A 12-year-old Milwaukee boy was killed and another, 8, was hurt after suffering blunt force trauma injuries during what is believed to have been a hammer attack, according to local reports.
Police responded at about 8:30 a.m. Sunday to Milwaukee's north side and are investigating the events of the attack, including the homicide of the pre-teen, according to FOX 6 Milwaukee. The affiliate station reported that the boy was rushed to an area hospital, but could not be saved.
A number of neighbors, including Lewis Williams, told reporters a hammer was apparently used to inflict the injuries. Williams told local reports he overheard the younger victim talking at the scene. "From what I heard, directly from his mouth was, ‘he tried to hit me with the hammer, too,’" said Williams. Williams also described how he heard arguing and then saw people putting a boy into a car that then drove away.
Police are still searching for a suspect, who has been identified by police, according to the Associated Press. An autopsy by the Milwaukee County Medical Examiner’s Office is expected to be done Monday.

It happened near 46th and Hampton on Sunday, Aug. 30. Police say the child died of blunt force trauma.

Family says that boy was 12-year-old Andre Smith Jr. His mom, Nakeda Martina, is devastated and says she has been fighting to regain custody of Andre because she was worried about his safety.

“He was so sweet, he was personable, he just always smiling, wanting to hug people,” Martina said about Andre.

Martina says Andre wanted to own a business some day, but the 12-year-old's life was cut short Sunday.

Family says he was beaten to death with a hammer. Andre's 8-year-old brother was also injured. Police say they're looking for a known suspect.

“He just call me Friday night, wished me a happy birthday,” Martina said through tears.

Martina says Andre's grandmother had custody of Andre and his siblings, but she has been fighting to get her kids back.

“I’ve been calling [child protective services] every week since Andre got hit by a car July 4,” Martina said. “Nobody contacted me back.”

CBS 58 is not naming the suspect because he's not charged. Martina showed CBS 58 text messages from earlier this month where she asked Andre's guardian not to allow that suspect around the kids.

“I hope every second, every breath you take, you think about how you killed my baby,” Martina said. “He probably was crying for his mama, you all know he wanted to come home.”

Now Martina wants answers from the state about how this could've happened, and she wants to be able to see her other kids.

“They all are responsible for ignoring me and my child,” Martina said. “I’ve been calling them, nobody came, nobody checked on my child.”

And most of all she wants justice for Andre.

“They took my baby from me,” Martina said. “He was so sweet, I miss him.”

Martina says she has a lawyer trying to get her other kids back.

A 12-YEAR-OLD boy in Milwaukee is dead after his felon grandfather beat him to death over missing money.

Police say 53-year-old Andrez Martina admitted to "losing control" on Sunday and beating his grandchild, Andre Smith Jr., to death, in Wisconsin.
Andre and his 8-year-old brother were staying at Martina's house when Martina allegedly asked to have the boys sleep over to get school supplies the next day, according to a criminal complaint obtained by CBS58.

Wisconsin Right Now reported that Martina is a “multiple time felon (at least four times over) convicted of drug dealing and was arrested years ago for homicide,” but CBS58 reported his grandmother, Illysha McCroy, had custody of him and was giving the boys’ grandfather “the chance to get to know his grandkids” after not previously being in their lives.

Martina told police he woke up at about 3am to use the bathroom and noticed money was missing from his wallet. He claimed he went to the living room and accused Andre of taking it.

Although the young boy allegedly turned his pockets inside out to show his grandfather he hadn’t stolen the money, Martina told officials he then hit Andre repeatedly, continuing to do so even after Andre went to a cousin's bedroom to get the cash.

The complaint noted that Martina recalled, "I'm not killing him, I'm just bopping his [expletive],” according to CBS58.

Investigators said that in the course of the attack, Martina attempted to use belts and even beat the boy with Martina's mother's wooden cane.

At one point, the complaint noted, Andre was able to run to the bathroom to lock himself inside, but Martina told investigators he picked the lock open and "lost it" on the boy.

He said he shoved Andre at one point and his head left a hole in the wall.

Martina's mother, who lived in the same residence but is disabled, told investigators she saw Martina hitting Andre with a hammer and that the attack lasted an hour to an hour-and-a-half.

The boy’s aunt, Nia Moore, received a call for help Sunday morning, only to find the boy unconscious when she arrived.

"We was trying to save him. We couldn't save him," Moore told WISN 12 Milwaukee.

Moore and her boyfriend brought Andre to the hospital, but sadly, Moore said, "He died on me when I was in the car. And then he died again at Children's Hospital.”

According to the criminal complaint, Martina did not remember using a hammer to hit Andre but did admit he lost control in the attack that killed the pre-teen.

Andre's 8-year-old brother also suffered a broken finger, bruising to his body, and a laceration to the top of his head in the attack, CBS58 reported.

The boy's mother, Nakeda Martina, told CBS58 she had been fighting to get custody of Andre when he died and is now trying to get her other children back.

Martina has been charged with first-degree intentional homicide; physical abuse of a child, repeated acts causing death; neglecting a child, consequence is death; physical abuse of a child, repeated acts with high probability of great bodily harm; and finally possession of a firearm by a felon

So he killed a boy in 1989 and the family still allowed the children around him.
Court records show that he was convicted of a charge under Wisconsin Statutes 940.01(89), according to online court records. 940.01 is the first-degree intentional homicide statute. The clerk at the courthouse told Wisconsin Right Now that Andrez Martina was charged with first-degree intentional homicide in that case. Our source confirmed that he was arrested for first-degree intentional homicide on June 11, 1989. The case is converted in the system because it’s so old; we’ve ordered it to get additional details on what happened. We’ve also contacted the Department of Corrections to get his prison history.

