Wesley’s injuries were discovered Thursday at about 4 p.m. when emergency responders went to the scene of a two-vehicle crash at Audubon and Mountain Lake roads, Cook said in his complaint.

Wesley’s mother told police that she and her boyfriend were taking the child to the hospital when they crashed into the back of a car, records said.

The physician reported that the child was "neurologically devastated," and noted injuries to the boy's skin that were consistent with "nonaccidental immersion scald burns," Cook said in his complaint.

McKinley told police he had been giving the baby a bath and was unaware there was anything wrong until the baby’s skin turned red, court records said.

According to the defendant, the baby did not cry, Cook said in his complaint.

McKinley also said he had checked the bath water with his hand, and it seemed fine, records said.

But after the baby’s skin started turning red, the defendant told police he drained the water and ran cold water over the child, court records said.


The trooper said that the child's mother indicated that her boyfriend told her when she returned home that the baby had been burned while he was giving him a bath, records said.

The woman, who was at a grocery store, told police that she found her child in the tub, and her boyfriend was running cold water over him, records said.

She said the tub was not full of water, and denied the trooper’s request to search the home, records said.

While speaking with McKinley, Cook said he noticed that his eyes were glassy and bloodshot, and he smelled alcohol on the defendant’s breath, court records said.

McKinley told the trooper he had consumed one can of an alcoholic beverage. A preliminary breath test determined his blood-alcohol concentration was 0.116, records said.

After conducting the test, Cook said the defendant requested a lawyer and did not wish to speak further about the incident, records said.

How was the child "neurologically devastated"? Doesn't this refer specifically to brain damage, and not neuropathy?

Were they holding the child without safety restraints when the car accident occurred?

When asked about the potential impact of the vehicle crash, Cook said the physician indicated it was "not a reasonable explanation for the amount of head trauma that was sustained by Wesley," court records said.

Have a bad feeling the reason behind burning this baby was to mask those other injuries. From what I read on where's baby Kate, he had 3rd degree burns on 95% of his body. And the asshole made sure this child's face was burned.
 
I bet he immersed the child in the hot water for a long time in an effort to bring him out of his unconcious state from the head trauma this asshole inflicted on the baby. Then tried to run the cold water but it was too late.

The mother of a 14-month-old boy, who died after apparently being scalded by hot bath water on May 5, also has been charged in connection with the child's death in addition to her boyfriend.

Brittany Rose Reuille, 24, of Algonquin Trail, Hedgesville, W.Va, was arraigned Thursday on one count of child neglect resulting in death after a preliminary hearing was held for her boyfriend, Michael Patrick McKinley, in Berkeley County Magistrate Court, according to court records.

Wesley Todd Mowery III died a week ago at Children's National Health System in Washington, D.C., where a forensic pediatrician documented second- and third-degree burns on the child's body and "head trauma consistent with child maltreatment (abuse and neglect)," records said.

Reuille was being held in Eastern Regional Jail on Friday on a $250,000 surety/cash bond, records said.

McKinley, 29, also was being held in jail on single counts of death of a child by guardian/custodian by child abuse and child neglect resulting in injury, records said.

The case against McKinley is now pending in Berkeley County Circuit Court, records said.

West Virginia State Police Trooper T.W. Cook said in a complaint that McKinley testified Thursday in magistrate court that the child's mother had left Wesley in the bath tub alone on several occasions, so he didn't think it was a concern that he should leave the boy unattended while he smoked a cigarette, records said.

Cook said Reuille knew McKinley had been drinking at the time of the incident, and also knew that her brother had turned up the temperature on the hot water heater at the residence because the water was not getting hot, records said.

She also indicated that the water would get "really hot" as a result of the change, records said.

Cook had previously estimated the boy had severe burns over about 95 percent of his body when he saw the child in the back of an ambulance upon responding to investigate a two-vehicle crash at Audubon and Mountain Lake roads, court records said.

The trooper said that Reuille had said that she and McKinley were taking the boy to the hospital for treatment when she stepped on the brakes of the car to stop behind another vehicle and nothing happened, resulting in the crash, records said.

Cook said video footage recorded at the crash scene indicated that McKinley was driving. When Cook said he asked Reuille about footage, and why she would have let McKinley drive the car if she knew he had been drinking, Reuille said, "she was just sticking to his story and she did not know."

McKinley previously had told the trooper that he had consumed one can of an alcoholic beverage. A preliminary breath test determined his blood-alcohol concentration was 0.116, records said. The legal limit for driving is 0.08.

