Robert Richard
— A du Pont family heir who raped his 3-year-old daughter nearly a decade ago but received no prison time now faces a lawsuit from his former wife that accuses him of sexually abusing his toddler son.
Robert H. Richards IV, 47, who is supported by a trust fund and who paid $1.8 million for his 5,800-square-foot mansion near Winterthur Museum, pleaded guilty in 2008 to fourth-degree rape of his daughter. Currently on probation, he has never been charged with crimes against his son.

The lawsuit provides in-depth details about a child rape case that Delaware authorities never disclosed publicly and did not receive media attention.

Richards is a scion of two prominent Delaware families — the du Pont family who built the chemical empire and the Richards family who co-founded the prestigious corporate law firm Richards Layton & Finger. Du Pont family patriarch Irenee du Pont is his great grandfather. His father, Robert H. Richards III, was a partner in the law firm until his 2008 retirement.

On Tuesday, nearly six years after Richards’ felony conviction, his ex-wife, Tracy Richards, filed a Superior Court lawsuit on behalf of her children seeking compensatory and punitive damages for assault, negligence, and intentional and negligent infliction of emotional distress on his two children. Abuse of the children occurred at both the Greenville and North Shores homes

The lawsuit claims that Richards raped his daughter, now 11, in 2005 when she was 3. Several times, he entered her bedroom at night while she slept and penetrated her with his fingers while masturbating, said the lawsuit, which includes documents from the criminal case.

Richards told the girl “to keep what he had done to her a secret,” but in October 2007 she told her grandmother, who informed Tracy Richards, the lawsuit said. The girl was taken to her pediatrician, whom she told about the abuse, and New Castle County police arrested him

obtained a grand jury indictment charging him with two counts of second-degree rape, a Class B felony that carries a mandatory two-year prison term for each conviction. Delaware law requires a sentence of two to 25 years in prison but sentencing guidelines urge a sentence of two to five years.

Utilizing “his family’s wealth and position in the community,” Richards IV hired prominent Wilmington defense attorney Eugene J. Maurer Jr. and denied the charges, the lawsuit said. But after volunteering for and failing a polygraph examination, he admitted abusing his child, “then claimed that he was ill and that he needed medical treatment,”

In June 2008, he avoided mandatory prison time by pleading guilty to a single count of fourth-degree rape in a deal arranged by Maurer and prosecutor Renee Hrivnak, court records show. Fourth-degree rape is a Class C violent felony that under Delaware law can bring a sentence of up to 15 years in prison, but does not carry a mandatory minimum sentence.

Superior Court Judge Jan Jurden sentenced Richards to eight years in prison but suspended that for Level II probation, which requires monthly visits with a case officer. Jurden also ordered him to pay $4,395 to the Delaware Violent Crimes Compensation Board, records filed with the lawsuit show.

The lawsuits asserts that Roberts also admitted in April 2010, while on probation, that he sexually abused his son. Those assaults began around December 2005, when the boy was 19 months old, and continued for about two years,

The revelations allegedly came while Richards was taking a lie detector test, ordered in an attempt to get Richards to be more forthcoming about his sexual history. Richards told the examiner he “was very concerned that something happened with his son but that he has repressed the memories,’ “ He told the examiner he worried that his acts were “similar to what happened with his daughter,” the lawsuit said. “But he promised that whatever I did to my son, I will never do it again.”

That September, his probation officer informed Superior Court that during the polygraph, “the possibility of sexual contact” with his son “came to light,” according to the officer’s progress report,
[...]
In a 2012 progress report, another probation officer reminded the court that “there are concerns about Mr. Richards’ past offenses concerning his son.”

The proven abuse of his daughter and alleged assault of his son has caused his children “long-term injuries,” the lawsuit filed Tuesday said, perhaps including depression, post-traumatic stress disorder, sexual dysfunction and shame.

His daughter also has “repressed memories of some instances of the abuse she suffered,” and if the son was abused, the same is true with him, the suit said.

With medical treatment, the lawsuit said, those memories will likely “begin to surface.”

