Court documents reveal that Erik Sherman, 33. and the mother of the 20-day old infant noticed injuries to their baby but waited days to take him to see a doctor.

According to court documents, the baby’s mother also took four videos of the baby on Aug. 7 before going to the hospital. In the videos, the baby’s eyes are completely dilated, and bruises can be seen on his head and face. He did not appear to be conscious in the video. At one point, the baby appeared to be trying to cry but couldn’t.

On August 7, a baby arrived at the Holy Family Hospital ER not breathing and unresponsive. He had a temperature of 92 degrees and was covered in bruises. The baby’s mother and Sherman brought him to the hospital.

Doctors at Holy Family were able to get the infant to breathe again but they decided he needed to be airlifted from Holy Family to Sacred Heart Children’s Hospital due to his life-threatening injuries, according to court documents.

A doctor at Sacred Heart later said the baby had bruising to his face, butt, back, stomach and genitals, along with a massive internal brain injury, according to court documents. After a CT scan was completed, doctors determined that the child had no brain activity. Due to the extent of his injuries, doctors believed there was no chance the child would survive, according to court documents.

Sherman said his son’s head suddenly and unexpectedly rocked forward and hit his shoulder, according to court documents. He then said the force of this caused the child to begin bleeding from his mouth.

Both Sherman and the baby’s mother admitted the baby had not been able to drink from a bottle or breastfeed since the incident. They claimed they would drip milk into the baby’s mouth by holding a bottle over him, according to court documents.

Both parents claimed they thought he was getting enough nourishment, though he was not eating as much as he had been prior to the incident, according to court documents.

Right ... because if my baby was acting not babyish and looked like he was dying i would take a bunch of videos too, because that always helps. Stupid people ... stupid people everywhere.

They said the internet told them the injury was relatively minor and that it would heal quickly, which is why they did not take their son to the doctor.

Because of the seriousness of the injuries, the baby was taken by Life Flight helicopter to Sacred Heart Medical Center.A doctor at Sacred Heart evaluated the infant upon arrival to the hospital and noted "obvious bruising" on his face, right shoulder, between his shoulder blades and elsewhere. The documents say the doctor was concerned that the infant had a "severe life-threatening brain injury." X-rays taken at Sacred Heart confirmed the broken clavicle as well as a broken femur and tibia. The doctor determined there was no possible accidental or natural causes for the injuries the child had received.​

She told investigators that in July she was in her room, which is directly below the baby's room. I was unaware that a 20 day old infant was capable of "Having an attitude"
The folks in jail are not going to like these baby beating monsters attitudes.

JEEZ! Just throw the baby to the coyotes and be fast and be honest about it. At least i could acknowledge a straight forward rejection of your spawn and a relatively quick death.
But just flinging the baby against things and pulling punching and twisting it's tiny limbs in frustration? And probably joy. For weeks!? FU & Die.
Or ya know, another option, use one of those baby deposit boxes!

More than a year after police said a Spokane man killed his infant son, we've learned that he's pleaded guilty to the crime.

34-year-old Erik Sherman is now convicted of homicide by abuse.

The doctor who treated his infant son said in the 23 years of practicing medicine, this was the worst case of child abuse they've ever scene.

According to court documents, doctors said when the infant arrived at Sacred Heart Medical Center, he was unresponsive.

They also noted obvious bruising all over his body. X-rays confirmed he had a right clavicle fracture, a fractured femur and right tibia.

Court documents said three separate neurological exams confirmed a serious brain injury with no brain activity.

Investigators said Sherman denied knowing how the child received any of the bruises, a brain injury or broken clavicle.

A few days later, police arrested the father for the death of his child.

Then, just last month, Sherman made a plea agreement and admitted to killing his son by abusing him.

Erik Sherman has been sentenced to 26 years in prison for the drug-fueled beating death of his 20-day-old son, Emmett.

A doctor told police it was one of the worst cases of child abuse he had seen.

Sherman pleaded guilty to homicide by abuse as part of a plea agreement that allowed him to avoid a life sentence.

The baby’s mother, Yazmin Russell, says she knew about the plea agreement but didn’t know he could have received life in prison. She says it’s not fair that he only gets 26 years for killing their son.

Sherman apologizes and says he will take time to become a better man.

She should be going to prison with him.
Even after Sherman admitted to the killing, several members of his family offered support at the sentencing.

In a letter read in court, his own 16-year-old daughter said that she wants her father to wrap his arms around her and tell her “everything is going to be OK.”

“In the public eye, he is a horrible person,” the girl said in the letter. “In my eye, he is human. He is my dad. He will always be my protector.”

When he was clean and sober, several family members described Sherman as a caring and loving father. Sherman’s attorney, Blumhorst, said that Sherman’s family described him as a loving father, brother and son. But he had recently started using methamphetamine, which made him capable “of a heinous act.”

“Mr. Sherman has accepted responsibility for his actions,” Blumhorst said. “He did not want to put anyone through the trauma of going through a trial. Mr. Sherman lost his only son. He will be haunted by that forever.”

Sherman said the sentencing “was one of the hardest things I’ve ever had to do. I want the court to know that I accept this lengthy sentence. I am going to take the time to become a better man.
“I’m sorry for this tragedy and everything I’ve caused.”

It's also not fair that mom gets to pretend she doesn't share responsibility for her baby's death.

During the hearing, Russell said her whole life was flipped upside down after she discovered her son’s injuries Aug. 5, 2018. She did not call a doctor until two days later, when the bruised Emmett stopped breathing. She said that Sherman had hid the extent of the baby’s injuries from her.
How did he do that exactly?

[Judge] Stine said he wanted to sentence Sherman to life in prison, but if he had, Sherman could have appealed the sentence. As a result, a jury would have been subjected to autopsy photos showing the battered baby who died from bleeding on the brain.
