Tulsa Sexual Assault Suspect Charged With 15 Counts

TULSA, Oklahoma -
A sexual assault suspect, arrested a week ago, is behind bars and facing more than a dozen charges. Prosecutors filed those charges Friday and charged him as a youthful offender.

Prosecutors said the reason he wasn't charged as an adult was because of his age. Dayquan Williams is only 16 and the charges are so serious for his age, by law he falls into this special youthful offender category.

Prosecutor Steve Kunzweiler, said, "For the longest time we had a sequence of offense and victims, where this was a stranger. It was only through the good efforts of the Tulsa Police Department, and their detectives, where we got to the point where we can identify a suspect."

With that evidence from police, prosecutors charged Williams with attempted 1st degree rape, three counts of forcible sodomy, three counts of sexual battery, two counts of kidnapping, two counts of assault and battery, two counts of first degree burglary, robbery with an imitation firearm and attempted robbery.

Tulsa Police connected Williams to an assault on a Union student on her walk to school last month, as well as three other attacks.

Detectives said he's responsible for attacks at a south Tulsa coffee shop and two area apartment complexes that date back to late last year.

Damon Williams, Dayquan's older brother, said his little brother dropped out of high school and was trying to get his life back on track.

This kid was severely failed, he needed help a long time ago.
I always wonder about cases like this...would they be different if they got the emotional help they need or would they end up doing the same things even with it? Some people are born 'psychos' and nothing will change that but there are many people that do get help and change their ways. Why wasn't his behavior noticed before? I can't imagine he just woke up one day thinking today will be a good day to rape people!
 
He is NOT be charged as a "juvenile". He's being charged as a "Youthful Offender". It's sort of a middle ground between the juvie system and full on adult prison.
The idea behind the youthful offender act was to get tougher on teenagers who commit violent crimes than we used to, when they were only handled in the juvenile system. However, it was also to give them a chance to be rehabilitated, instead of sending them to adult prison, where they'd likely just turn into hard-core criminals.

What does that mean? It's tougher than being treated as a juvenile, but still gives teenagers a chance to turn their life around.

A 16-year-old treated as a juvenile, might get probation or juvenile detention, but has to be released when they're 18 and their record will be sealed.

A 16 year old youthful offender, might go to jail, although they're kept separate from the grownups. The maximum sentence they can get is 10 years. If they do all the right things, they'll be released when they're 21 and their record can be sealed. If they keep getting in trouble, they can be sent to adult prison to serve the rest of that 10 year sentence.

A 16-year-old treated like an adult, goes to adult prison can be there for life and it will always be on their record.

The youthful offender program is an opportunity for kids to get back on track so their whole life isn't ruined, but not everyone takes advantage of that opportunity.

Call me skeptical, but the kid's brother says he is already trying to get his life "on track" and I truly don't see that it's working. Why should I believe it will work this time, in this way? 16 years old is plenty old enough to be tried as an adult for rape.

Since the law doesn't allow for that, the alternative is the Juvenile system. The Youthful Offender Program allows for harsher punishment and longer oversight.

This really surprised me. I'd been under the impression that 17 & 18 were the ages in most states.

But I still disagree. Sixteen years old is not an adult. Granted, there is nothing magical about turning eighteen years old, but a line must be drawn somewhere to distinguish between juvenile and adult offenders. Otherwise you're bound to end up on a slippery slope, and before you know it, prepubescent children are being charged as adults and sentenced to life imprisonment. (The U.S. Supreme Court ended capital punishment for minors in 2005.)
 
We need to draw the line at juveniles that commit juvenile type crimes I.e. petty theft, vandilism....stuff like that. This animal has 15 counts of RAPE against him, that is not a crime common to juveniles.

If they sentence him as a kid he will be out in no time having perfected his crimes.

This waste of human being should be locked up and the key thrown away.

Charge him as they see fit but it's a damn shame more women will be raped by this animal so some legislators can feel good about themselves. I would have no problem if this kid was sent to an adult prison. He's never going to be a "nice guy."

"Youthful Offender" categories allow for harsher penalties and longer oversight than the juvenile system while having more opportunities for rehabilitation than in the adult system.
 
I dont get this. A 15 yo girl gets s.o. status and has to register for taking a topless photo and sending it to her boyfried, who later gets pissed at her and sends it to lots at school. But this pos RAPES 15 times and if he dont reoffends, it didnt happen?

I was not being snarkey.. my personal experience from being raped twice in my childhood by two different family members is that the activity never ceases no matter what age.. he has 15 rape charges.. in all my studies throughout several degrees.. they dont change they get braver and then deadly.. no witnesses..
 
Someone had to know this kid was this fucked up. This kid was definitely failed by his family and friends. But still, what he did was horrific, and it sounds like one of the crimes was committed before he was 16.

A 17-year-old Tulsan who was charged with 21 criminal counts — including rape, forcible sodomy and armed robbery — following a three-month crime spree will be tried as an adult, a Tulsa judge ruled Monday.

At an arraignment before District Judge William Kellough earlier this month, psychologists and a representative of the state Office of Juvenile Affairs testified as to whether sentencing as a youthful offender would be appropriate in Williams’ case.
Kellough postponed ruling on the matter until Monday in order to review the transcript from Williams’ preliminary hearing before a different judge and other case materials.
Kellough announced Monday that he determined Williams is not amenable to further treatment due to the aggressive, premeditated and violent nature of the crimes and numerous failed attempts to rehabilitate him. If found guilty, Williams would be sentenced as an adult.

On Sept. 19, an expert witness told the court that Williams had a “lifelong” history of behavior problems beginning in kindergarten and was found to be emotionally disturbed in the second grade. He entered four different in-patient treatment programs in recent years.

Although he completed some of the programs, a psychologist who testified for the prosecution said he would not classify the treatment as successful due to Williams’ subsequent offenses.

“Although he may have learned some things, he didn’t apply them very well,” Dr. Shawn Roberson said.

Roberson noted a continuing lack of concern for other people in Williams’ behavior and signs of developing psychopathy.

Dr. Susan Phillips testified for the defense and told the court that Williams showed “some remorse” for his victims during her encounters with him and attributed his abhorrent sexual behavior to substance abuse.

His defense attorney, Velia Lopez, argued that Williams’ previous treatment programs, some of which were contracted with the state to treat juvenile offenders, “did not address the real problem” by failing to provide him with sex-offender treatment.

The Office of Juvenile Affairs representative told Kellough that Williams’ age would prevent him from completing the 18 months of in-patient treatment required of youthful offenders. Williams turned 17 in July, meaning he would be in OJA custody for 15 months before the agency would be required to relinquish custody of him at the maximum age of 18 years and five months.

A series of amendments have been made to Williams’ charges, which currently are:
First-degree burglary, assault and battery, and larceny from a residence at night on Nov. 17 at the Sugarberry Apartments near 61st Street and Garnett Road.

Rape, kidnapping, sexual battery, first-degree burglary and two counts of forcible sodomy at the Greens of Bedford apartments near 61st Street and U.S. 169 on Nov. 28. The initial filing listed a different date.

Robbery with a firearm, forcible sodomy, kidnapping, assault and battery, possession of a firearm after juvenile adjudication and two counts of sexual battery at the Agora Coffeehouse in the Fontana Shopping Center, 4959 S. 79th East Ave., on Dec. 3.

Kidnapping, forcible sodomy, sexual battery, attempted robbery, and assault and battery near Union High School on Jan. 29.

Williams is scheduled to return to court Oct. 6.