Its sad he got off with a slap on the wrist. I hope he is not allowed any contact with his kids. He is nothing more than a disgusting pathetic pedophile. I hope his income is significantly impacted by this lawsuit...to the point he has to downsize to a little apartment...with no servants and no luxuries. It pisses me off him sitting all fat and happy...not a care in the world for the suffering he put his own kids through.

Just fucking disgusting and looks like a sick pervert! Sadly many very wealthy men have some sick perverted sexual fetishes. For them to have given him a get out of jail free card because of his money and not exposing him in the media they allowed him an opportunity to pray on other unsuspecting children. I wouldn't be surprised if they start coming out of the wood work now. How many girlfriends has he had with young children since 2005 that were so blinded by the money that they probably failed to see anything that should have been a warning sign....Sucks to be these poor kids rich as fuck and fucked up in the head because daddy is a sicko pervert.

I'm sorry to tell you this but he didn't necessarily get a slap on the wrist because he has money. I know of an animal that has been sexually abusing children for many years. He abused his daughters and was ordered into counseling. It was kept quiet. He then abused a friend of his family's child. The judge and DA was going to give him 6 months in county jail. The mother went ballistic and told them that she dared them to give him 6 months. She threatened to go to every news station, radio station, newspaper and magazine that would listen to her and let them know what they were trying to do. They decided that maybe they should re-think things and asked what she felt would be appropriate. She decided that a sentence of a minimum 6-8 years in prison would at least let his girls grow up without being abused. That is the sentence he received. Since he got out of prison he has been caught 2 more times. Guess what the sentence was? 6 months in county jail. She couldn't do anything about it since he has moved from the area. He won't show his face near this mother.

Why is the ex wife suing for money? Why are the police not arresting him for the abuse of the son? I just hate when shit has to boil down to money.

Repressed his memories. Fucking sicko probably still gets off to those same exact memories he "repressed".

And I think she's suing for money to hit him where it hurts since the police didn't do it themselves.

I don't know why but I always find it intriguing when the well-to-do empire-like families have skeletons in their closets. What happened to HIM I wonder in the famous DuPont/Richards family? I think we've come to expect the worst of the trailer park families who cage their kids....but when the rich do it it can throw us for a loop.

What I hate most about this is money is what's being asked for. Not time. Money makes counseling payments easier, sure but...it feels very calculated to me. The next generation are pawns just as much as the last.

No amount of money can wipe the filth out of his soul. Disgusting animal. I'm so sickened by this case. His kids received no justice for what he did to them.

I know if he was deranged enough to abuse his kids, he abused others.

Yes, they have always abused others. Our society doesn't seem to understand that you can't cure pedophilia. The urges escalate and many victims are never even known about. Death is the only logical solution. Personally I'd like to see the rubber tire and fire method used!

What I think is interesting is that drug offenses allow them to seize any property us in furtherance of criminal activity. Wouldn't it be interesting to see that same law applied in some of these child abuse cases? Fat ass here would lose him homes, car used to transport the victims. Etc.

Maybe it's just me, but this makes me want to stop using any products made by DuPont. I don't want to subsidize this sicko's existence. :vomit:

That probably isn't it.

When I was 10 until the time I was 16, I was sexually abused by a stepfather. When my mom divorced him, she told the police about the abuse (I told her about it years before). After the interview, I told the social worker that I felt that my mom only cared about getting what she wanted in the divorce. I was 17 at the time. Anyway, there was no physical proof as I wasn't ever penetrated, so the only evidence they had was my testimony. Many times, that's all they have when prosecuting child sex crimes. Because they felt I was not a reliable witness (they said I was influenced by my mother and her wanting to get support from my stepfather in the divorce), they couldn't charge him.

It's the same situation for the 19 m/o. Obviously he can't testify. Any physical proof would have healed. And a first year law student could get his comments about something maybe happening thrown out.

In a criminal trial, the prosecution has to prove beyond a reasonable doubt that the crime happened. sadly, I doubt they could do that in this case. In a civil case, i.e. the mother suing, the burden of proof is much lower. The party who is suing only has to prove that it's likely that the even occurred. So it's probably not all about the money. It's probably the only way he will see any type of punishment.

