Madison — A woman accused of stealing her half sister's newborn boy and abandoning the infant behind a gas station in frigid temperatures made her first court appearance in Wisconsin on Friday to answer a federal kidnapping charge.

Kristen Smith, 31, could face life in prison if she's convicted. She made her initial appearance in front of ... after federal marshals transported her to Madison from West Branch, Iowa, where she faces a state child endangerment charge.

Authorities say the Denver woman took the baby from a Beloit home and left him in Iowa as investigators closed in on her. A police chief found the baby alive and well 29 hours later.

Friday's court proceeding ... lasted less than five minutes. Smith's public defender, Kelly Welsh, told Crocker that Smith's family was trying to hire a defense attorney. The judge said he didn't want to schedule anything until that attorney was in place and ordered Smith to remain in custody until the lawyer can participate in a detention hearing.

The baby's parents, 18-year-old Brianna Marshall and 23-year-old Robert Powell, and other family members looked on from the gallery as Smith sat quietly. Dressed in a gray top and black slacks with her hair tied back in a ponytail, she appeared relaxed.

The parents left without talking to reporters, but the baby's great-uncle, Mark Bennett, said he was disgusted with Smith's demeanor.

"She won't get away with this one," Bennett said. "We're going to be here every day."

Attorneys agree that part of an interview between police and the woman charged with kidnapping a 5-day-old infant won’t be used in court.
[...]
Defense attorney Matt Noel said during a preliminary hearing Thursday that Smith wasn’t read her rights before FBI agents interviewed her. Prosecutors agree that about two hours of the daylong interview shouldn’t be used in court.

But Noel wants everything Smith told police to be kept out of court. Smith testified in U.S. District Court that she asked for a lawyer during the early stages of the FBI interview.

is also evidence through face book and emails that Smith tried to fake a pregnancy.

In earlier court hearings Smith's lawyer argued the court should throw out the evidence against her.

That didn't happen, and if Smith is convicted in this case, then she could face life in prison.

I hope she gets the book, and the rest of the tree it came from, thrown at her. Why aren't they charging her with attempted murder too?

MADISON (AP) — Guilty! That’s the verdict handed down Thursday, July 31st by a jury in the case of Kristen Smith [...]

Smith, of Colorado, is now convicted — after kidnapping her newborn nephew in Wisconsin and leaving him at an Iowa gas station in frigid temperatures.

The attorney for [...] Smith said Thursday the government is misinterpreting her motives.

Prosecutors say she took four-day-old Kayden Powell from the Town of Beloit in February. As police closed in, she put him inside a plastic tote and left him at an Iowa gas station.

The baby survived, despite spending 29 hours in frigid temperatures.

Smith says Kayden’s father asked her to take him because the parents were moving in with her soon.

Prosecutors say Smith was actually scheming to pass the boy off as her own.

Smith now faces 25 years to life in prison.

Smith says Kayden’s father asked her to take him because the parents were moving in with her soon.

And did the father also ask her to leave this beautiful 5 day old infant in a lot filled with weeds and trash, during frigid winter weather?

I hope she gets at least 29 years -- one year for each hour that tiny little baby had to fight to survive, all on his own.

"Kristen Smith left a baby outside in bitterly cold temperatures and for over 24 hours denied any knowledge of his whereabouts," said John W. Vaudreuil, U.S. Attorney for the Western District of Wisconsin, in a statement. "Her callous disregard for this child's life merits this long prison sentence."

Prosecutors in Wisconsin believed Smith faked being pregnant after they found a prosthetic pregnancy belly in her car and Facebook postings in which she claimed to be with child.

Smith had been arrested a day before the infant was found at the same gas station. Police had searched her car and found a car seat and a stroller, but no baby.

Smith also received 10 years of supervised release, according to a spokeswoman for the U.S. Attorney's Office.
