Attorneys said they think they will reach a plea deal for a Gary mother charged from a fire that left two of her children dead.

Kristen Gober, 34, was charged last year with two counts of neglect of a dependent resulting in death, neglect of a dependent and possession of marijuana.

The charges came after two of Gober’s children, Khristopher Gober, 4, and Kailani Gober, 2, died March 25, 2018, in a fire in Gary. Gober’s then-6-year-old son made it out of the fire, attorneys said.

Gober appeared Monday morning in Lake Superior Court for a hearing with her public defender, Thomas S. Mullins.

“Judge, I think we will have a resolution,” Mullins told Judge Diane Boswell.

Mullins and deputy prosecuting attorney Michelle Jatkiewicz asked for a hearing in two weeks to see if they have a plea deal for Gober. Boswell set a hearing for April 22.

Gober became emotional after her hearing Monday, as she has at past hearings.

Gober said she had “left the children alone” sleeping in her apartment March 24 into March 25 while she did laundry and went to the maintenance employee's apartment for a couple of hours, which she said she had done "on multiple occasions," according to a probable cause affidavit.

While the mother was out of the apartment, her children "were playing with the stove" and put a blanket inside that "caught fire," according to the 6-year-old in the probable cause affidavit.

Gary Fire Department Chief of Operations Mark Jones previously said the fire, which began on the fourth floor and displaced 113 residents, appeared accidental with no foul play suspected.

An 8-year-old child jumped to safety from the fourth floor onto a blanket held by neighbors, officials said.

Khristopher and Kailani Gober suffered from smoke inhalation and burns, Jones said.

Gober said "she was in a state of shock" and "could not bear to watch the fire so she started walking away when someone picked her up" and took her to McDonald's, according to court documents.

"Ms. Gober said that everyone knew that the children were inside and said it was a lost cause to tell the firemen about the children at that point," the affidavit states.

A Gary woman whose two young children died in a 2018 fire is expected to be sentenced Monday.

Kristen Gober, 34, is expected to plead guilty to multiple counts of neglect before her sentencing.

Investigators said Gober left her three children alone for hours in March 2018 to be with her boyfriend. While she was away the kids allegedly started a fire on the apartment stove.

According to court documents, Gober's oldest son, 6-year-old Justen, said the fire started after he and his 4-year-old half-brother, Kristopher, put a blanket on the stove. Justen told police all three kids hid under a blanket before he ran away leaving Kristopher and 2-year-old Kailani alone in the apartment.

The court document also revealed that Gober told police she went back to apartment to try to save her children. She said she heard the kids, but the flames kept her back so she left.

Gober was found at a McDonald's down the street. She said she never asked for firefighter's help. Instead she told police that she thought it was a lost cause. Gober claims she was doing laundry.

A mother was given more time Monday to consider accepting a plea agreement in a neglect case filed after her youngest sons died in an apartment fire.

Lake Criminal Court Judge Diane Boswell told Gober she will face a choice in July: accept the plea deal or ask that her case be set for trial.

Jatkiewicz declined to outline the terms of the plea agreement during Monday's hearing. She said she would put those details on the record at the next hearing if Gober rejects the proposed agreement.

A Gary mother could face up to 60 years in prison after pleading guilty in connection with the deaths of her two young children, who died in a fire after she left them alone all night.

Kristen A. Gober, 35, admitted in a plea agreement she left her three children, ages 2, 4 and 6, alone in their fourth-floor apartment at the Lakeshore Dunes complex in Gary's Miller section in March 2018 while she drank alcohol and spent the night with a maintenance man.

Her two boys were playing with a stove and caught a blanket on fire the morning of March 25, 2018, records state.

Kailani Gober, 2, and her brother Khristopher Gober, 4, died from smoke inhalation.

Their then-6-year-old brother was able to escape the apartment without a shirt or his glasses, records state.
Firefighters battled the fire for more than four hours, but the building sustained heavy fire, smoke and water damage, causing dozens of residents to seek refuge at area shelters.

Neighbors rescued a fourth child — an 8-year-old boy — who leaped from the building into blankets they were holding.

Gober told police she attempted to get her children out of her apartment, but there was too much smoke. She said she was in a state of shock and could not watch the fire, so she began walking down the road.

Gober had been considering the state's plea offer for at least nine months.

She pleaded to two counts of neglect of a dependent resulting in death, a level 1 felony, and one count of neglect of a dependent, a level 6 felony. In exchange for her plea, prosecutors agreed to dismiss a misdemeanor charge of possession of marijuana.

If Lake Criminal Court Judge Diane Boswell accepts Gober's plea agreement, her sentence on each of the level 1 felonies will be capped at 30 years. Attorneys agreed to a cap of one year in jail on the level 6 felony neglect charge.

Attorneys will be free to argue at sentencing whether Gober should serve the sentences concurrently. If she's ordered to serve them consecutively, she could face 60 years in prison.

Gober, who has been in custody since her arrest shortly after the fire in March 2018, will receive credit for time served and good time at sentencing. She has been unable to post a bond of $125,000 surety or $12,500 while her case has been pending.

I went to the link about the 8 year old neighbor who jumped out the window. They quoted his story and he sounds like such a wonderful boy! He was so well spoken and full of love for his mom and his neighbors who helped save him. I really hope he is doing well today and has a really good life.

51 years to sit and think of how fucking stupid and ungrateful she was to have those boys seems fair. What could their futures have been? It's such a terrible loss. So she could go drink.

She could've drank at home. Not ideal but better than leaving a 6 yr old in charge. I wonder what happened to the surviving child. He's lost his siblings and his mom and his home. And he's so little to suffer so much.

I really hope that in her heart she suffers true and deep guilt for the stupid fucking choice she made
