A mother of 5 whose six-month-old was found dead in a filthy, feces-smeared home is facing criminal charges and has been stripped of her children.

Charlene June Riera, 39, is charged with child endangerment alleging her five children lived in a squalid home with no food or main heat source.

The charges follow the death of Riera’s daughter, 6-month-old Nora Riera, who died in the family home at the home the morning of Jan. 4.

An autopsy determined the baby died of “asphyxiation due to mechanical compression,” and the Luzerne County Coroner’s Office ruled the death accidental.

But state police say when they entered the home they were hit by a foul odor and observed filthy conditions, including garbage, leftover food and clothing scattered around. Officers also observed animal feces on the floors of multiple rooms, police said.

The home featured a large bird cage containing two cockatoos along with a chicken, as well as an overturned cat litter box in an upstairs room, according to the complaint. There was also a baby crib that was filled with clothing and empty soda boxes, police said.

The basement had a large number of filled garbage bags, and the refrigerator didn’t contain any food, according to police.

The rest of Charlene Riera’s children remain in foster care, but she has been busy repairing and cleaning her home, the newspaper states, adding:

A judge in the case allowed her to remain free on $25,000 unsecured bail, with orders for her to continue rehabilitating the property.

Newport Twp. Code Enforcement deemed the home unfit for human habitation based on the amount of “garbage and filth” police found. State police Cpl. Robert Betnar told the judge that, although the house failed an inspection on Feb. 4, Riera has been working to improve the property, which she owns along with her husband.

Riera informed the court that her husband, 36-year-old Bolivar Patricio Riera, had nothing to do with the condition of the property because he is in prison. Court records show Bolivar Riera was sentenced last August to serve three to six years in state prison on charges of aggravated indecent assault with forcible compulsion and unlawful sexual contact with a minor.

Webby allowed Charlene Riera to remain free on $25,000 unsecured bail, with orders for her to continue rehabilitating the property. Charlene Riera, who is already on probation from a previous driving under the influence conviction, was also ordered to continue drug and alcohol treatment and to take parenting classes.

  • Mechanical asphyxia—this is due to mechanical interference to respiration, e.g. hanging, strangulation, throttling, smothering, choking, drowning, etc

Mechanical asphyxia could be of following types depending upon the respiratory block.

  • Compression/ constriction of the neck, e.g. hanging, strangulation, throttling, etc.

Thanks. I just don't understand how this was accidental.
 
I don't think the coroner made the right conclusion..there is no way this was accidental. I mean, maybe the baby strangled on something or choked on something, BUT with the amount of neglect going on in that home, anything that caused this baby's death was due to neglect....so I certainly wouldn't count that as an accident

I got this one. As someone with a pathological fear of my kid (yay anxiety with OCD features) I have done obsessive levels of research about all the ways babies can accidentally die.

Asphyxiation due to mechanical compression, ruled accidental, for a 6 month old, likely means that she got stuck between a thing and another thing, and couldn't get out because she's a baby. Most common cause would be rolling into a gap between the bed and wall after sleeping in an adult bed, getting stuck, and suffocating. It could also occur if there were a headboard (or other furniture) with bars spaced far enough apart for the baby's body to slide through, but not her head. So if she fell into that space, she could asphyxiate with her head caught between the bars.

These things happen surprisingly often for babies who cosleep in unsafe situations. I believe it's entirely possible it was accidental. Bed needs to be pushed up close to the wall. No gaps anywhere of more than 1 inch. No blankets, pillows, other kids, smoking, excessive heat, or even loose long hair. Too bad baby's crib was filled with junk, huh? But my baby didn't sleep in her own bed till she was 8 months old, so i can't judge on that front.

So her husband was in jail for kiddy diddling and she kinda fell apart. I'm guessing that's why the court was so lenient. Not sure what I would do in that situation, either.

Coroner's determination is not the same as the court's determination. It's not an assessment of blame, just causation.

She was still charged with child endangerment, so obviously the court felt the same way.

Mechanical asphyxiation also includes choking on an object. A baby choking on a toy or food for example is mechanical asphyxiation and accidental. Just because she's a slob doesn't necessarily indicate that she killed her child on purpose.
Which should still be child neglect at the minimum.

I guess it depends on their state and how they rate it... But to me all I'm reading is here is a slap on the wrist have your kids back try not to kill another one
 
Charlene June Riera, 40, who had been charged after a 6-month-old was found dead in a home deemed unfit for human habitation entered a guilty plea on the charges against her.

Riera had not been charged specifically in the infant’s death, but was rather charged as a result of the state of the home, as investigators found filth throughout the home, including a bird cage with two parrots and a chicken inside of it, an overturned litter box with feces on the floor, and numerous space heaters and no permanent source of heat.

Five children in the home were taken into protective custody, and several animals were removed from the house by the SPCA.

Riera can apply for both home confinement and involvement in the intermediate punishment program.

Riera remains free on $25,000 unsecured bail pending sentencing.
