A 20-year-old Fresno man is behind bars, accused of sexually abusing and killing a toddler.

Fresno Police say Xavier Christopher Hawkins brutally beat a little boy to death inside his Fresno apartment Sunday afternoon.

Police say Hawkins, who also goes by the last name Weeks, now faces murder, physical and sexual abuse charges relating to the murder of 2-year-old Syre Bridges.

Hawkins was the live-in boyfriend of the boy's mother, police said.

On Sunday afternoon, Fresno Police went to the couple's Westside apartment after the toddler was rushed to Community Regional Medical Center. Syre was not breathing.

Fresno County Social Services Director Howard Himes says his department got a referral from the 2-year-old's grandmother asking CPS to check on some bruising on the child's face.

"All six attempts we were unable to locate the family at that point in time. That's why we also requested the Fresno Police Department to investigate as well," Himes said.

Police Chief Jerry Dyer says his officers stopped by the apartment on three occasions, but no one was ever home. The chief adds that Child Protective Services never relayed to police the severity of the suspected abuse, only that police needed to check on the 2-year-old's condition.

An autopsy found 23-month-old, Syre Bridges died from blunt force trauma to the body. Police say he was severely beaten when they found him. He wasn't breathing and had bruises on his head. Hawkins was actually the one who called 9-1-1, on Sunday. He was booked into Fresno County Jail on charges of murder, child abuse and penetration with a foreign object.

Fresno Police Chief Jerry Dyer expressed, “I don't know that there's a penalty that can be given to him that would be good enough. It was very apparent that this child, as a result of his injuries, was tortured and at the hands of Xavier Hawkins.â€￾

The mother of a murdered toddler talks about the man accused of brutally killing and sexually abusing her son.

She says the accused killer encouraged her to avoid Child Protective Services.

CPS and Fresno Police had been investigating allegations 2-year-old Syre Bridges was being abused. But neither CPS nor officers had ever been able to get a hold of Syre’s mother or see the little boy.

19-year-old Emiley Bridges knew about the investigation by Child Protective Services and the allegations her son, Syre, was being abused. She had noticed bruises on the boy.

“But he was very active. I didn’t think that he was being abused,â€￾ Emiley Bridges told us.

CPS said they tried to make contact with Emiley and Syre six different times. And they called Fresno Police to try and track down the mother and child.

Emiley says one of the times CPS came to her door, she and her boyfriend were home.

“I was going to answer the door one time, but Chris wouldn’t let me,â€￾ Emiley said.

Chris is her live-in boyfriend, Xavier Christopher Hawkins, also known as Chris Weeks.

Emiley now believes Weeks is responsible for her son’s death.

“Yeah, he was the last one to see him alive,â€￾ Emiley said.

Emiley said she had known Weeks all her life. They moved in together in June.

She says Weeks, who’s now 20-years-old, had served time in juvenile boot camp and at California Youth Authority. Police say he was on probation for a gun charge.

Emiley now says she would do things differently.

“I would be there for him more. I would have done something about it a lot sooner, if I knew,â€￾ Emiley said.

Fresno police say Emiley has cooperated with them. She does not face any charges.

Syre would have turned two years old on November 25th.

Xavier Hawkins is facing murder and child abuse charges, but one charge was dismissed Monday.

Prosecutors presented the first evidence in the case on Monday.

Investigators believe Hawkins was the only adult in the apartment when the little boy suffered the massive injuries that killed him.

But Hawkins' defense attorney is trying to show the boy's mother may have been there as well.

Hawkins and Emiley Bridges could only explain a couple of Syre's bruises.

Investigators say Hawkins wouldn't even look at pictures showing the full extent of the boy's injuries, but Dr. Michael Chambliss had to look at Syre to perform an autopsy.

He found a couple old bruises, and a lot of new ones.

Chambliss says extreme physical abuse killed Syre, and the abuse happened just before the boy died.

"I'm saying that the injuries that are fatal, he would not have survived for hours," Chambliss said.

Detectives say Emiley Bridges left her son and Hawkins in their Central Fresno apartment about three hours before the boy died.

But Hawkins' defense attorney says she may have returned.

And, he says, Bridges had a suspicious response when police informed her of Syre's death.

Detectives say there's evidence that Emiley Bridges rode the bus, and shopped at Wal Mart.

Her whereabouts, though, will likely be an issue when Hawkins stands trial.

A judge decided Monday there's enough evidence for Hawkins to face trial on murder charges, but he dismissed sex abuse charges for a lack of evidence.

He's due back in court later this month.

A Fresno man accused of beating a toddler to death in 2011 will go home a free man Monday night.

A jury found Xavier Hawkins not guilty of murder or assault leading up to the death of his girlfriend's son Syre Bridges.

Prosecutors say Hawkins was smoking pot and playing video games when he was interrupted by the 23-month-old boy. They argued he beat the toddler so hard that he left bruises all over his body.

But his defense attorney says the child's mother also regularly hit the boy. He added Hawkins is ecstatic about being reunited with his family.

"It was an emotional moment. I was surprised and he was surprised," said attorney Scott Baly. "It's an all or nothing moment in a lifetime because it means every day for the rest of his life possibly in prison, but at that moment it means he's going home tonight."
