WEST JORDAN, Utah -- A 6-year-old girl found dead in a canal near her home was sexually assaulted, police said Wednesday as detectives hunted a suspect.

Authorities in the Salt Lake City suburb of West Jordan said the girl was reported missing by her mother early Tuesday morning. On Wednesday, police ruled Sierra Newbold's death a homicide and said an autopsy determined she had been sexually assaulted.

"At this time no suspects have been identified and we do not have any persons of interest," Police Chief Doug Diamond said.

"There is obviously a predator out there that is a monster, that has murdered a child," Diamond told NBC station KSL. "Is this predator targeting other children? I have no idea at this point. Our highest priority now is to identify, arrest, and successfully prosecute the person or persons responsible for this crime."

'No need to panic'
The chief said he has increased police patrols in the area and is asking parents to take precautions to protect their children.

"If during the course of this investigation an imminent threat becomes known, we will share that information with our residents immediately," he said. "I believe there's no need to panic at this time."

Diamond said the girl's parents have been cooperating in the investigation.

Speaking to KSL, Diamond declined to provide details about the victim's condition, but added: "There was not a significant amount of trauma on the body."

Reed Newbold, the girl's grandfather, said her mother found her missing from her bedroom early Tuesday.

"We don't have any idea" how the girl disappeared or whether she was taken from the bedroom, Reed Newbold told The Associated Press. "It's a complete mystery."

The parents "are devastated by this," he said. No working telephone number could be found for the parents, and authorities had cordoned off the neighborhood with police tape and patrol cars, where pink and purple ribbons hung on trees and mailboxes.

Officers found Sierra's body in the canal about a block from her home, just 30 minutes after her mother "discovered she was not there and called us," police Sgt. Drew Sanders said.

Sanders declined to comment on any possible motive in the case. Investigators also are withholding a precise chain of events leading to the girl's disappearance.

"We haven't come to any conclusion," Sanders said. He said police have "tons of leads" and "it's paramount we find out who did this."

Police have said there were no signs of a break-in at the family's home, and they declined to release any more details about the case.

The case appears to have similarities to an unsolved Salt Lake City homicide that occurred in August 1995. Two days after going missing, the body of 6-year-old Rosie Tapia was found in a canal near her family’s Glendale-area apartment. Police ruled her death to be a murder, but leads eventually ran cold. Rosie would have turned 23 this August.

That’s the story, so far. Cute little girl allegedly abducted from her bed, apparently murdered, dumped in a canal. It’s already national news. The parents are not, at this time, considered suspects. West Jordan is on high predator alert. It’s a tragedy. So far, it appears to be that rarest of crimes – a stranger abduction.* Not unheard of in Utah (see Elizabeth Smart), but uncommon anywhere.
I dunno, though. Maybe I’m cynical, jaded by years of stories that start out this way and end with a parent or weird relative or family friend on trial. Maybe it’s the lack of detail often seen in a new case, the lack of evidence of a break-in at Sierra’s home. Or maybe it’s exactly what it looks like.…

Suspect in custody for killing Utah girl Sierra Newbold



A 41-year-old West Jordan man was charged Tuesday with the June 26 rape and murder of 6-year-old Sierra Newbold, who was found dead in a West Jordan canal.

Terry Lee Black was charged in 3rd District Court with aggravated murder, child kidnapping and rape of a child.

DNA evidence, as well as blackened debris from a field in the area that had burned the week before, ties Black to the slaying, according to Salt Lake County District Attorney Sim Gill, who announced the charges at an afternoon press conference.

Black is being held at the Salt Lake County jail in lieu of $2 million bail.

Black — who lives near the canal and reportedly attends the same LDS church as the victim’s family — became a suspect after being arrested June 29 for an unrelated auto theft and a Wells Fargo bank robbery.

Gill said the girl was abducted from her home, then beaten, raped, strangled and thrown into the canal, where she drowned, according to an autopsy.

Assistant Utah Medical Examiner Julie Adams, who performed the autopsy, found contusions on the side of Sierra’s face, under each eye and on several areas on her back, according to the charges. Also, Adams and Dr. Karen Hansen, with Primary Children’s Medical Center, saw evidence of sexual assault.

Police found Sierra’s body at 8:22 a.m. on June 26 in a canal about a block from her home.

The discovery occurred about an hour and 10 minutes after her mother reported the girl missing from the family’s home near 2400 W. 7100 South.

The girl’s mother called police after finding a sliding door open and Sierra missing from her bed at about 7:10 a.m. She told police she had last seen her daughter at about 10:30 p.m. the night before.

Police later viewed home security camera footage which showed a "form" entering the home at 3:05 a.m, and exiting "carrying something" at 3:13 a.m., according to charges.

