A 31-year-old woman is suspected of sexually assaulting a 13-year-old boy.

Fountain Police shared details on the case with the public Tuesday evening. According to police, the department started investigating suspect Andrea Serrano after receiving a tip on June 27. Serrano was arrested on Tuesday after “confirming” she had a relationship with the teen, according to police.

Serrano is charged with sexual assault on a child by one in a position of trust and sexual assault on a child.
 
A Fountain woman who was accused of sexually assaulting a 13-year-old boy and becoming pregnant with his child accepted a plea deal Thursday, and as a result will avoid further jail time for the allegations.

Andrea Neenet Serrano, 31, is accused of having a sexual relationship with the boy who Serrano said viewed her as a "mother figure," according to Serrano's arrest affidavit.

Serrano originally faced two charges, sexual assault against a child and sexual assault against a child under the age of 15 by one in a position of trust; but Thursday morning Serrano entered a plea of guilty to the charge of incest — an amended charge added for Serrano to plead guilty to.

The plea deal agreed upon by Serrano comes with a potential sentencing of 10 years to life on sex-offender intensive supervision probation, as well as having to register as a sex offender for the remainder of her life.

The plea deal also stipulates that there will be no additional jail time given to Serrano at sentencing.

The mother of the victim spoke to Judge William Moller prior to the plea deal being accepted to voice her displeasure with the fact that Serrano may not receive any jail time for her crimes.

"She (Serrano) sexually assaulted my 13-year-old son ... She introduced him to drugs, she needs to be in jail," the mother of the victim said in court. "It's a double standard. If she was a man, and my son was a girl she (Serrano) would be behind bars right now."

The prosecution noted during the plea deal that Serrano had given birth to the child she conceived with the victim, and she is currently caring for the child.

Custody and visitation of the child was a topic briefly discussed as an unresolved issue at the end of the hearing, but Moller stated it was not something that could be resolved in his courtroom and would need to be resolved by the Department of Human Services.

Serrano is currently out of custody after having posted a $70,000 bond in July 2022, and will remain out of custody on bond until her sentencing hearing.

KKTV reports Andrea Serrano of Fountain, Colorado, was facing sexual assault charges after her arrest in 2022 but earlier this year accepted a new plea deal to stay out of prison.

Serrano gave birth to the baby boy after she admitted to having sex with the 13-year-old. The mother of the victim told KKTV she is not happy with the deal offered to a woman she says ruined her son’s life.

“I feel like my son is robbed of his childhood. Now he’s having to be a father. He’s a victim, and he’s going to have to live with that for the rest of his life,” the victim’s mother said.

She questions why Serrano won’t face prison time.

“I feel like if she was a man and he was a little girl, it would definitely be different. They would be seeking more. I feel like because he is not a woman, they are not. They are having compassion for her,” the victim’s mother said.

Under terms of the plea deal reviewed by KKTV and that the suspect signed off on, Serrano will be required to register as a sex offender, and the judge could sentence her to 10 years to life on sex offender intensive supervised probation. Serrano will avoid any jail time, since the district attorney’s office dropped the original charges to a lesser charge that does not come with mandatory jail time.

The victim’s family is also looking ahead to the next steps in this case. They plan on asking the courts to give the 13-year-old custody of the baby. Currently, Serrano has custody. Serrano will find out in May how long she’ll be on probation.
