Judge Ciaccio issued his ruling in Erica Bell’s bench trial Friday morning.

Bell, 25, was found guilty of second degree murder and first degree manslaughter. During the ruling, Judge Ciaccio said he believed Bell punched three-year-old Brook Stagles, causing her death. He also said that Bell came up with a story to blame Brook’s father, Michael Stageles, for her death.

In court, Judge Ciaccio said he believed recordings in which Bell admitted to hitting Brook. He also said Bell can be held responsible for Brook not receiving care for her injuries. Bell lacked any concern for Brook and only for herself, Judge Ciaccio said.

Bell will be sentenced on Nov. 8.

Michael Stagles pleaded guilty Friday to criminally negligent homicide in the death of his 3-year-old daughter, Brook Stagles.

Stagles admitted to failing to act to get his daughter medical attention in the days leading to her death.

Standing before Monroe County Court Judge Christopher Ciaccio in a white T-shirt and baggy sweats, with his head freshly shaven, Stagles admitted that he knew Brook was very sick, but still did not take her to a doctor.

Brook died Nov. 14, 2016, of complications related to a beating. Her intestines had ruptured, leading to a systemic infection called sepsis.

Stagles said he did not know that Bell had punched Brook in the stomach sometime on Nov. 11, 2016.

"I was working on my vehicle that day and when I got home, Erica told me she was sick," he said. He also said he did not know that when Erica Bell promised him on Nov. 12, 2016 that she was taking the girl to a doctor, that Bell instead planned to go to North Clinton Avenue to buy heroin.

Stagles also denied that Brook complained of stomach pain during the weekend before her death, but admitted that she was continually vomiting and that he knew she should have been seen by a doctor.

On Sunday, Nov. 13, 2016, Stagles said, he tried to give Brook some water and Gatorade, but she refused to take any liquids. That was when he took her to Rochester General Hospital.

Bell, 25, was convicted last month of second-degree murder and first-degree manslaughter in connection with Brook's death. At the conclusion of her bench trial, Monroe County Court Judge Christopher Ciaccio said Bell was "supremely selfish, concerned with her own self-preservation" and that she possessed a "wicked, evil or inhuman" state of mind.

In the days leading up to Brook's death, Bell beat the girl severely, and subsequently thwarted attempts by others to get medical care for the girl. In phone calls she made from jail, Bell also repeatedly asked her grandmother to make sure Michael Stagles did not take his daughter to a doctor.

The plea deal means he could get as little as 1 1/3 year in jail. Hopefully he'll get one of the no nonsense judges that doesn't tolerate child abuse. We do have a couple here.

“There are few things that shock a community more than the beating death of a child,” Ciacco said moments before handing down Bell’s sentence.

He did not yield to pleas from defense attorney Lawrence Kasperek to show his client leniency. Kasperek argued — as he had at trial — that Bell was a “textbook case of a battered woman” and that Brook’s father Michael Stagles shared blame for the girl’s death.

Kasperek had urged Ciaccio to deliver Bell a sentence not influenced by “a community driven by bloodlust, looking for vengeance.”

Ciaccio said Bell’s heroin use and past abuse were not a shield for her actions.

Testimony at trial alleged that Bell hit Brook because she had come into the room while Bell was shooting heroin.

“Heroin had nothing to do with you hiding Brook’s injuries,” Ciaccio said to Bell. “These were acts of a person fully in control of their faculties.”

Ciaccio said he was especially struck at trial by a picture presented by prosecutors of Brook standing in her maternal great-grandmother’s Greece living room, grinning broadly next to a Christmas tree. The photo was taken just days before Brook was beaten.

“That is an image of hope, the future,” he said. “The hope that this is the one who can break free, of the cycle of addiction, of abuse, of living in a cockroach-infested home.”

And that future will now never be known, he said.

Michael Stagles, the father of 3-year-old Brook Stagle was sentenced to 1 1/3 to 4 years in prison.

Brook was beaten to death in November 2016 by his girlfriend Erica Bell. She was sentenced to 25 years to life in state prison.

In court Wednesday morning, Stagles apologized to the judge and the courtroom for what happened.

In the cold sterility of her hospital room, Brook Stagles drew her last breaths cradled in her mother’s arms.
Brook was just 3 years old on Nov. 14, 2016 when she died from injuries related to a beating delivered days before by her father’s live-in girlfriend Erica Bell.
Brook was so battered and bruised, hospital employees asked family members if she’d been in a car accident.
In a victim impact statement before Monroe County Court Judge Christopher Ciaccio on Wednesday, Brook’s maternal grandfather John Geer described his family’s confusion, horror and fear after being summoned to Rochester General Hospital the night before Brook died.
“Nobody should ever hold a dying child in their arms,” Geer said.

Geer said his daughter Ashlee — Brook’s mother — lay beside Brook’s tiny body and spoke soothing words of comfort to her lifeless form for nearly an hour after she had died. The girl’s injuries had been too severe for pediatric surgeons to fix.
“I wouldn’t wish that on anybody,” he said. “So many people have been traumatized by all of this.”
Geer’s comments came just before Ciaccio handed down the maximum sentence to Bell, a 25-year-old heroin addict from Spencerport who was convicted in September of second-degree murder and first-degree manslaughter for Brook's death.
