The Florida man who invoked the "stand your ground" self-defense law after shooting a black man in a dispute over a parking space was charged Monday with manslaughter, officials said.

Michael Drejka, 48, was arrested Monday morning in the fatal shooting in July of Markeis McGlockton in Clearwater, Florida -- an incident that was caught on video which sparked an uproar after its release.

"The announcement that Michael Drejka will be charged with manslaughter provides our family with a small measure of comfort in our time of profound mourning," McGlockton's family said in a statement. "While this decision cannot bring back our partner, our son, our father, we take solace in knowing our voices are being heard as we work for justice.

"This man killed Markeis in cold blood, without a second thought about the devastating impact his actions would have on our family, but this charge gives us a measure of hope that the truth will win and justice will prevail in the end.”

Drejka was booked at the Pinellas County Jail and bond was set at $100,000. He is scheduled to make his first court appearance on Tuesday, at which time a judge will review his bond status and decide whether to appoint an attorney for Drejka or if the defendant can afford to hire his own lawyer.

Bernie McCabe, the state attorney for Pinellas County, announced his decision to file charges against Drejka 12 days after receiving investigative reports on the case from the Pinellas County Sheriff's Office.

"We have filed a formal charge, and he has been arrested, and he will now go through the court system," McCabe said in a statement.

Pinellas County Sheriff Bob Gualtieri had initially declined to arrest Drejka after the gunman invoked the "stand your ground" defense, saying his decision was bound by the law.

"I support the State Attorney's decision and will have no further comment as the case continues to work its way through the criminal justice system," Gualtieri said in a statement on Monday.

McCabe said charging Drejka is "consistent with the decision-making process established under Florida law in this case."

McGlockton, 28, was shot on July 19 after he came out of a convenience store and saw Drejka berating his girlfriend, Britany Jacobs, about parking in a handicap zone. Surveillance video showed McGlockton shoving Drejka to the ground and Drejka, who had a legal concealed weapons permit, pulling a handgun and shooting McGlockton.

Attorneys for Jacobs, the mother of McGlockton's three young children, and McGlockton's parents have held several press conferences to say they do not believe Drejka should have been given immunity from arrest under "stand your ground."

"My first thought on hearing this news was: It's about time," said Benjamin Crump, an attorney for Jacobs.

Crump said he "firmly" stands behind McCabe's decision to charge Drejka.

"This self-appointed wannabe cop attempted to hide behind 'stand your ground' to defend his indefensible actions, but the truth has finally cut through the noise," Crump said in a statement. "I have full faith that this truth will prevail to punish this cold-blooded killer who angrily created the altercation that led to Markeis’ needless death. We will continue to fight until justice is brought for the family of Markeis McGlockton.”
 
I have mixed feelings.

I absolutely hate it when someone parks in a handicap space without a plackard.
But, I'm not a cop and it's not up to me to enforce that.
The shooter knew he had protection with his gun tucked up in where ever he had it so he felt brave in running his mouth to the person in the parking space.

Then there is the dead guy shoving him down. I guess he should have thought about that.

Ap erson should make damn sure using deadly force is the absolute necessity in order to protect/defend themselves or their family from certain harm. That clearly was not what happened here.

A single push does not warrant the use of deadly force to defend oneself. It's outrageous this is has the slightest degree of controversy to it. Clear cut simple crime, and all on video.

It was 6-8 feet.
As for starting knee or arm shit as you call it, too bad.
The leg and or knee were a straight line target plenty big enough not to miss at that range.
It is a valid point to be made.

I think it's better for Pinellas County that Michael Drejka has to stand trial, because the community needs a better explanation to what went on than having the Sheriff say it's self-defense. And I believe Drejka has a good chance of winning because there's more to the video than what you first see.

Here are the less-obvious details I see:
  • This is a confrontation between THREE people, not two. Drejka was outnumbered. Look at the video again, slow it down to see the details. Britany Jacobs got out of the car and began to confront Drejka right before McGlockton hard-pushed him to the ground. (Do not assume that Britany is not a threat because she's a woman.) McGlockton continued to approach Drejka after he was on the ground and Britany Jacobs did not go back into the car. She stayed part of the fight by remaining right where she was.
  • Drejka is on the ground, not on his feet and able to run away. With Drejka on the ground, he is in a vulnerable position because by regaining balance to stand up, he'll open up a chance for one of the two to strike again, kick or grab his weapon.
And the audio is missing, so we don't have a clear understanding to what was said. If McGlockton verbally threatened to continue the attack, that's another point in favor of Drejka. But we don't know, so Jacobs and Drejka will have to testify in court on that matter.

The situation would be against Drejka if he were alone with McGlockton and was standing at the time of the shooting. But having 2 on 1 and Drejka vulnerable on the ground, he's got a good defense.

If someone pinches me on the arm, it's not acceptable for me to punch them full force in the face and knock them unconscious, possibly break bones in their face or cause other serious injury. Legally that wouldnt hold water as reasonable use of force for self defense either.

Simply cuz he laid hands on the man didnt provide reason for the use of a firearm, not in this case.

