Charleston Williams, 25, and wife Crystal Williams, 27, took custody of Josiah because his biological mother is in prison. Under their watch, he became malnourished and suffered severe physical trauma, according to the affidavit.

Josiah had two black eyes, bruises and cuts all over his body, as well as tears behind his ears and large gashes inside his lips, according to the affidavit.
He also showed signs of “prolonged malnutrition,” weighing 38 pounds at the time of his death.
Charleston Williams admitted to beating Josiah with a belt and placing him in “time out” in a closet, but said his injuries were from accidental falls.
He “was adamant that to the best of his knowledge (Josiah) was never struck in the head by anybody in the household,” the affidavit said.
Crystal Williams corroborated her husband's story that Josiah had fallen multiple times that week, but said one of his falls was “intentional” because he was protesting being put in time out, and he “threw himself to the floor and struck his head,” the affidavit said.
The couple's stories diverged when it came to the malnutrition aspect of Josiah's injuries.
Charleston Williams said Josiah was “healthy, even a slightly overweight child” when he came to live with them, but had been refusing to eat, the affidavit said. Crystal Williams said Josiah had been eating regularly and didn't know why he was losing weight. Both denied intentionally starving him.
The Bexar County medical examiner's office still is investigating the cause of Josiah's death. If his death is ruled a homicide, the couple's charges could be upgraded.
Two other children who lived with the couple, an 8-year-old boy from Crystal Williams' previous relationship, and 2-year-old girl that's biologically theirs, were taken into Child Protective Services' custody.

Details about the boy's suspected abuse emerged after the arrest of Josiah's step-grandmother, Gloria Proo, 48, who is believed to have taken a lead role in disciplining him. Proo was arrested Thursday night on one count of felony injury to a child by omission. Bond was set at $75,000.
Witnesses reportedly told police the child looked “scared, sick fragile and thin” during a barbecue at the family's house in late November. Josiah, who reportedly looked jaundiced and had a scab on his forehead, had been forced to stand in a corner and not move or look at anyone.
When the child looked back, the witnesses said, Proo came up from behind, grabbed him by the back of the head and slammed it against a wall three times.
Police later found holes in a closet wall that appeared to be the size and circumference of a child's head. There was also blood inside the closet.
One of the witnesses said he asked the child to go outside with him to talk, and when he asked the boy to sit next to him, Josiah said he “was not allowed to sit with everyone else because he 'pooped' on the furniture,” the affidavit said.
He was only allowed to have leftover pizza once other children at the party were done eating.
Another witness told police that Proo had once taunted the child with an empty beverage container. Proo allegedly offered the child a grape-flavored drink, but the child declined because he “didn't want to get into trouble.”
After Proo convinced him to take the drink from her, she laughed when he realized the container was empty, the witness said.

Proo is Crystal Williams' mother, and is not biologically related to Josiah Williams but called herself his grandmother.
Sgt. Jim Cole said the investigation revealed Proo was spending hours and sometimes days alone with the child and was taking a lead role in disciplining him, adding that investigators found “a pattern of physical assault that goes above any reasonable standards of discipline.”