Police later found clothing items belonging to the girl — pink pajama bottoms and her underwear — in a field near the canal that had been blackened by the recent fire.

An officer found the girl’s partially clad body in the canal, which borders the field, and her clothing was darkened with debris consistent with the burned material from the field.

After Black’s arrest, a swab from Black’s genitals was obtained and compared to DNA from Sierra’s body. Examiners at the Utah State Crime Laboratory subsequently found Sierra’s DNA profile on the swab taken from Black, according to charges.

The three charges filed against Black on Monday are all first-degree felonies. Prosecutors could opt to pursue the death penalty in connection with the murder count.

The robbery that led to Black’s arrest occurred June 29 when, according to police, Black entered the Wells Fargo Bank, 7869 S. Redwood Road in Salt Lake County, and told the teller that he needed $100.

According to a probable cause affidavit, when the teller asked Black for identification, he told the woman, "This is a robbery."

The teller took a $100 bill from her drawer and gave it Black. She then asked if he wanted $400, and he told the teller he wanted $4,000, according to court documents.

When the teller told Black that she would have to go to the vault for that, Black left the bank.

After Black left the bank, a service manager at the bank was able to snap a photo with her cell phone as he was trying to get into a Jeep.

Earlier that morning, an employee at the Deseret Industries, located at 7166 S. Redwood Road, reported that her Jeep had been stolen from the parking lot.

Her boss later went to the Wells Fargo Bank to deposit a check, and spotted the stolen Jeep in the bank’s parking lot. When she saw Black attempt to get into the vehicle, the woman confronted him and told him to get away from the car, according to court records. She also took a photo of Black with his cell phone.

Black fled the area on foot, but was arrested nearby. He was charged on June 30 with robbery and receiving or transferring of a stolen vehicle, both second degree felonies.

Black’s criminal history includes a 2008 guilty plea to burglary of a vehicle, a class A misdemeanor. An additional charge of burglary of a vehicle, two counts of criminal mischief and one count of intoxication where dismissed as part of a plea deal.

Man Charged With Raping, Murdering Sierra Newbold Made First Court Appearance

SALT LAKE CITY, UT – *Terry Lee Black, the 41-year-old man accused of*kidnapping, raping and murdering 6-year-old Sierra Newbold, made his first court appearance today.
For those of you who missed the story, Sierra*was reported missing by her mother on the morning of June 26*after she woke up to find that her daughter was not in the house. Thirty minutes later, the little girl was found dead, floating face down in a nearby canal.
Autopsy reports would show that Sierra died from drowning, but that she had also been raped, strangled and beaten.
A video camera mounted on Newbold’s home captured a man entering through a sliding glass door at around 3:00 a.m. and leave moments later carrying something. Police would also find*Sierra’s pink pajama bottoms and underwear in a burnt out field a short distance from Sierra’s home.
Three days later, Black was arrested shortly after robbing a Wells Fargo bank in West Jordan. He got caught after leaving the bank and returning to a Jeep he had stolen earlier. A friend*of the car’s owner just*happened to be in the parking lot, saw their friend’s vehicle,*and confronted Black. He fled on foot but was quickly captured by police.…

Pics emerge of Sierra Newbold’s accused killer

FOX 13 has obtained pictures of the man accused of killing 6-year-old Sierra Newbold, minutes before he was arrested.
A woman, who asked not to be identified, took them as she confronted Terry Lee Black outside a Wells Fargo Bank here. She spotted her friend’s car that had been stolen in the parking lot and confronted him while taking the pictures.
West Jordan police said Black walked out of the bank after holding it up and making off with $100. When officers arrived, detectives who were also working the murder of Sierra Newbold became suspicious of him. Police said he had charcoal on his hands that matched what was found in a charred out field where Sierra’s underwear and pajama bottoms were found. Police also claim to have found DNA from the girl on his body.
Black, 41, is charged with aggravated murder, child kidnapping and rape of a child. He refused to come to court on Thursday for his first appearance on a robbery charge related to the bank holdup, prosecutors said. A judge has ordered him to be present on Friday.

There was no sign of a break-in, did they not have their doors locked? .... security camera caught him but they had no alarms? so fucking sad this monster was able to come into their home in the dead of the night, take their baby and kill her.

I believe he entered through the sliding glass door. Anyone I know with one of those doors puts a stick in the bottom runner to prevent the door from being opened.
 
New abuse charges filed
Prosecutors on Friday filed new charges against the man accused of kidnapping and murdering 6-year-old Sierra Newbold, saying he abused another girl a few years ago.

Terry Lee Black, 41, was charged with two more counts of sexual abuse of a child and two more counts of aggravated sexual abuse of a child. Documents filed with the new charges state the abuse happened sometime between 2007 and 2009.

