Wesley’s injuries were discovered Thursday at about 4 p.m. when emergency responders went to the scene of a two-vehicle crash at Audubon and Mountain Lake roads, Cook said in his complaint.
Wesley’s mother told police that she and her boyfriend were taking the child to the hospital when they crashed into the back of a car, records said.
The physician reported that the child was "neurologically devastated," and noted injuries to the boy's skin that were consistent with "nonaccidental immersion scald burns," Cook said in his complaint.
McKinley told police he had been giving the baby a bath and was unaware there was anything wrong until the baby’s skin turned red, court records said.
According to the defendant, the baby did not cry, Cook said in his complaint.
McKinley also said he had checked the bath water with his hand, and it seemed fine, records said.
But after the baby’s skin started turning red, the defendant told police he drained the water and ran cold water over the child, court records said.
The trooper said that the child's mother indicated that her boyfriend told her when she returned home that the baby had been burned while he was giving him a bath, records said.
The woman, who was at a grocery store, told police that she found her child in the tub, and her boyfriend was running cold water over him, records said.
She said the tub was not full of water, and denied the trooper’s request to search the home, records said.
While speaking with McKinley, Cook said he noticed that his eyes were glassy and bloodshot, and he smelled alcohol on the defendant’s breath, court records said.
McKinley told the trooper he had consumed one can of an alcoholic beverage. A preliminary breath test determined his blood-alcohol concentration was 0.116, records said.
After conducting the test, Cook said the defendant requested a lawyer and did not wish to speak further about the incident, records said.
