the crime alleged and the nature of the person accused.
Westberry's actions, however, could have caused "real severe damage," Deputy District Attorney Sara Varela said. The child, in foster care, appears to be doing well.
"I've had a lot of time to think about it," Westberry said.
Once Westberry completes his sentence he must spend two years on probation, the judge ordered.