McKinley initially told police he had been giving the baby a bath and was unaware there was anything wrong until the baby’s skin turned red, court records said.

After the baby’s skin started turning red, the defendant told police he drained the water and ran cold water over the child, court records said.

Reuille, who was at a grocery store, told police that she found her child in the tub, and McKinley was running cold water over him when she returned home, records said.

When asked why she didn't immediately call 911, Cook said Reuille indicated she didn't know where her phone was and was panicked about getting the child to the hospital.

people want to exist in a perpetual state of instant gratification like an animal until the "oh noes!!" show up. why would you drive an injured child to the hospital instead of calling an ambulance? maybe you were wanting to dump a body but hit a car instead.
Or wanting to purposefully have an accident to explain away head trauma

He deserves a lot more than 15 years! The defense thinks this could have happened while the baby was alone? That's why he wasn't convicted of abuse, only neglect. Even if he could manage to turn the hot water on, (a plumber testified that it was 143 degrees ) how long does it take to fill up the tub? He would have been screaming the whole time! And this POS claims that he was in the kitchen smoking. Why wouldn't he have gotten him out right away? Two experts testified that the burn pattern was that of "immersion". He held that baby down in that water
Maybe the jury couldn't believe anyone could be that evil but we know better.
 
I agree with above theory, the fry pit treatment was to cover up a lot of other abuse and try for an accidental death. This baby probably already was looking like his real dad and guppy momma was all more than willing to sacrifice him to keep her latest snag [like triple ew gag]

Michael P. McKinley, 31,convicted of child neglect causing the death of a 14-month boy who died in scalding hot bath water was sentenced to serve three to 15 years in prison for his role in the incident.

McKinley, was also sentenced to serve 20 years of supervised release following any period of incarceration or parole and to register on the child abuse and neglect registry with the West Virginia State Police for 10 years.

On May 5, 2016, McKinley was giving Wesley Todd Mowery III a bath when he went to smoke a cigarette in the kitchen, court records said. McKinley was babysitting the toddler while the child’s mother, Brittany Reuille, 26, was running errands.

Approximately 95 percent of the toddler’s body was covered in second- and third-degree burns.

During sentencing Monday, McKinley’s attorney, J. Mark Sutton, argued that his client’s intent was to give “baby Todd” a bath to impress his girlfriend and to show that he can contribute and be helpful.

He also said the temperature of the water heater, which was discovered to be set too high at 140 degrees, could not be discounted.

Sutton added he believes the facts and jury’s verdict shows that he did contribute to the child’s death, but there was no evidence to support that he showed the child anything but care.

The state argued that on top of the incident, “baby Todd” was suffering for an hour before Reuille returned home, but McKinley could have gotten help before then because there was a cellphone on a table in the kitchen, he had keys to a car and could have gotten help from a neighbor.

Assistant prosecuting attorney Hassan Rasheed said this is a case of “gross neglect at its worst” and the case “cries out for punishment.”

The child’s injuries were first discovered when McKinley, Reuille and the child were involved in a car accident while on route to the hospital.

Brittany Rose Reuille, 26, pleaded guilty to a misdemeanor charge of child neglect creating a risk of bodily injury and a second misdemeanor charge of obstructing a police officer. The misdemeanor neglect charge said Reuille left her child “unlawfully but not feloniously” in the care of Michael P. McKinley while he was intoxicated.

Reuille admitted Monday to leaving her son with McKinley, who she knew had been drinking and was not experienced with kids.

A plea agreement was reached in Reuille’s case prior to trial, which called for her to plead guilty under Alford circumstances to one felony count of child neglect creating risk of injury or death. A term of the agreement required Reuille to testify in McKinley’s case. In exchange for the agreement, the state recommended Reuille for probation.

Assistant prosecuting attorney Hassan Rasheed said this new plea is in the interest of the public because it aligns with her culpablilty, and that the state believes it may be difficult to convince a jury of the felony charge.

Per the binding plea agreement, Reuille was sentenced to time served on the obstruction charge — having previously served 300 days in jail after the incident. She was also sentenced to serve three years of supervised probation for the neglect charge.

Reuille testified in the trial that McKinley got along with her children “very well,” and he treated them as family. She agreed that McKinley was willing to help with the kids in any way he could, and she never had any concerns with leaving McKinley home alone with the baby.

Anybody giving a 14mo a bath that is interested in impressing the child mother with his wonderous helpfulness would not leave him unsupervised in the bath tub. He ran that hot water and he sat that baby in it and stood and watched while little Todd screamed and burned. He got off light, I would have killed him with my very own hands if he had hurt my baby.:mad:
