A Missouri man was charged with murder Tuesday for allegedly killing his wife after a nonprofit group posted his bail in a domestic violence case, prosecutors said.

Samuel Lee Scott, 54, was charged Tuesday with first-degree murder in the death of his wife, 54-year-old Marcia Johnson, several hours after he was released from jail on a domestic abuse case involving the woman.

Scott had been in jail for a misdemeanor domestic assault charge after he allegedly hit Johnson in the face and threatened to “finish what (he) started” in January. The St. Louis Bail Project posted his $5,000 bail on April 9, court documents obtained by The Associated Press stated.

Later that same night, Scott was said to have gone to Johnson’s home at around 7:45 p.m.

Several hours later, Johnson was rushed to a nearby hospital after a friend found her head and body bloodied. According to a probable cause statement, she was “unconscious, had a broken eye socket, several broken ribs, and was bruised from head to toe.”

Johnson died Sunday, five days after Scott's release.

Scott admitted he struck Johnson, police said.

The Bail Project has operated in St. Louis since January 2018. Executive Director Robin Steinberg said the organization was "deeply saddened," but bail wasn't to blame for Johnson's death.

"No one could have predicted this tragedy," Steinberg said in a statement. "It's important to remember that had he been wealthy enough to afford his bail, or bonded out by a commercial bail bond agency, he would have been free pretrial as well. In times like this, we must come together for this family and keep sight of the need to transform the larger systems that create poverty, racism and violence, including the pretrial bail system."
 
This isnt the first, wont be the last. These groups are the same people who believe people are locked up for no reason, and there are disparities in the jail/prison population. I am sure there are some that are innocent, or nearly but the overwhelming majority are guilty, and id bet there are guilty of more than they are charged for. I wish these Bail Project idiots would stop getting any support, or start using their brains on who to let out.
 
I wouldn't put the blame for this on The Bail Project. His bail was set at $5,000. It was up to the court to set bail and its conditions. For dangerous offenders, bail should be set much higher or denied entirely. A guy who shouldn't be let out also shouldn't be held on a few grand bail in the first place.

I'll blame both. These bail organizations need to be more discerning than just price. Maybe they should look at the types of charges. They only went by price, not crime.

This is how I see it: they shouldn't be bailing out violent criminals, period. If they are concerned with social-justice disparities caused by people with money actually being able to make bond, then they should equalize things by advocating for impossibly high bonds for all violent offenders, *not* by bailing out destitute violent offenders.

That said, they can bail out all the destitute non-violent offenders they want. In fact, I'd support that model financially.

Also I pulled up this guy's record on CaseNet. The domestic battery was 4th degree assault, and was charged as a first or second offense. In 1999, he was charged and convicted of marijuana possession. In 1998, he was convicted of 3rd degree assault, for which he served 90 days. In 1996, convicted of marijuana possession.

Given what I've found, there really was no reason to believe he was a threat to his wife's life. There's no pattern of violent crime on his record. His last violent crime was over twenty years ago.

Also here's the Missouri statute/criteria for 4th degree assault

Class C misdemeanor for intimidation and "provocative/offensive contact". Class A if the offense "causes pain". If he had inflicted serious injury on his wife, he would be getting charged with 2nd or 1st degree domestic assault. So even the domestic violence charge itself wouldn't be seen as an indication of danger for the wife.

Race is not a deciding factor for assistance. I believe our firm has had one client bailed out by them, and I'm fairly sure he was white. It's not about bailing out black people; it's about bailing out poor people.

Only the judge can set bail. If the judge believed he was violent its the judge's duty to order him to be held, obviously the judge believed it was safe to let him out. Bail is not set to keep someone in jail, its to hopefully ensure they will return for future proceedings, why doesn't anyone understand that?

Also, even if bail is suppose to be some sort of pre-trial punishment, $5000 is jackshit, it appears the judge didn't give a fuck whether he was out or not, if this was the case.

Why in the fuck is this organization bailing out VIOLENT offenders? I think it's absurd to blame the charity pussies for the crime, but whether or not this man killed his wife is irrelevant when it comes to how offputting and fucking wrong it is that they are going to bat for people arrested for violent offenses. They wanna help, as this other feller said, use some resources to lobby for increased bail for all and dedicate their funds to bailing out the more petty scumbags.

One of the biggest flawed in the judicial system is the fucking bail. "The Bail Project" is actually trying to unfuck the disparity between wealthy and non-wealthy people when it comes to pre-trial confinement.

Basically, why should the amount of money an accused has be a deciding factor whether the accused stays in jail or not before trial?

4th degree assault can be as simple as a slap or even raising your hand to someone without striking them. The average Three Stooges short is more severe than that.
I did way worse than that in highschool, and all I got was a week's suspension and no criminal record.

Ok, I admit my sheer ignorance of the intention of TBP. I understand fully now. I told you I was guilty of that ol' devil knee-jerk reaction when I read this article. DD articles tend to do that to me. Thank goodness we have folks like you to take away the red cape from the matador.

Thanks to the St Louis bail project, he got to follow through on his threat.

That's not to say the St Louis project is 'bad'. It's to say that their judgment on this particular case was flawed, to say the least. Without their intervention this woman would still be alive. Maybe they need to write into their charter than any form of violent charge disqualifies a person from receiving their assistance. Domestic abuse also. And sexual crimes. Crimes against children too.

In fact, fuck it, they should just come out and say - "We'll only bail out if you are in for possession of weed...."
