Prosecutors say a Louisville mother had been partying for three days before she was found passed out on top of her infant daughter after a car crash.

The Jefferson County Coroner's Office has identified the baby as 3-month-old Charvi Scruggs. The baby died of asphyxiation, according to prosecutors.

Ebony Moore is charged with manslaughter in connection with her child's death. A not guilty plea was entered for her in Jefferson District Court.

"My sister is not a monster," Moore's sister Deneshia Blincoe, said while gathered with relatives outside the jail supporting Moore. "She does have another child -- a 3-year-old. We all make mistakes. If we was perfect, we wouldn't be here right now."

the relatives rallied together outside jail Thursday said Moore battled mental illness, bipolar disorder and an abusive relationship.

"She would do anything anything for anybody and it's messed up she's in this predicament," Moore's cousin Meshell Weatherford said. "That's not the kind of person she is and she has had a hard life. I mean a hard life."

The judge granted a request to raise Moore's bond from $10,000 to $100,000. Relatives say CPS has taken custody of her 3-year-old daughter.

Police say the car was still running and in drive when they arrived at the scene where Moore hit a parked car around 1:30 a.m. on Feb. 19.

Court documents say Moore was "laying on top of her infant child" in the driver's seat. Family members say the child was not in a car seat.

According to court documents, results of toxicology tests indicate Moore's blood alcohol level was 0.175% at the time of the crash. She also tested positive for amphetamine, opiates, THC and cocaine. Police say Moore admitted to drinking alcohol, smoking marijuana and taking ecstasy and muscle relaxers before getting behind the wheel.

Let's see, she had a depressant (alcohol), a stimulant (amphetamine), another depressant (opiate), one that could go either way (THC), and another stimulant (coke), all in her system at the same time, but hey, "That's not the kind of person she is".

Ebony Moore told the judge about her success in drug and alcohol rehab programs.

"I have been doing everything I can do to make sure I'm doing right," she said.
She also pleaded for a second chance, "I have a sister that's pregnant at the moment and she really needs me and I apologize to the court for my mistake."


Moore admitted that in the days leading up to her baby girl's death, she was drinking and taking drugs and muscle relaxers. She then got behind the wheel and crashed into a parked car in the Park Duvalle neighborhood.
"At some point, after the car had come to a stop she passed out on top of her 3-month - infant and suffocated her to death. Probation for that would be a mere slap on the wrist," assistant commonwealth's attorney Sheri Wornall told Judge Barry Willett.
Before sentencing, Judge Willett told Moore he couldn't think of a case more tragic than hers.

"Your daughter lost her life, based upon decisions you made," he said, before telling her, "I'm going to send you to serve six years in the penitentiary."
Based on sentencing guidelines, Moore could have spent anywhere from 5 to 10 years behind bars, or even gotten probation. So, the prosecutor believed Moore's sentence provided some sort of justice for little Charvi.

"I do think it's a good outcome, but I think it's definitely difficult to say justice was done when a 3-month-old has died," Wornall said.