A girl who would have been 11 or 12 years old at the time attended a sleep over with members of Black’s family. Black, according to court documents, entered the bedroom where the girl was sleeping and touched her breasts, put his hands down her underwear and forced her hands to touch his genitals.

The next summer, court documents claim, Black lured the same girl to his apartment and again put his hands down her pants.

A Utah man accused of kidnapping, raping and killing a 6-year-old West Jordan girl four years ago still is not competent to stand trial on charges, a judge ruled Thursday.

Terry Lee Black, 45, is charged with aggravated murder, child kidnapping and rape of a child, accused of snatching Sierra Newbold from her West Jordan home and killing her on June 26, 2012.

The defendant is not competent to stand trial on the charges, 3rd District Judge L. Douglas Hogan decided Thursday — the latest delay in the 4-year-old case.

Black, handcuffed and shackled, smirked throughout the hearing, but he did not speak or address the judge. A hearing to review his competency is set for June 29, 2017.

But before that, Black is scheduled to be in court on Oct. 4 for a review hearing. Attorneys told the judge Thursday that they anticipate State Hospital officials will ask the judge to order that Black be medicated.

This is the second time in the past year that Black has been found not competent for trial. The judge also ruled in December that the man could not understand the charges against him and could not meaningfully participate in his own defense.

Black has sent letters to The Salt Lake Tribune from jail in which he has maintained his innocence. Police were looking for someone to pin Sierra's murder on, he said, and he was an easy target who got caught up in the investigation.

The case went before the Utah Supreme Court on an interlocutory appeal in December 2013 after Black's attorneys said 3rd District Judge Mark Kouris was biased against him. The case went back to district court in September 2015, and the high court did not rule on Kouris' statements because he had moved to a different court by then.

The accusations of bias followed a July 18, 2013, hearing, during which defense attorneys asked that Black's preliminary hearing be delayed because of possible competency issues.

At that hearing, Kouris questioned why the defense attorneys waited until a week before the five-day preliminary hearing would occur to begin to ask for a competency review; the lawyers at that time had been dealing with the case for about a year.

"I have to tell you, the timing to me is very, very suspicious," the judge said. "You claim it's in good faith; I have no reason to doubt you, except that the timing is a little problematic for me."

In a subsequent court filing, Black's attorneys said Kouris' words during the hearing were "hostile, demeaning and humiliating, and disparaged the integrity and ethics of counsel for the defendant."

A West Jordan man housed in the Utah State Hospital for years admitted Thursday there is enough evidence to convict him of kidnapping a 6-year-old girl from the bedroom of her West Jordan home in 2012, then raping and murdering her.

Terry Lee Black, 47, entered Alford pleas to aggravated murder, child kidnapping and rape of a child, meaning he believes a jury would likely find him guilty of the crimes but he denies them.

Third District Judge Douglas Hogan sentenced him to at least 65 years and up to life in prison Thursday, moments after determining that Black was finally mentally competent to stand trial.

Black has schizophrenia and another unspecified psychotic disorder, but "has a rational and factual understanding of the proceedings against him," Hogan wrote in the order. Black can consult with his attorneys and understand the charges against him, Hogan determined.

Black was repeatedly found incompetent after multiple evaluations, meaning he legally could not understand the charges against him or communicate with his attorneys as they defended him in court in Sierra Newbold's death. The judge in 2015 ordered he be committed to the Utah State Hospital.

Last summer, his attorneys told the judge that an evaluator believed Black was "making reasonable progress toward restoration" after treatment at the hospital.

Police say Black sneaked through a sliding glass door into the Newbolds' West Jordan home at 3:05 a.m. on June 26, 2012, and was seen on a security camera carrying Sierra out of the home at 3:13 a.m. From there, the young child was raped, strangled and drowned in a nearby canal.

Black was arrested three days later after police say he robbed a West Jordan bank using a stolen car. Investigators said Black attended the same ward as the Newbolds in The Church of Jesus Christ of Latter-day Saints and his apartment was near the canal where she was found.

Black was charged with aggravated murder, a capital offense, as well as child kidnapping and rape of a child, all first-degree felonies. As part of an agreement with prosecutors and in exchange for the guilty pleas, charges of child sexual abuse and theft were dropped, court documents show.

Prosecutors say evidence of the grisly crimes was strong, but they entered into the agreement allowing Black to deny them in order to prevent any further delays or any appeals of his convictions.

"Competency is always a fluid issue. We could be in the middle of a trial and competency could destabilize," said Salt Lake County prosecutor Matthew Janzen. "While he was presently competent, we made an effort to bring closure to this case for the family and resolve it."

The judge ordered Black on Thursday to serve two sentences of at least 25 years and up to life on the aggravated murder and rape of a child charges, and at least 15 years to life on the child kidnapping count. Hogan ordered the sentences to run consecutively and granted Black credit for the time he has served since 2012.