The state Department of Corrections spokesman, John Beard, said Martina was sent to prison on a “homicide-reckless conduct” conviction in 1990. He had a mandatory release date of August 1994. He was in and out of DOC custody over the years, starting in 1990. He’s no longer on supervision by DOC.

Andrez D. Martina was once quoted in this story about an apartment building where he used to live in South Bend, Indiana. His full name is Andrez Danielle Martina. We ran his record in Indiana too and only came up with an eviction.

We reached out to CPS to find out why the grandfather had access to the children and why the mother’s concerns weren’t addressed (she told local media she tried repeatedly to reach CPS and didn’t want the suspect around her kids), asking a series of questions. They refused to answer them, but did release this brief report.

Mom and the sibling will receive a nice big check from the state of Wisconsin.

A Wisconsin man with a multiple felony history is accused of fatally beating his own grandson with a sledgehammer after allegedly finding money missing from his wallet.
The incident happened Saturday night in Milwaukee, according to police, when 12-year-old Andre Smith and his brother, 8, spent the night with their grandfather, Andrez Danielle Martina. A criminal complaint indicates that at some point on Saturday evening, the children’s grandmother, Illysha McCroy, contacted her daughter, Nia Moore, and told her to come to get the boys immediately.

According to court documents cited by FOX6 News Milwaukee, McCroy has legal custody of the children. Their biological mother has been identified as Nakeda Martina.
Moore and her boyfriend arrived at the home, where the youngest boy ran out immediately. Inside, Andre was covered in blood and not moving. They rushed him to St. Joseph’s Hospital. He was then transferred to Children’s Wisconsin, where he ultimately died.
‘I’m not killing him, I’m just bopping his (expletive),’ the criminal complaint quotes Andrez Martina as saying during the beating.

The incident lasted from 3 a.m. to 8 a.m. and he told detectives he warned his grandkids ‘if you lie, if you mess up in school, if you steal, I’m going to kill you,’ the complaint says.
Authorities interviewed everyone in the home, including a great-grandmother who also lived in the residence. The great-grandmother told police that she saw Martina ‘striking Andre with a hammer all over his body, including the head and back.’ He then switched weapons and allegedly began beating the boy with a cane, she said.
The incident happened after Andre allegedly took money from Smith’s wallet, but the great-grandmother said Martina continued to beat the boy even after the child went to a different room to retrieve the stolen money.
The younger boy confirmed that Martina beat them after accusing Andre of taking money from his wallet. The boy said Martina beat them with a sledgehammer, cane, mallet, and coat rack.


Milwaukee County Medical Examiner Brian Peterson indicated that Andre had a fractured skull and numerous blunt force blows to his body.
Police arrested Martina and charged him with intentional homicide, child abuse, neglect, and conviction of a firearm by a felon. If convicted, the grandfather faces life in prison according to the Milwaukee Sentinel Journal.
Of note, this isn’t the first time Martina has been in legal trouble. In 1989, he was convicted of second-degree reckless homicide and served a four year sentence. He had just recently moved back to Milwaukee to be near his grandchildren ABC 12 reported.

‘Nobody contacted me back.’

Nakeda Martina told the outlet she had been trying to get her children back for a while after concern for their safety and had ‘been calling CPS since last year.’ It remained unclear why the child protection agency was seemingly dragging its feet.

The trial for a Wisconsin grandfather accused of beating his own grandson to death with a sledgehammer got underway in Milwaukee on Wednesday.

The 12-year-old's grandfather, Andrez Martina, is charged with first-degree intentional homicide and physical abuse of a child in relation to his death on August 29, 2021. Prosecutors allege Martina used a sledgehammer and other objects to beat the boy.
In an interview with police, Martina admitted to being under the influence and blacking out during the beating, according to Fox 6.

Smith's 8-year-old brother testified at the trial, saying he witnessed the beating and that his grandfather also hit him with a cane.
Martina testified in his own defense on Wednesday. He claimed his grandson stole $1,000 from him, wouldn't tell him where it was and then pulled a gun on him.
"Well, once I grabbed the gun from him, and he hit the wall, everything went lights out," Martina said.
He claimed he didn't mean to kill the boy.
Martina waived his right to a jury trial, so the judge will decide the verdict.
 
Andrez Martina will spend the rest of his life behind bars for the first-degree intentional homicide and physical abuse of a child causing death – for the murder of his 12-year-old grandson, Andre Smith.
Police say Martina beat the 12-year-old to death with a sledgehammer and other objects – because he believed the child stole money from him.

During his trial, Martian told the court he was acting in self-defense – and accused his grandson of pointing a gun at him.
"The extreme nature of the violence this defendant imposed the scope of the violence…demonstrate an unspeakable level of evil," said Matthew Torbenson, of the prosecution team.

On Monday, June 6, the state requested Martina be given life in prison without the possibility of parole for the two most serious counts against him.
"I was scared to come back to Milwaukee 'cause we all know what goes on here – that dark cloud," said Andrez Martina.
Martina apologized for what happened, but stopped short of taking responsibility. Martina's words did not sit well with the judge.
"You, in turn, then come into this courtroom and blame this community for your actions. Shame on you. That’s a coward’s way out," said Judge Stephanie Rothstein.

Judge Rothstein followed the state's request.
 
It doesn’t seem like the mom was trying all that hard to get them back if all she ever did was call CPS weekly for a year (according to her).
Was the great grandma so handicapped she couldn’t call 911? And who called the aunt instead of 911? More people are at fault here.
The only ones I feel badly for are the children. The rest can rot in hell.
 
Unless the children are entirely removed from their family of origin (no contact whatsoever) I am saddened for their future :(

Sadly, no one in their family will probably hold either of these women that failed all the children accountable for it.
