Because of the federal indictment, the Boulder District Attorney's Office has dropped its case against Spitzer, spokeswoman Catherine Olguin said Monday.
Spitzer had been charged with four counts of sexual exploitation of a child. Two of the counts were for selling or publishing sexually exploitative material, while the other two were for possessing more than 20 items or videos, according to court records.

Boulder police were alerted when a child pornography investigation out of Jefferson County traced pornography downloads in January to an IP address listed to Spitzer's father, John Spitzer, the PLAN-Boulder County member and founder of the Whittier Neighborhood Association.
On Feb. 7, police officers served a search warrant at John Spitzer's home at 2323 20th St., where Christopher Spitzer also lives.
Police seized a laptop belonging to Christopher Spitzer and found hundreds of images and videos of child pornography, with some of the children as young as 4 years old, according to police.
In an interview with a detective, Christopher Spitzer admitted to possessing the child pornography.
Spitzer was also arrested in a child pornography case in Gunnison in 2005. He pleaded guilty in that case to a misdemeanor charge of possession of child pornography and was sentenced to 60 days in jail and five years of probation.
In late 2016, Spitzer applied to de-register from the sex-offender registry because he had been off of probation for five years and had not been arrested on any new charges in that time.
A judge granted the order on Dec. 20, 2016, according to court records.