It is disgusting when it boils down to money, but honestly? Sometimes, that is all people like him understand. I am also faced with a similar person as an ex, although not in anyway the same situation. The money the mother receives would ensure that her children get the best counseling and care for what he did to them. That is probably the best she can hope for in this situation and he SHOULD have to pay for it, he should have to pay for every bad dream, psychological issue and any other related problem the children have. He caused it, he should pay for it and then we can all hope and pray that this sick MF dies a horribly painful and torturous death.

How about this then, if money is an issue....sue the fuck out of him, for both children, and place it in a trust fund ( plus ample cheese for counseling on the now) That way mom wont be accused of being trifle, and the kids will have a cushion.

:finger::finger::finger:FUCK YOU JUDGE JAN JURDEN!!!:finger::finger::finger:
A judge who sentenced a wealthy du Pont heir to probation for raping his 3-year-old daughter noted in her order that he “will not fare well” in prison and needed treatment instead of time behind bars, court records show.

Superior Court Judge Jan Jurden’s sentencing order for Robert H. Richards IV suggested that she considered unique circumstances when deciding his punishment for fourth-degree rape. Her observation that prison life would adversely affect Richards was a rare and puzzling rationale, several criminal justice authorities in Delaware said. Some also said her view that treatment was a better idea than prison is a justification typically used when sentencing drug addicts, not child rapists.

[....]

The fact that Jurden expressed concern that prison wasn’t right for Richards came as a surprise to defense lawyers and prosecutors who consider her a tough sentencing judge. Several noted that prison officials can put inmates in protective custody if they are worried about their safety, noting that child abusers are sometimes targeted by other inmates.

[...]

O’Neill said he and his deputies have often argued that a defendant was too ill or frail for prison, but he has never seen a judge cite it as a “reason not to send someone to jail.”

[...]

Richards, who is unemployed and supported by a trust fund, owns a 5,800-square-foot mansion in Greenville, Del., he bought for $1.8 million in 2005. He also lists a home in the exclusive North Shores neighborhood near Rehoboth Beach, according to the state’s sex abuse registry. His great-grandfather is du Pont family patriarch Irenee du Pont, and his father is Robert H. Richards III, a retired partner in the Richards Layton & Finger law firm.

Jurden, who has been a judge since 2001, and Superior Court President James T. Vaughn Jr. did not respond to questions last week about the case.

[....]

According to the arrest warrant filed by a New Castle County Police Detective JoAnna Burton in December 2007, the girl, then 5, told her grandmother, Donna Burg, that Richards sexually abused her.

[...]

Tracy Richards, who confronted her then-husband, told police he admitted abusing his daughter but said “it was an accident and he would never do it again,” the warrant said.

[...]

But in June 2008, just days before a scheduled trial, prosecutor Renee Hrivnak offered Richards a plea to a single count of fourth-degree rape, which carries no mandatory time, and he accepted, admitting in court that he abused his child.

“It was more than reasonable, an enlightened plea offer,” Richards attorney Eugene J. Maurer Jr. said.

Fourth-degree rape is a Class C violent felony that by law can bring up to 15 years in prison, though guidelines suggest zero to 2 1/2 years in prison.

[...]

Biden spokesman Jason Miller said the attorney general – who routinely hails the prosecution of child predators as a top priority for his office – did not know about the case.

Miller said only Hrivnak and her supervisor, Allison Texter, were part of the decision on how to resolve the case. Texter, who is now in private practice in Wilmington, did not return calls for comment.

[...]

McConnel would not discuss the rationale behind the Richards’ plea deal and Hrivnak’s recommendation of probation for the fourth-degree rape conviction.

[...]

“Defendant will not fare well in Level 5 setting,” said the final line of her sentencing order. In Delaware’s correctional system, Level 5 is prison.

Joseph S. Grubb, chief New Castle County prosecutor, said he was not involved in the case, but stressed that whether Richards might suffer or thrive in prison was not something prosecutors considered.

[...]