And it's irrelevant whether the shove was warranted in the first place. The shove really isnt in question here. No one is being charged over a shove. If one asshole hadnt turned out to be a homicidal stain and hadnt murdered the victim here like a dog for absolutely no good reason, i would be calling for the shover to be charged. I would agree the shove wasnt warranted. Whether or not the shove is wrongful has no bearing whatsoever on how unnecessary and criminal in nature the shooting is.

However, since you are insistent on pressing the subject, i also would say that there is a lot more grey area to the shove. The murderer is hassling the victims wife, he has no way of knowing if things were about to turn violent or not. I personally think it was uncalled for, however it is more understandable that in the heat of the moment the shover might feel a need to protect his wife from this angry male coming at her aggressively. I think it's commendable actually that he does in fact only shove the murderer rather then doing something seriously dangerous like decking him in the face or taking a page out of most folks' heres book and blasting him to death.

This guy is a total asshole who has been just itching to shoot someone. There is incident after incident after incident of him waving guns at people and threatening to shoot them.

This is not just hearsay and people exaggerating events after the fact. These incidents are documented in police and accident reports with people who have encountered Drejka in the past.

This includes a previous incident at the same convenience store, involving the SAME FUCKING HANDICAP PARKING SPOT that the fatal shooting occurred.

The thing I hate about him using a stand your ground defense is that he's going to attempt to ignore the fact that he has been running around actively looking for trouble and any reason to pull his gun and shoot someone.

This is the sort of crime (because yes, I feel this was a crime, although I guess we'll see) that really makes law-abiding concealed carry holders look like shit. You don't go brandishing your firearm at every perceived injustice that occurs throughout your day. You don't wave it around every time some asshole cuts you off in traffic, and you DON'T go starting altercations and escalating with strangers, just because you can feel it's weight at your side and think you're hot shit.

Drejka is a loose cannon, and it was only a matter of time before someone got hurt or killed.



Court documents show that the July incident wasn't the first time Drejka aggressively confronted drivers over parking spots or what he perceived to be traffic infractions. In one incident, he caused a traffic accident by "brake checking" a car behind him, according to reports.

A truck driver parked in a handicapped-accessible spot

About three months ago, Richard Kelly told a Pinellas County Sheriff's Office detective he was confronted by Drejka at Circle A Food Store, the same store where he shot McGlockton. Drejka, documents said, was upset because Kelly parked in a handicapped-accessible spot. The exchange between the two became very loud and Kelly said at some point during the argument Drejka told him he was going to shoot him, documents said.

Drejka then went to his car and was rummaging around the center console, but documents said Kelly drove away. Drejka, Kelly said, also threw racial slurs at him. Kelly is black and Drejka is white.
Court documents said Drejka wanted to voice his complaint to Kelly's employer, AA Cut-Rate Septic Tank Service, so he spoke to the owner, John Tyler. Drejka told the business owner he was lucky he didn't blow his employee's head off, documents said.

A woman drove too slow through a school zone

On December 12, 2012, a woman told a Largo Police Department officer that a man driving a black Toyota truck, later identified as Drejka, pointed a gun at her and the passengers in the vehicle.
The woman pointed out the truck to the officer. The officer spoke with Drejka, documents said, and he told the officer the woman was driving too slow through a school zone.
Drejka denied pointing a gun at the occupants of the car, documents said, but he did have a gun in his vehicle. Drejka told the officer, according to police reports, that he honked at the people in the other car, and the people in that car made rude hand gestures at him.

A teen didn't drive through a yellow light

On January 10, 2012, Tyler Smith, 18, was driving with a friend when a traffic light turned yellow. Smith decided not to drive through the light and stopped his vehicle.
A truck, driven by Drejka, was behind Smith. Drejka honked his horn, documents said, and yelled at Smith. Drejka held a black handgun out the driver's side window of his vehicle and motioned for Smith to walk back to his truck, documents said. Drejka then followed the teen's vehicle, passed it and slammed on his brakes, according to police reports.

The teen did not press charges, documents said.
When officers confronted Drejka about the incident, he said the teen's car cut him off, the police report said. He said he neither followed the teen's car nor did he show his gun, but did admit to having one in his vehicle.

The 'brake-checking' incident

Drejka was driving his truck down US Route 19 Alternate in Pinellas County on November 13, 2013, when a woman turned onto the route, pulling into the center lane so that Drejka could pass, according to a police report. She then pulled out behind Drejka.
Drejka would later tell a state trooper that he felt the woman, who had her 4- and 7-year-old children in the car, almost hit him when she pulled into the center lane, the police report said. He began hitting his brakes "in an aggressive manner," closing the distance between him and the woman, the report said.
As she got closer, he again slammed his brakes aggressively and the woman rear-ended him, the report said. Drejka told police he was trying to turn into a store but missed the turn, the report said.
But he also acknowledged being upset with the woman, according to the report, and said he was "brake checking," a term for when you hit the brakes because another driver is riding your tail.
"Based on my training and experience and the damage to both vehicles, (Drejka) did not attempt to turn prior to the crash," the trooper wrote in the report, which said Drejka was cited for stopping or sudden decrease in speed without signaling.

