A Texas man allegedly killed his girlfriend’s daughter by stuffing her in a backpack while he went to work and ran errands, authorities said.

Trevor Rowe, 27, of Lubbock was arrested Wednesday in connection with the murder of 10-month-old Marion Jester-Montoya, the Abilene Reporter News reported.

Rowe brought the baby Tuesday morning to his job site and “crammed” her in a backpack, which he left on the floor of the car, according to an arrest warrant.

He discovered at one point during the workday that Marion escaped, and put her back in the bag, the warrant said.

Then, around lunchtime, Rowe checked on her and found that she was “lightly crying but breathing,” authorities said.

Rowe then went to a fast-food drive-through, two stores and returned to work, where he placed the backpack with the baby inside in the trunk of his car, according to the warrant.

Upon returning around 5 p.m. to the vehicle, Rowe checked on Marion in the trunk and discovered that she was not breathing, authorities said.

Marion appeared loved and had a large extended family on her father's side.

Mom needs to explain why her live-in penis came to pick up the child and bring her to his job.

@Keepalowprofile he kept her in the backpack so he would not get in trouble for leaving a child unattended in a car- he put her in the trunk because he was angry with her.

I know he will take a plea but this man deserves the death penalty.

Lawd have mercy! Mom’s Facebook is a damn mess. It’s soo sad. This little girl had very little chance of growing up without some sort of trauma. There’s a photo with a kid in a dog pen (safer than a backpack, I suppose). Then a picture of the family at a funereal posing with the family member in the coffin. Is that a thing people are doing now? WTF?! I need a drink.
 
Sheilah Montoya, Marion’s grandmother said when the suspect came out to get Marion “she immediately started screaming and grabbing (Sheilah).”

CPS has confirmed they were involved with the family before the incident on Tuesday.

Katrina Montoya, Marion’s aunt, said if Emilio Montoya had custody of Marion, she would still be here today.

“She wouldn’t be gone,” Katrina said.

According to court documents, Rowe was arrested in 2018 after being accused of leaving two children unattended in a home. The police report says the two children were his. The police report says CPS was called, but were not able to locate anyone to respond to the house. He told police the children were sleeping and he left to get them something to eat. He left on a bicycle and told police he was gone for about 30 minutes. Court records show the case was closed “in the interest of justice.” Rowe was never officially charged with the crime.

A man accused of murdering a young girl by stuffing her into a backpack petitioned Monday to be let out of jail due to the coronavirus outbreak.

Trevor Rowe, 27, was arrested January 8 and charged with the capital murder of 11-month-old Marion Jester-Montoya. His bond was set at $2 million.

According to the petition, Rowe believes he has been, “unlawfully restrained of his liberty by the Sheriff of Lubbock County, Texas.”

Rowe was charged but not indicted on the murder charge, according to the petition, and has been held without an indictment for more than 90 days. The petition argues this is against a section of the Texas Code of Criminal Procedure.

According to the code, if an indictment is not filed, the person arrested must be allowed to be released on personal bond.

On March 29, Governor Greg Abbott signed an executive order that suspended five sections of the Texas Code of Criminal Procedure, including the one Rowe cited as a reason to be released on personal bond.

Rowe’s petition also talked about COVID-19 as a reason to release him.

According to the petition, “The government’s interest in continued incarceration cannot be justified where incarceration itself exacerbates an ongoing and devastating public health crisis and brings a heightened risk of illness and death to people inside and outside the jail.”

According to the petition, “There is nothing that can justify exposing a presumed innocent person to a deadly virus.”

On Thursday, a Lubbock family held a memorial following the death of their baby girl, Marion Montoya, one year later.

“Just trying to understand why what happened, happened,” Sheilah Montoya, Marion’s grandmother said.

Marion’s family and members of the community gathered at 130th and Upland Avenue for the service, the same place police said she was found unresponsive on January 8, 2020.

The memorial featured singing Marion’s favorite songs, a shelf with her toys, pictures, and a balloon release.

“I think she should have had a long and beautiful life with us,” Emilio Montoya, Marion’s father said.

“Today, everything still hurts,” Emilio said.

Marion’s family said they are demanding justice.

“In this case, justice to me is life in prison for Trevor. Not the death penalty, but life in prison,” Sheilah said.

Sheilah added they plan to support other families who have also lost children as a result of abuse.

“If you have something that you think is a sign of abuse or neglect, report it,” Sheilah said.

After a year, her family said it has not gotten any easier, and they think of her every day. Sheilah said they will continue to keep her story alive, and hopes the community will join their fight.

In January 2020, Trevor Marquis Rowe, 29, was arrested by Lubbock County authorities and charged with capital murder of a victim under 10 years of age for the tragic death of Marion Jester-Montoya.
As Law&Crime previously reported, the defendant took the child to his job site. There, he stuffed the girl in a backpack and left her on the floorboard of his vehicle for hours while he was working. Investigators wrote in a criminal complaint Marion got out of the backpack at one point, and he put her back inside.
Rowe checked on the child again during lunch. He determined that she was lightly crying at the time – but still breathing. According to the arrest warrant, Rowe went to a fast-food restaurant and two stores during his lunch break. After returning to the job site, he put the backpack in the trunk of his car.

At around 5 that night, the defendant determined the girl had stopped breathing. He called 911 and performed CPR.
But by then, it was far too late.

That pathetic excuse for a mother doesn’t deserve another child to raise. She should have been charged also as there’s no way she didn’t know what a pathetic piece of shit he was to begin with. Where the fuck did she she think her child was all day while this asshat was at work.