Defense lawyer Joseph A. Hurley said it makes sense to him that the judge would be concerned about Richards’ time in prison.

“Sure, they have protective custody, but that is solitary confinement for 23 hours a day. We’re not a third-world society,” Hurley said.

“Sex offenders are the lowest of the low in prison,” Hurley said. “He’s a rich, white boy who is a wuss and a child perv. The prison can’t protect them, and Jan Jurden knows that reality. She is right on.”

She sentenced him so lightly because his daddy was a big time lawyer in the area, professional courtesy and all that. I hope karma bites that judge in the ass too.

The dumb cunt should have also taken into consideration that those were the Big time lawyer's grandkids. I hope this gets so much attention, she steps down as a judge.

Sooo... what you're saying is that it's more important to protect a pedophile than his victims. I've never understood this. Who pays the cost of "fixing" this asshole? How about we put that money towards helping his victims heal?

And who the hell "fares well" in prison?!

Well, I wonder how well the children have fared having been molested or doesn't that matter until they have money to spend too?

Age limit or family blood does not seem to matter to some kiddy fiddlers, and this story proves it.
n-ROBERT-H-RICHARDS-IV-large.jpg

A Delaware man convicted of raping his three-year-old daughter only faced probation after a state Superior Court judge ruled he "will not fare well" in prison.

In her decision, Judge Jan Jurden suggested Robert H. Richards IV would benefit more from treatment. Richards, who was charged with fourth-degree rape in 2009, is an unemployed heir living off his trust fund. The light sentence has only became public as the result of a subsequent lawsuit filed by his ex-wife, which charges that he penetrated his daughter with his fingers while masturbating, and subsequently assaulted his son as well.

Richards is the great grandson of du Pont family patriarch Irenee du Pont, a chemical baron.

According to the lawsuit filed by Richards' ex-wife, he admitted to assaulting his infant son in addition to his daughter between 2005 and 2007. Richards was initially indicted on two counts of second-degree child rape, felonies that translate to a 10-year mandatory jail sentence per count. He was released on $60,000 bail while awaiting his charges.

Richards hired one of the state's top law firms and was offered a plea deal of one count of fourth-degree rape charges -- which carries no mandatory minimum prison sentencing. He accepted, and admitted to the assault.

In her sentence, Jurden said he would benefit from participating in a sex offenders rehabilitation program rather than serving prison time.

He won't fare well in prison?! Isn't that the whole friggin' point of prison? Last I checked, prison is supposed to be punishment, not a day at Disneyland. He should have to live in fear. It would serve the bastard right after the fear he subjected his poor kids to. Fuck him.

Oh, his lawyer says he'll have to be locked up 23 hours a day to protect him from other inmates? Wah. Where was the protection for his kids when he was raping them? Those poor kids were afraid of what was going to happen to them at the hands of their piece of shit father 24 hours a day. Where's the justice for them?

And when this lowlife was first caught, he claimed that raping his daughter was a mistake and he'd never do it again. Yeah, tell that bullshit to his son, whom he raped next.

There is no rehabilitation for this sick fuck. He will always be turned on by little kids. With his trust fund and not having to work, he's got way too much time on his hands. I guarantee he'll do this again to some poor, innocent soul. If he could do that to his own kids, whom he was supposed to protect, I guarantee he'll have no qualms about doing it to someone else's kid.

He deserves to be in prison, living in fear, having nightmares of the abuse the other inmates would deal out to him.

She sentenced him so lightly because his daddy was a big time lawyer in the area, professional courtesy and all that. I hope karma bites that judge in the ass too.

You are probably right. It makes me sick. When this jackass reoffends, and I have no doubt that he will, I hope that judge has lots of sleepless nights thinking about how she's responsible for letting him out to attack his next victim.

Sorry for the length. I'm just disgusted right now. :rage:

This is just the most ridiculous arguement for light sentencing that I have ever heard. By this logic, no pedos could be sent to jail, they'd all have to get probation. Wealth appears to be the only factor at play here

The prosecutor, her supervisor and the judge should all be investigated. I wonder if it is a coincidence that the supervisor, Allison Testes, is now in private practice?