The Florida man who was charged with manslaughter after killing an unarmed black man over a handicapped parking spot said he has no regrets about what he did.

Michael Drejka, 48, has become the center of the state's newest high-profile 'Stand Your Ground' case after gunning down Markeis McGlockton, 28, in July.

McGlockton was shot to death in front of his girlfriend and children outside the Circle A convenience store in Clearwater.

Drejka, who is currently behind bars, said he has had 'plenty of time to think' about the shooting but still would not do anything different if he could turn back time.

'As far as changing anything, events, I don't see - no, not off the top of my head,' he told WTSP in an interview from prison.

'I followed the law the way I felt the law was supposed to be followed. I cleared every hurdle that the law had to put in front of me.'

Brittany Jacobs, McGlockton's girlfriend, was sitting in the couple's car with their three-year-old and four-month-old child when she was confronted by Drejka.

McGlockton, meanwhile, was inside the convenience store with the couple's five-year-old son, also named Markeis.

Jacobs said Drejka confronted her for being parked in the handicapped-accessible space and told her to move the 'f*****g car'.

Security footage showed McGlockton leaving the store and, seeing the argument, shoving Drejka to the ground.

Drejka said that he's spent his 'whole life' looking 'for a handicapped parking spot' for his late high school sweetheart and, more recently, his mother-in-law.

'I did not confront anyone,' he said. 'I was confronted and I answered.'

Drejka also claims McGlockton 'tackled' him to the ground and that it felt like 'someone hit me from behind with something'.

The footage clearly shows the 28-year-old pushing Drejka in the chest, not the back.

Drejka claims he was 'stunned' by the push and that he was 'very scared'.

'I didn't know what was coming for me and there's only one way to look at that,' he said. 'You have to be scared for it, cause if you'e not, you're wrong. And that's that.'

'So yeah, I was very scared. I've never been confronted like that. I'm not a physical person to begin with, I don't wrestle with people, I don't push and shove my friends.'

'There's none of that that goes on in my life, so I'm a very hands-off person.'

Drejka said he felt 'vindicated' when Pinellas County Sheriff Bob Gualtieri refused to arrest him and said he was protected by the state's Stand Your Ground law.

But after protests from McGlockton's family and civil rights group, the State Attorney reviewed the case and decided to pursue charges against Drejka.

Drejka, who was arrested on August 13 for the July 19 shooting, maintains that he is not a racist and not a violent or confrontational person.

But Drejka has threatened three other drivers in the past few years, even pointing a gun at them, according to Pinellas County Sheriff's Detective George Moffett.

'It's always been a hotbed for me, always touched a nerve with me,' he said. 'The parking spots, the way they're used and abused.'

Drejka said he doesn't 'usually confront people about it' and claims that was the case with McGlockton, despite the fact that footage shows him walking up to Jacobs' car and confronting her over the spot.

Three months before the fatal July incident, Drejka allegedly threatened to shoot Richard Kelly, a black septic truck driver.
He also allegedly hurled the N-word at Kelly when the driver parked in the same handicapped-accessible parking space as McGlockton, CNN reported.

Kelly drove away, but his boss told Moffett that Drejka later called and told him 'he was lucky he didn't blow his employee's head off.'

Drejka told WTSP that the claim was 'false' and he 'wouldn't have used that word'.

You view the law of "Standing your Ground" to be a set of hurdles, opposed to an unfortunate event most don't want to experience? This guy was itching' to pull that trigger.

I couldn't care either way in this one though, while I feel the asshole should have never pulled the gun and had he been so "Scared" he should have fucking ran. On the other hand the guy who put his hands on him should realize that any event in which you have a physical altercation with another there is a possibility a weapon may be introduced, and death is a possibility. I personally don't like the odds, So I simply keep my hands off others.
 
The evidence shows he’s lying. For example, when he says he did not confront the driver, and when he said he was pushed from behind. I think if you have to lie to win your argument, you’re not in a good position.

Also, the victim was backing up when he was shot.

This guy is a fucking idiot of the highest order. We have stand your ground laws in my state, they're not blanket defenses. If you ever want to use that defense you better make damn sure you're covered in showing escalation of force otherwise you're fucked.

Just my opinion - All he needed to do is pull it out and display a willingness to use it, it's not that's difficult. You won't believe how many potential assaults are stopped simply by displaying or drawing your weapon.

But like I said - He's an idiot, first class.

Defense attorneys apparently talked some sense into their client.

Defense attorneys in a shooting case that gained national attention last year say they will no longer be using the "stand your ground" defense.

The defense team for Michael Drejka announced Friday they would no longer proceed with "stand your ground" but will still argue he used self-defense.

"Collectively, the defense team has elected that it would not be in our client’s best interest to proceed with the 'stand your ground' motion," attorney Bryant Camereno said in a statement to WFLA. "We will, however, continue to rely on the self-defense jury instruction."
